The Online Safety Act 2023 (Commencement No. 4) Regulations 2024

Made: 10th December 2024

The Secretary of State makes these Regulations in exercise of the powers conferred by section 240(1) of the Online Safety Act 2023[^f00001].

Citation and extent

• (1) These Regulations may be cited as the Online Safety Act 2023 (Commencement No. 4) Regulations 2024.

• (2) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Commencement

• (1) The following provisions of the Online Safety Act 2023 come into force on 17th January 2025—

• (a) section 81 (duties about regulated provider pornographic content);

• (b) section 100(6)(a)(vii) (power to require information);

• (c) section 104(13)(a)(xvi) (reports by skilled persons);

• (d) section 136(2)(b) (confirmation decisions: proactive technology);

• (e) section 138(2)(c) and (d) (confirmation decisions: offences).

Explanatory Note

These Regulations are the fourth commencement regulations under the Online Safety Act 2023 (c. 50). They bring into force the duties about regulated provider pornographic content in section 81 and other provisions, such as OFCOM’s enforcement and information powers and the offence of failing to comply with a confirmation decision, as they relate to section 81.
