His Majesty, in exercise of the power conferred upon Him by section 37(2) of the British Nationality Act 1981[^f00001], is pleased, by and with the advice of His Privy Council, orders as follows.
Citation, commencement and extent

- (1) This Order may be cited as the British Nationality (Eswatini, Gabon and Togo) Order 2023 and comes into force on 15th December 2023.
- (2) This Order extends to England and Wales, Scotland and Northern Ireland. It additionally extends to the Isle of Man, the Bailiwick of Jersey, the Bailiwick of Guernsey and the British Overseas Territories.
Amendment of Schedule 3 to the British Nationality Act 1981

In Schedule 3 to the British Nationality Act 1981[^f00002] (countries whose citizens are Commonwealth citizens)—
- (a) omit “Swaziland”, and
- (b) at the appropriate places insert the following entries—
- “Eswatini”;
- “Gabon”;
- “Togo”.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
Article 2 of this Order adds Gabon and Togo to Schedule 3 to the British Nationality Act 1981. This means that citizens of Gabon and Togo will now have the status of Commonwealth citizens. It further amends the name of Swaziland (as it previously appeared at Schedule 3) to Eswatini.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector or community bodies is foreseen.
