The Electricity and Gas (Energy Company Obligation) (Amendment) Order 2026

Coming into force: 18th March 2026

The Secretary of State makes this Order in exercise of the powers conferred by section 33BD of the Gas Act 1986[^f00001] and section 41B of the Electricity Act 1989[^f00002], with the agreement of the Scottish Ministers[^f00003].

The Secretary of State has consulted the Gas and Electricity Markets Authority, the National Association of Citizens Advice Bureaux, Consumer Scotland, electricity distributors, electricity suppliers, gas transporters, gas suppliers and such other persons as the Secretary of State considers appropriate.

Citation, commencement and extent

• (1) This Order may be cited as the Electricity and Gas (Energy Company Obligation) (Amendment) Order 2026.

• (2) This Order comes into force on 18th March 2026.

• (3) This Order extends to England and Wales and Scotland.

• (1) The Electricity and Gas (Energy Company Obligation) Order 2022[^f00004] is amended as follows.

• (2) In article 12(1)(e), after “public funds”, insert—

given under— 1. the Social Housing Decarbonisation Fund, 2. the Boiler Upgrade Scheme, 3. the Home Upgrade Grant, 4. the Green Homes Grant: Local Authority Delivery, 5. the Green Homes Grant: Voucher Scheme, 6. the Warm Homes: Local Grant, 7. the Warm Homes: Social Housing Fund, 8. the Scottish Government’s Home Energy Scotland Grant and Loan Scheme, 9. the Scottish Government’s Warmer Homes Scotland Scheme, 10. the Scottish Government’s Area Based Schemes, 11. the Scottish Government’s Social Housing Net Zero Heat Fund, 12. the Welsh Government’s Optimised Retrofit Programme, 13. the Welsh Government’s Warm Homes Nest Scheme

• (1) Article 11(8) of the Energy and Gas (Energy Company Obligation) (Amendment, Saving and Transitional Provisions) Order 2025[^f00005] is amended as follows.

• (2) For sub-paragraph (j) substitute—

(j) “post-project energy efficiency assessment” has the same meaning as in Part 10 of the 2022 Order;

• (3) After sub-paragraph (j), insert—

(k) “post-installation energy efficiency assessment” means an assessment performed under article 22(1)(b) of the 2023 Order;

• (4) After sub-paragraph (k) insert—

(l) “pre-installation energy efficiency assessment” has the same meaning as in the 2023 Order;

Explanatory note

(This note is not part of the Order)

Explanatory Note

This Order extends to Great Britain. Article 2 relates to the Energy Company Obligation scheme for the promotion of measures for reducing the cost to individuals of heating their homes. This provision amends one of the requirements contained in a condition that applies to qualifying actions under the scheme. The condition that a measure is not funded by any grant from public funds is changed so that specific grant schemes are referred to.

Article 3 corrects drafting errors in the Electricity and Gas (Energy Company Obligation) (Amendment, Saving and Transitional Provisions) Order 2025 ([S.I. 2025/802](https://www.legislation.gov.uk/uksi/2025/802)) that were identified by the Joint Committee on Statutory Instruments in its 37th Report of Session 2024-2026.

An impact assessment has not been produced for this instrument, as no, or no significant, impact on the private or voluntary sector is foreseen.
