The Organic Production (Control of Imports) (Amendment) Regulations 2023

Coming into force: 1st September 2023
In accordance with Article 38b(9) of that Regulation, the Secretary of State has consulted such bodies or persons as appear to the Secretary of State to be representative of the interests likely to be substantially affected by these Regulations and such other bodies or persons as the Secretary of State considers appropriate.
Citation, commencement and extent

- (1) These Regulations may be cited as the Organic Production (Control of Imports) (Amendment) Regulations 2023, and come into force on 1st September 2023.
- (2) These Regulations extend to England and Wales and Scotland.
Commission Regulation (EC) No 1235/2008

- (1) Commission Regulation (EC) No 1235/2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries[^f00002] is amended as follows.
- (2) Omit Article 13(8) to (10).
- (3) In Annex 5 (certificate of inspection)—
- (a) in box 2—
- (i) omit “, as it has effect in Great Britain”;
- (ii) omit the words from “Council Regulation (EC) No 834/2007, as it has effect in the European Union” to the end;
- (b) in the Notes—
- (i) in the entry relating to box 2, omit the words from “, as it has effect”, in the first place it occurs, to “European Union,”;
- (ii) in the entry relating to box 4—
- (aa) omit “, as it has effect in Great Britain, or Article 2(i) of Regulation (EC) No 834/2007, as it has effect in the European Union,”;
- (bb) omit “, as it has effect in Great Britain, or Article 34 of Regulation (EC) 889/2008, as it has effect in the European Union.”;
- (iii) in the entry relating to box 8, omit the words from “, as it has effect”, in the first place it occurs, to “European Union,”.
- (4) In Annex 6 (extract of the certificate of inspection)—
- (a) in box 2—
- (i) omit “, as it has effect in Great Britain”;
- (ii) omit the words from “Council Regulation (EC) No 834/2007, as it has effect in the European Union” to the end;
- (b) in the Notes, in the entry relating to box 2, omit the words from “, as it has effect”, in the first place it occurs, to “European Union,”.

Explanatory Note
These Regulations amend Commission Regulation (EC) No 1235/2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries (EUR 2008/1235).
Regulation 2(2) omits from Article 13 of that Regulation transitional provisions concerning certificates of inspection which expired on 31st December 2022.
Regulation 2(3) and (4) make consequential amendments to Annexes 5 and 6 of that Regulation arising from the expiry of the transitional provisions.
A regulatory impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
