His Majesty, in exercise of the powers conferred on Him by sections 93(3) and 113(3) of the Scotland Act 1998[^f00001], is pleased, by and with the advice of His Privy Council, to order as follows:

Citation, commencement and extent

Specification of functions

Any function of the Scottish Ministers to which article 3 or 4 applies is specified for the purposes of section 93(1) (agency arrangements) of the Scotland Act 1998.

but only to the extent that it is so exercisable.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

The Order paves the way for the Scottish Ministers and a Minister of the Crown to enter into agency arrangements, under which a Minister of the Crown can exercise certain social security functions relating to winter heating assistance on behalf of the Scottish Ministers. Any such arrangements would require to be agreed between a Minister of the Crown and the Scottish Ministers.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
