The Secretary of State makes this Order in exercise of the powers conferred by section 5(1) and (6)(a) of the Electricity Act 1989[^f00001].

The Secretary of State has given notice of the proposal to make this Order in accordance with section 5(2) and (3) of that Act and has considered any representations made.

Explanatory note

(This note is not part of the Order)

Explanatory Note

This Order grants exemption from the requirement to hold an electricity generation licence.

Section 4(1)(a) of the Electricity Act 1989 prohibits the generation of electricity for the purpose of giving a supply to any premises or enabling a supply to be so given without a licence. The Secretary of State, exercising the powers under section 5(1) of that Act, grants exemption indefinitely from the requirement to hold a generation licence to Riverside Energy Park Limited in respect of Riverside 2, an energy from waste facility in Belvedere, London, England.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
