The National Health Service (Transfer of Residual Estate) (Wales) Order 2009

Made: 29 September 2009

Coming into force: 1 October 2009

The Welsh Ministers in exercise of powers conferred by section 11(6) of and paragraph 22(1) and (3) and paragraph 23(3) and (7) of Schedule 2, and section 18(4) of and paragraph 9(1), (3), (5) and (9) of Schedule 3 to the National Health Service (Wales) Act 2006[^f00001], and with the agreement of the relevant Local Health Board and National Health Service Trust in accordance with paragraph 22(2) of Schedule 2 and paragraph 9(7) of Schedule 3 to that Act respectively, hereby make this Order.

Title, Commencement and Application

• (1) The title of this Order is the National Health Service (Transfer of Residual Estate) (Wales) Order 2009 and it comes into force on 1 October 2009.

• (2) This Order applies to Wales.

Interpretation

In this Order unless the context otherwise requires—

• “National Health Service body” (“corff Gwasanaeth Iechyd Gwladol”) means the relevant body listed in column 2 of the Schedule;

• “the residual estate” (“yr ystad weddilliol”) is that estate listed in column 1 of the Schedule;

• “the transfer date” (“y dyddiad trosglwyddo”) means 1 October 2009.

• (1) The relevant residual estate is transferred to the relevant National Health Service body from the transfer date.

• (2) The relevant National Health Service body must abide by the terms of any lease which has transferred to it by virtue of this article.

(This note is not part of the Order)

This Order provides for the transfer of the residual estate from the Welsh Ministers to the National Health Service bodies referred to in the Schedule to this Order from 1 October 2009.
