The Commissioners for His Majesty’s Revenue and Customs make these Regulations in exercise of the powers conferred by paragraph 16(2) of Schedule 26 to the Finance Act 2021[^f00001].

Citation and commencement

These Regulations may be cited as the Penalties for Failure to Pay Tax (Schedule 26 to the Finance Act 2021) (Assessments) Regulations 2024 and come into force on 4th December 2024.

Explanatory note

(This note is not part of the Regulations)

Explanatory Note

These Regulations make provision under paragraph 16(2) of Schedule 26 to the Finance Act 2021 for the assessment of penalties for failure to pay tax (“late payment penalties”). That Schedule provides for a two-penalty model for late payment penalties. These Regulations concern the second late payment penalty.

Regulation 1 provides for citation and commencement.

Regulation 2 makes provision enabling HMRC to assess a second late payment penalty before the tax due has been paid in full.

A Tax Information and Impact Note covering late payment penalties was published on 3rd March 2021 and is available on the HMRC website at https://www.gov.uk/government/publications/interest-harmonisation-and-penalties-for-late-submission-and-late-payment-of-tax/interest-harmonisation-and-penalties-for-late-payment-and-late-submission. It remains an accurate summary of the impacts of the late payment penalties regime established by Schedule 26 to the Finance Act 2021.
