The Personal Injuries (NHS Charges) (Amounts) (Amendment) Regulations 2025

Coming into force: 1st October 2025
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 153(2) and (5), 167(1)(a) and 195(1) and (2) of the Health and Social Care (Community Health and Standards) Act 2003[^f00001].
In accordance with section 195(3) of that Act, the Secretary of State has consulted with the Welsh Ministers[^f00002].
Citation, commencement and extent

- (1) These Regulations may be cited as the Personal Injuries (NHS Charges) (Amounts) (Amendment) Regulations 2025.
- (2) These Regulations come into force on 1st October 2025.
- (3) These Regulations extend to England and Wales.
Amendment of Schedule 1 to the 2015 Regulations

In Schedule 1 to the Personal Injuries (NHS Charges) (Amounts) Regulations 2015[^f00003], for the existing table, substitute the following table—

Explanatory note

Explanatory Note
These Regulations amend the Personal Injuries (NHS Charges) (Amounts) Regulations 2015 (S.I. 2015/295) (“the principal Regulations”) which make provision about the charges payable under the scheme for the recovery of NHS charges in cases where an injured person who receives a compensation payment in respect of their injury has received NHS hospital treatment or ambulance services.
Regulation 2 amends the principal Regulations by substituting a table in Schedule 1. This table provides for increased charges in respect of injuries which occur on or after 1st October 2025. Where the injured person is provided with NHS ambulance services, the charge will be £267 (compared with £256, for injuries incurred between 1st October 2024 and 30th September 2025). Where the injured person receives NHS treatment at a hospital, but is not admitted to hospital, the charge will be £883 (compared with £848 for injuries incurred between 1st October 2024 and 30th September 2025). The daily charge for NHS in-patient treatment will be £1,085 (compared with £1,042 for injuries incurred between 1st October 2024 and 30th September 2025). The maximum charge in respect of an injury will be £64,856 (compared with £62,272 for injuries incurred between 1st October 2024 and 30th September 2025).
Regulation 3 revokes the Personal Injuries (NHS Charges) (Amounts) (Amendment) (No.2) Regulations 2024 (S.I. 2024/895).
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
