Coming into force in accordance with regulation 1(2)

The Treasury make the following Regulations in exercise of the powers conferred by sections 4, 84(2) and 86(5) of the Financial Services and Markets Act 2023[^f00001].

Notwithstanding regulations 4 to 6, the PRA’s power to make general rules under section 137G of FSMA 2000[^f00007] (the PRA’s general rules) continues to include power to make rules—

PRA’s functions and powers under FSMA 2000

(aa) regulation 5, 6 or 7B of the Insurance and Reinsurance Undertakings (Prudential Requirements) Regulations 2023, or

(aa) imposed by regulation 5, 6 or 7B of the Insurance and Reinsurance Undertakings (Prudential Requirements) Regulations 2023, or

(jd) an authorised person may have contravened regulation 5, 6 or 7B of the Insurance and Reinsurance Undertakings (Prudential Requirements) Regulations 2023; or
