The Welsh Ministers make these Regulations in exercise of the powers conferred by sections 77(2) and 90(3)(a) and (b) of, and paragraphs 1, 2, 3(1)(a) and (2)(a), 4 to 8, 9(1) and (2), 10, 12, 16 to 19 and 21 of Schedule 6 to, the Climate Change Act 2008 .

The Welsh Ministers are satisfied in accordance with paragraph 23 of Schedule 6 to that Act that every county council and county borough council in Wales will act in accordance with the principles referred to in that paragraph when exercising a power conferred by these Regulations to impose a civil sanction.

A draft of these Regulations has been laid before, and approved by resolution of, the National Assembly for Wales pursuant to section 77(4)(a) and (b) of, and paragraph 27(3) of Schedule 6 to, the Climate Change Act 2008.

Regulation 6 does not apply in relation to the supply of single use carrier bags of the kinds described in Schedule 1 and that Schedule has effect accordingly.

Schedule 4 makes provision for the imposition of monetary penalties in cases where a seller fails to comply with a non-monetary discretionary requirement and that Schedule has effect accordingly.
