In accordance with section 146(3) of the 2014 Act, within a period of 40 days Senedd Cymru did not resolve not to approve the draft Codes, and the Codes were issued in the form of the draft.

The title of this Order is the National Framework for the Commissioning of Care and Support in Wales Code of Practice and the Revised Code of Practice (General Functions) (Appointed Day) (Wales) Order 2024.

Explanatory note

EXPLANATORY NOTE

This Order appoints 1 September 2024 as the day on which the Codes of Practice listed in article 2 of this Order (“the Codes”) come into force.

The Codes were issued by the Welsh Ministers under section 145(1) of the Social Services and Well-being (Wales) Act 2014 (“the 2014 Act”) on the 24 July 2024.

Section 145(3) of the 2014 Act requires local authorities, when exercising social services functions, to act in accordance with any relevant requirements contained in a code and to have regard to any relevant guidance contained in it.

The revised Part 2 Code of Practice (General Functions) replaces the Part 2 Code of Practice (General Functions) issued on the 2 November 2015.

The Codes can be accessed on the internet at www.gov.wales or a printed copy can be obtained from the Welsh Government, Cathays Park, Cardiff, CF10 3NQ.
