The Secretary of State makes the following Regulations in exercise of the powers in sections 1 and 2 of the Education (Fees and Awards) Act 1983[^f00001], sections 22 and 42(6) of the Teaching and Higher Education Act 1998[^f00002] and sections 10(4)(b) and 119(5) of the Higher Education and Research Act 2017[^f00003].

Citation and commencement

These Regulations may be cited as the Education (Student Fees, Awards and Support) (Amendment) Regulations 2023 and come into force on 16th February 2023.

Extent and application

whether or not anything done under these Regulation is done before, on or after 1st August 2023.

CHAPTER 1 — Introductory

Amendment of the Education (Student Support) Regulations 2011

The Education (Student Support) Regulations 2011[^f00005] are amended in accordance with this Part.

CHAPTER 2 — Definitions

Insertion of definition of “the course start date”

In regulation 2(1) (interpretation), after the definition of “course for the initial training of teachers” insert—

  • the course start date” means the day on which the first term of the first academic year of a course actually begins;

In Part 2 of Schedule 1 (eligible students: categories)[^f00006]—

Insertion of definition of “immigration rules”

In regulation 2(1) (interpretation)[^f00007]—

  • immigration rules” has the meaning given in section 33(1) of the Immigration Act 1971[^f00008];

In Part 2 of Schedule 1 (eligible students: categories)[^f00009]—

Amendments to the definitions of “overseas territories” and “specified British overseas territories”

In Part 1 of Schedule 1 (eligible students: interpretation)[^f00010], in paragraph 1(1)—

Amendments to the definition of “person granted leave under the Afghan Relocations and Assistance Policy Scheme”

In regulation 2(1) (interpretation) in the definition of “person granted leave under the Afghan Relocations and Assistance Policy Scheme” (as amended by regulation 7 of these Regulations)—

(ia) indefinite leave to enter the United Kingdom under paragraph ARAP 6.1 of Appendix Afghan Relocation and Assistance Policy of the immigration rules or indefinite leave to remain in the United Kingdom under paragraph ARAP 6.2 of that Appendix of those rules;

Amendments relating to the ordinary residence requirements for students in existing protected categories
