The Secretary of State makes these Regulations in exercise of the powers conferred by sections 7(1)(b), 7A, 9A, 13(1), 39(1)(b), 43(1), 44(1) and 104(2) of the Childcare Act 2006[^f00001] and sections 2(1) and (2) and 4(2) of the Childcare Act 2016[^f00002].

In accordance with section 43(2) of the Childcare Act 2006, the Secretary of State has consulted His Majesty's Chief Inspector of Education, Children's Services and Skills in respect of the provision in regulation 2.

  • inspection report” means— in relation to an early years childminder agency, a report under section 51E of the 2006 Act[^f00006], in relation to an early years provider, a report under— section 5 of the Education Act 2005[^f00007], section 50 of the 2006 Act[^f00008], or section 109 of the Education and Skills Act 2008[^f00009];

(6) (1) The requirement in regulation 5(1) does not apply if the early years provider is any of the following— (a) a provider (other than an early years childminder registered with an early years childminder agency) that is awarded a specified grade in its most recent inspection report, (b) an early years childminder registered with an early years childminder agency where— (i) the agency is awarded a grade of “ineffective” in its most recent inspection report, or (ii) the agency notifies the local authority that, in its reasonable opinion, the childminder has ceased to provide childcare of satisfactory quality, (c) a provider the local authority has grounds to believe would not be able to satisfy a requirement the authority would impose if arrangements were made. (2) In this regulation, “specified grade” means, in relation to an inspection specified in the first column of the table in the Schedule and conducted on a date in the corresponding entry in the second column— (a) where the early years provision is for a child who meets the condition in regulation 3(2) but does not meet the condition in regulation 3(3), any of the grades specified in the corresponding entry in the third column of the table, (b) where the early years provision is for a child who meets the condition in regulation 3(3), any of the grades specified in the corresponding entry in the fourth column of the table.

(7) Except in the case of arrangements with the governing body of a maintained school, arrangements made by the local authority for the purpose of complying with the requirement in regulation 5(1) must include provision allowing the local authority to terminate the arrangements if the early years provider with whom the arrangements are made becomes a provider mentioned in regulation 6(1)(a) or (b).

(viii) where the early years provider is awarded a specified grade in its most recent inspection report, that the provider takes the measures identified in that report to improve the effectiveness of the provision, including, where applicable, participation in a training or other quality improvement programme;

(3) In this regulation, “specified grade” means, in relation to an inspection specified in the first column of the table in the Schedule and conducted on a date in the corresponding entry in the second column, any of the grades specified in the corresponding entry in the third column of the table (irrespective of whether the provision is for a child who meets the condition in regulation 3(2) or 3(3)).

(ii) the provision was awarded a specified grade in the most recent early years provision inspection report published in respect of the provision;

  • specified grade” means— in the case of an early years provider most recently inspected before 10th November 2025, a grade weaker than “good” for the overall effectiveness of the provision; in the case of an early years provider most recently inspected on or after 10th November 2025, a grade— of “not met” for safeguarding, or weaker than “expected standard” for leadership and governance.

(b) a childminder registered with an early years childminder agency where— (i) the agency is awarded a grade of “ineffective” in its most recent inspection report, or (ii) the agency notifies the local authority that, in its reasonable opinion, the childminder has ceased to provide childcare of satisfactory quality; (c) a childcare provider (other than a childminder registered with an early years childminder agency) that is awarded a specified grade in its most recent inspection report.

(5) In this regulation, “specified grade” means, in relation to an inspection specified in the first column of the table in Schedule 2 and conducted on a date in the corresponding entry in the second column, any of the grades specified in the corresponding entry in the third column of the table.

Explanatory note

(This note is not part of the Regulations)

Explanatory Note

These Regulations amend four instruments relating to childcare and early years provision in England. The changes are made in consequence of changes to inspection grades made by the Office for Standards in Education, Children’s Services and Skills (‘Ofsted’), and to make provision for inspections of independent schools by an independent inspectorate approved under section 106 of the Education and Skills Act 2008 (c. 25).

Regulation 2 amends the Early Years Foundation Stage (Welfare Requirements) Regulations 2012 (S.I. 2012/938) to give effect to a revised version, dated 3rd December 2025, of the Early Years Qualifications Requirements and Standards Document (the ‘Qualifications Document’), which sets out qualifications requirements applicable to early years providers other than early years childminders. The Qualifications Document provides for the ‘experience-based route’ for early years practitioners to work at level 3 in staff:child ratios where the provider has achieved specified grades at its most recent Ofsted inspection. These grades are updated in light of changes to Ofsted grades and to provide for independent schools inspected by an independent inspectorate. Regulation 3 amends the Local Authority (Duty to Secure Early Years Provision Free of Charge) Regulations 2014 (S.I. 2014/2147) (the ‘2014 Regulations’), which require local authorities to make arrangements for free early years provision for eligible children in their area. Local authorities are not required to make or continue arrangements with early years providers that achieve specified inspection grades at their most recent inspection. The specified grades differ depending on whether the provision is made for eligible 2 year olds or 3-4 year olds (see regulation 3(2) and 3(3) of the 2014 Regulations), with additional higher grades specified for the provision for eligible 2 year olds. Paragraph (2) removes redundant definitions. Paragraph (3) updates references to Ofsted inspection grades and provides for independent schools, and paragraphs (4) to (5) make further consequential changes. Paragraph (6) inserts a new Schedule to the 2014 Regulations which sets out the specified grades. The third column of the table in the Schedule contains the grades applicable to provision for eligible 2 year-olds, and the fourth column contains the grades applicable to provision for 3-4 year olds. By regulation 8(1)(c)(viii) of the 2014 Regulations (amended by paragraph (5)), local authorities may impose training or quality improvement requirements on an early years provider with whom it makes arrangements where the provider achieves a specified grade at its most recent inspection. For these purposes, the specified grades are those in the third column of the table (irrespective of whether the provision is for an eligible 2 year-old or 3-4 year old).
