Coming into force in accordance with regulation 1(2) to (8)

In accordance with section 408(5) of that Act, the Welsh Ministers have consulted with such persons as they consider desirable.

Title, commencement and application

(1) The title of these Regulations is the Provision of Information by Head Teachers to Parents and Adult Pupils (Wales) Regulations 2022.

(2) These Regulations come into force on 1 September 2022—

(a) for pupils in a nursery class[^f00005] at a maintained school[^f00006];

(b) for pupils in their reception year[^f00007] at a maintained school;

(d) for pupils in year 7 at a maintained school where the head teacher and governing body have adopted a relevant curriculum under Part 2 of the 2021 Act[^f00011];

(e) for pupils in years 1, 2, 3, 4, 5 and 6 at a pupil referral unit[^f00012];

(f) for pupils in year 7 at a pupil referral unit where the local authority, the management committee (if any) and the teacher in charge have a curriculum for that unit which meets the requirements of section 50 of the 2021 Act.

(3) These Regulations come into force on 1 September 2023—

(a) for pupils in years 7 and 8 at a maintained school;

(b) for pupils in years 7 and 8 at a pupil referral unit.

(4) These Regulations come into force on 1 September 2024—

(a) for pupils in year 9 at a maintained school;

(b) for pupils in year 9 at a pupil referral unit.

(5) These Regulations come into force on 1 September 2025—

(a) for pupils in year 10 at a maintained school;

(b) for pupils in year 10 at a pupil referral unit.

(6) These Regulations come into force on 1 September 2026—

(a) for pupils in year 11 at a maintained school;

(b) for pupils in year 11 at a pupil referral unit.

(7) These Regulations come into force on 1 September 2027 for pupils in year 12 at a maintained school.

(8) These Regulations come into force on 1 September 2028 for pupils in year 13 at a maintained school.

(9) These Regulations apply in relation to Wales.

Interpretation

(1) In these Regulations—

“the 1996 Act” (“Deddf 1996”) means the Education Act 1996;

“the 2021 Act” (“Deddf 2021”) means the Curriculum and Assessment (Wales) Act 2021[^f00013];

“adult pupil” (“disgybl sy’n oedolyn”) means a pupil aged 18 or over at the time the information referred to in regulation 4 or regulation 5 is made available and who is not proposing to leave the school by the end of the school year;

“approved relevant qualification” (“cymhwyster perthnasol a gymeradwywyd”) is a qualification within the meaning of section 56 of the Qualifications Wales Act 2015[^f00014];

“attendance record” (“cofnod presenoldeb”) means the record of a pupil’s school attendance contained in the attendance register kept in accordance with section 434 of the 1996 Act[^f00015] and the Education (Pupil Registration) (Wales) Regulations 2010[^f00016];

“compulsory school age” (“oedran ysgol gorfodol”) has the meaning given to it in section 8 of the 1996 Act[^f00017];

“education welfare officer” (“swyddog lles addysg”) means any person who is employed by a local authority, and whose duties include securing the regular attendance at school of pupils of compulsory school age;

“local authority” (“awdurdod lleol”) means the local authority that maintains the school;

“maintained school” (“ysgol a gynhelir”) means a—community, foundation or voluntary school,community or foundation special school (other than one established in a hospital),maintained nursery school, andpupil referral unit;

“nursery year” (“blwyddyn meithrin”) means a year group in which the majority of pupils attain the age of 4;

“parent” (“rhiant”) has the meaning given to it in section 576 of the 1996 Act;

“pupil referral unit (PRU)” (“uned cyfeirio disgyblion (UCD)” has the meaning given to it in section 81(1) of the 2021 Act;

“pupil” (“disgybl”) has the meaning given to it in section 3 of the 1996 Act[^f00018];

“registered pupil” (“disgybl cofrestredig”) has the meaning given to it in section 434(5) of the 1996 Act;

“reception year” (“blwyddyn derbyn”) means a year group in which the majority of pupils attain the age of 5;

“relevant curriculum” (“cwricwlwm perthnasol”) has the meaning given to it—in section 56(5)(a) of the 2021 Act in relation to a maintained school; andin section 56(5)(c) of the 2021 Act in relation to a PRU;

