The Local Government and Elections (Wales) Act 2021 (Commencement No. 3 and Transitional Provision) Order 2021
Made: 18 March 2021
The Welsh Ministers make the following Order in exercise of the power conferred on them by section 175(7) and (8) of the Local Government and Elections (Wales) Act 2021[^f00001].
Title and interpretation

- (1) The title of this Order is the Local Government and Elections (Wales) Act 2021 (Commencement No. 3 and Transitional Provision) Order 2021.
- (2) In this Order, “the 2021 Act” means the Local Government and Elections (Wales) Act 2021.
Provisions coming into force on 1 May 2021

The following provisions of the 2021 Act come into force on 1 May 2021 so far as those provisions are not already in force—
- (a) section 47;
- (b) section 49;
- (c) Schedule 4.
Transitional provision

- (1) In this article, “the 1972 Act” means the Local Government Act 1972[^f00002].
- (2) Any notice or other document published or sent before 1 May 2021 in accordance with the provisions specified in paragraph (3) as modified by the Local Authorities (Coronavirus) (Meetings) (Wales) Regulations 2020[^f00003] in relation to a meeting held on or after 1 May 2021, is to be treated as having been published or sent in accordance with those provisions as amended by Schedule 4 to the 2021 Act.
- (3) The provisions are—
- (a) section 1 of the Public Bodies (Admission to Meetings) Act 1960[^f00004];
- (b) Part 5A of the 1972 Act;
- (c) Schedule 12 to the 1972 Act.

Explanatory note

EXPLANATORY NOTE
This is the third commencement order made by the Welsh Ministers under the Local Government and Elections (Wales) Act 2021 (“the 2021 Act”).
Article 2 of this Order brings the following provisions of the 2021 Act into force on 1 May 2021, so far as those provisions are not already in force—
- (a) section 47 (arrangements and conditions for persons who are not in the same place to attend local authority meetings);
- (b) section 49 (notices etc. of local authority meetings);
- (c) Schedule 4 (notice of local authority meetings, access to documents and consequential amendments relating to attendance at such meetings).
Article 3 makes transitional provision for any notice or other document published or sent before 1 May 2021 which relates to a meeting held on or after 1 May 2021.
