The Secretary of State makes this Order in exercise of the powers conferred by sections 120(1) and 134(1) of the Building Act 1984[^f00001].

This Order may be cited as the Building Act 1984 (Commencement No. 3) (England) Order 2023.
Provision coming into force on 1st October 2023

Section 33 of the Building Act 1984 (tests for conformity with building regulations) comes into force on 1st October 2023.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order brings into force section 33 of the Building Act 1984 (c. 55) so far as relating to England. (By virtue of section 134(1A) only Welsh Ministers have the power to commence section 33 in relation to Wales.) Section 33 makes provision in relation to testing and sampling.