“school day” (“diwrnod ysgol”) has the meaning given to it in section 579(1) of the 1996 Act;

“school term” (“tymor ysgol”) means the dates on which the school terms and holidays are to begin and end;

“school year” (“blwyddyn ysgol”) has the meaning given to it in section 579(1) of the 1996 Act;

“unit or credit” (“uned neu gredyd”), in relation to a qualification, means a module or part of a course leading to that qualification which, when successfully completed, can be counted together with other modules or parts towards obtaining that qualification;

“year 1” (“blwyddyn 1”) means a year group in which the majority of pupils attain the age of 6;

“year 2” (“blwyddyn 2”) means a year group in which the majority of pupils attain the age of 7;

“year 3” (“blwyddyn 3”) means a year group in which the majority of pupils attain the age of 8;

“year 4” (“blwyddyn 4”) means a year group in which the majority of pupils attain the age of 9;

“year 5” (“blwyddyn 5”) means a year group in which the majority of pupils attain the age of 10;

“year 6” (“blwyddyn 6”) means a year group in which the majority of pupils attain the age of 11;

“year 7” (“blwyddyn 7”) means a year group in which the majority of pupils attain the age of 12;

“year 8” (“blwyddyn 8”) means a year group in which the majority of pupils attain the age of 13;

“year 9” (“blwyddyn 9”) means a year group in which the majority of pupils attain the age of 14;

“year 10” (“blwyddyn 10”) means a year group in which the majority of pupils attain the age of 15;

“year 11” (“blwyddyn 11”) means a year group in which the majority of pupils attain the age of 16;

“year 12” (“blwyddyn 12”) means a year group in which the majority of pupils attain the age of 17;

“year 13” (“blwyddyn 13”) means a year group in which the majority of pupils attain the age of 18.

(2) In these Regulations any reference in relation to a PRU to—

(a) a head teacher is a reference to a teacher in charge of a PRU, or

(b) a governing body is a reference to management committee (if there is one) and to a teacher in charge of a PRU if there is no management committee.

Disapplication and revocation of the Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011

(1) The Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011[^f00019] (“the 2011 Regulations”) are disapplied as follows.

(2) The 2011 Regulations do not apply—

(a) from the school year 2022 to 2023 to children and pupils in—

(i) the nursery year,

(ii) the reception year,

(iii) year 1, year 2, year 3, year 4, year 5 and year 6, and

(iv) year 7 where they are provided with a relevant curriculum in accordance with the 2021 Act,

(b) from the school year 2023 to 2024 to pupils in year 7 and year 8,

(d) from the school year 2025 to 2026 to pupils in year 10,

(e) from the school year 2026 to 2027 to pupils in year 11,

(f) from the school year 2027 to 2028 to pupils in year 12, and

(g) from the school year 2028 to 2029 to pupils in year 13.

(3) The Regulations in Schedule 1 to these Regulations are revoked from 1 September 2028.

Requirement to provide information: Termly progress

(1) The head teacher of every maintained school must make arrangements for providing the information in Part 1 of Schedule 2 (“the termly information”).

(2) The termly information must be provided before the end of each school term.

(3) The termly information must be made available to—

(a) each adult pupil,

(b) the parent of each adult pupil (if the head teacher considers there to be special circumstances which make it appropriate), or

(4) The termly information may be provided in such form as the head teacher reasonably considers appropriate.

Requirement to provide information: Annual progress

(1) The head teacher of every maintained school must make arrangements for providing (“the annual information”)—

(a) in relation to pupils up to and including year 9, the information in Part 2 of Schedule 2,

(b) in relation to pupils up to and including year 9 and who are entered for an approved relevant qualification, the information in Parts 2 and 3 of Schedule 2, and

(2) The annual information may be provided in such form as the head teacher reasonably considers appropriate.

(3) The annual information must be made available before the end of each school year.

(4) Nothing in this regulation prevents the annual information being contained in more than one document provided that, subject to regulation 6(2), the head teacher provides such information before the end of the school year.

(5) The annual information must be made available to—

(a) each adult pupil,

(b) the parent of each adult pupil (if the head teacher considers there to be special circumstances which make it appropriate), or

(6) This regulation does not apply in relation to any pupil who is to be provided with a school leaver’s report pursuant to regulation 8.

