The Counter-Terrorism and Security Act 2015 (Risk of Being Drawn into Terrorism) (Revised Guidance) Regulations 2023

Coming into force: 31st December 2023
In accordance with section 29(5) and (7) of the Act, a draft of these Regulations was laid before Parliament and approved by a resolution of each House of Parliament.
Citation, commencement and extent

- (1) These Regulations may be cited as the Counter-Terrorism and Security Act 2015 (Risk of Being Drawn into Terrorism) (Revised Guidance) Regulations 2023.
- (2) These Regulations come into force on 31st December 2023.
- (3) These Regulations extend to England and Wales and Scotland.
Revised guidance under section 29

The “Prevent duty guidance: Guidance for specified authorities in England and Wales” issued by the Secretary of State on 7th September 2023 in accordance with section 29(6) of the Counter-Terrorism and Security Act 2015 takes effect on the day on which this regulation comes into force.

Explanatory note

Explanatory Note
These Regulations bring into effect revised statutory guidance for England and Wales about the exercise by specified authorities listed at Schedule 6 to the Counter-Terrorism and Security Act 2015 (c. 6) (“the Act”) of their duty under section 26(1) of the Act. The revised guidance replaces such guidance as came into effect for specified authorities in England and Wales on 18th September 2015 (S.I. 2015/1697).
The revised guidance was issued by the Secretary of State on 7th September 2023 in accordance with section 29(6) of the Act. It was laid before Parliament with the draft of these Regulations laid in accordance with section 29(5) and (7) of the Act on the same date. The revised guidance is available on the gov.uk website and a copy may be requested from Homeland Security Group at the Home Office, 2 Marsham Street, London SW1P 4DF or by e-mail to PreventDutyGuidance1@homeoffice.gov.uk.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sectors or community bodies is foreseen.
