The Treatment of Conformity Assessment Bodies (Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India) Regulations 2026

Coming into force in accordance with regulation 1(2)
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 1(1), 2(2)(h), 2(3)(g), 2(3)(h) and 13(2)(g) of the Product Regulation and Metrology Act 2025[^f00001].
In accordance with section 13(6) of that Act, the Secretary of State has consulted such persons as the Secretary of State considered appropriate.
Part 1 — Preliminary
Citation, commencement and extent

- (1) These Regulations may be cited as the Treatment of Conformity Assessment Bodies (Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India) Regulations 2026.
- (2) These Regulations come into force immediately after the Comprehensive Economic and Trade Agreement between the Government of Great Britain and Northern Ireland and the Government of the Republic of India signed on 24 July 2025 (“the Agreement”) enters into force (on which see Article 30.6 of the Agreement)[^f00002].
- (3) The Secretary of State must publish a notice in the London Gazette, as soon as reasonably practicable, of the date on which the Agreement enters into force.
- (4) These Regulations extend to England and Wales and Scotland only.
Part 2 — Amendment to subordinate legislation
Amendment of the Toys (Safety) Regulations 2011

- (1) The Pressure Equipment (Safety) Regulations 2016[^f00007] are amended as follows.
- (2) In sub-paragraph (a) of paragraph 31(8) (materials) of Schedule 2 (essential safety requirements), after (i) insert—
(ia) the territory of the Republic of India.
- (3) In paragraph 2 of Schedule 4 (approved body requirements) —
- (a) omit the “or” after sub-paragraph (a);

Explanatory note

Explanatory Note
These Regulations are made in exercise of the powers conferred by sections 1 and 2 of the Product Regulation and Metrology Act 2025 in order to implement Article 7.7.9 (National Treatment - Conformity Assessment) of the Comprehensive Economic and Trade Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of India, signed in Buckinghamshire on 24 July 2025.
These Regulations amend a number of legislative instruments. Each legislative instrument being amended currently includes a restriction on where relevant conformity assessment bodies can be established. This restriction is to the United Kingdom as well as to the territory of each party to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, signed in Santiago on 8 March 2018, including the UK Accession Protocol, as it has effect in the United Kingdom from time to time (“the CPTPP”). The legislation being amended currently requires the parties to accord conformity assessment bodies located in the United Kingdom, or in the territory of a party to the CPTPP, treatment no less favourable than that it accords to conformity assessment bodies located in its own territory or in the territory of any other party to the CPTPP. These Regulations amend the provisions containing these establishment requirements so as to include conformity assessment bodies which are established in the territory of the Republic of India.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or business sectors is foreseen. An Explanatory Memorandum has been published alongside these Regulations and is available at www.legislation.gov.uk.