Reporting period: Annual progress

(1) The period to which the annual information specified in regulation 5 relates begins with the later of—

(a) the date of the pupil’s admission to the school, or

(b) the end of the period in which the last report on such matters was made under these Regulations or under the Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011.

(2) Where any of the particulars necessary to provide the information specified in Part 3 of Schedule 2 are not received by the head teacher until after the end of the summer term, the head teacher must make available such information as soon as practicable and in any event not later than the following 30 September.

Additional information to be made available: Annual progress

(1) If any person set out in regulation 5(5) considers the annual information provided does not contain all the information required by regulation 5 that person may request the head teacher provide the missing information.

(2) Any request pursuant to paragraph (1) must—

(a) be made in writing, and

(b) set out the information requested.

(3) The head teacher must comply with such a request within 15 school days of receiving it.

(4) Paragraph (1) does not apply if the information referred to in the request has previously been made available to the adult pupil or the pupil’s parent under these Regulations.

Requirement to provide information: School leaver’s report

(1) The head teacher of every maintained school must make available to any pupil who has ceased to be of compulsory school age and is proposing to leave or has left the school a report containing the information referred to in Part 4 of Schedule 2.

(2) The report must be in writing and may be in electronic form.

(3) The part of the report—

(a) in which the information referred to in paragraphs 16, 17 and 19 of Schedule 2 is made available must provide for signature by the pupil (“first part”);

(b) which comprises of the first part and the part of the report in which the information referred to in paragraphs 16 and 18 of Schedule 2 is made available, must provide for signature by a teacher who is familiar with the pupil and that pupil’s achievements.

(4) Any signature provided pursuant to paragraph (3) may be provided electronically.

Reporting period: School leaver’s report

The report in regulation 8 must be made available to the pupil not later than 30 September following the end of the school year during or at the end of which the pupil left the school.

Restrictions on provision of information

(1) Nothing in these Regulations requires the making available of any information—

(a) originating from or supplied by or on behalf of any person other than—

(i) an employee of the local authority which maintains the school,

(ii) in the case of a voluntary aided school, a teacher or other employee at the school (including an educational psychologist engaged by the governing body under a contract for services),

(iii) an education welfare officer,

(iv) the person requesting disclosure, or

(b) to the extent that it would reveal, or enable to be deduced, the identity of a person as the source of the information or as a person to whom that information relates—

(i) other than the pupil to whom that information relates, or

(ii) person mentioned in paragraph (1)(a).

(2) Nothing in these Regulations requires the making available of any information—

(a) to the extent that disclosure would in the opinion of the head teacher be likely to cause serious harm to the physical or mental health or emotional condition of the pupil to whom the information relates or of any other person, or

(b) to the extent that in the opinion of the head teacher it is relevant to the question whether the pupil to which it relates is or has been the subject of or may be at risk of child abuse.

(3) In this regulation “child abuse” includes physical (other than accidental) injury to, and physical or emotional neglect, ill-treatment or sexual abuse of, a child.

Translation of information and documents

(1) If it appears necessary to the head teacher of any maintained school that any document or information required to be made available under these Regulations which is provided in Welsh should be translated into English, it must be so translated and these Regulations are to apply to the document or information so translated as they apply to the original document or information.

(2) If it appears necessary to the head teacher of any maintained school that any document or information required to be made available under these Regulations which is provided in English should be translated into Welsh, it must be so translated and these Regulations are to apply to the document or information so translated as they apply to the original document or information.

(3) If it appears necessary to the head teacher of any maintained school that any document or information required to be made available under these Regulations should be translated into a language other than English or Welsh or that a Braille or audio tape version of such a document or information should be available, it must be so translated or produced in Braille or audio tape, as the case may be, and these Regulations are to apply to the translated document, information, Braille or audio version as they apply to the original document or information.

(4) No charge must be made for a copy of any information translated or produced in accordance with paragraphs (1), (2) or (3), but where a charge is made for a copy of an original document no greater charge must be made for a copy of the document so translated or produced.

Amendment to the Pupil Information (Wales) Regulations 2011

In regulation 3 of the Pupil Information (Wales) Regulations 2011[^f00020], for paragraph (1) substitute—
