Explanatory note

(This note is not part of the Order)

This Order, made by the Welsh Ministers, commences Part 1 (Suspension of the Right to Buy and Related Rights) of the Housing (Wales) Measure 2011 (“the Measure”) on 3 September 2012.

A local housing authority may apply to the Welsh Ministers under section 1 of the Measure for a direction to suspend the right to buy and related rights in its area for up to 5 years, provided it has completed a consultation exercise in accordance with section 2 of the Measure within the period of 6 months preceding the application and, in the light of that exercise, it concludes that the housing pressure condition (as set out in section 1(2) of the Measure) exists.

This is the second Commencement Order made under the Measure.
