The Public Health (Wales) Act 2017 (Commencement No. 7) Order 2024

Made: 10 September 2024

The Welsh Ministers, in exercise of the powers conferred by section 126(2) of the Public Health (Wales) Act 2017[^f00001], make the following Order:

Title and interpretation

• (1) The title of this Order is the Public Health (Wales) Act 2017 (Commencement No. 7) Order 2024.

• (2) In this Order, “the Act” (“y Ddeddf”) means the Public Health (Wales) Act 2017.

Provisions coming into force on 13 September 2024

• (1) The following provisions of the Act come into force, to the extent necessary for the purpose of making regulations, on 13 September 2024—

• (a) section 59 (general provision about special procedure licences) in so far as it relates to Schedule 3;

• (b) section 60 (exempted individuals);

• (c) section 62 (licensing criteria);

• (d) section 63 (mandatory licensing conditions);

• (e) section 69 (performance of special procedure in course of business: approval requirement);

• (f) section 70 (approval of premises and vehicles in respect of performance of special procedure);

• (g) section 71 (approval certificates);

• (h) section 72 (voluntary termination of approval);

• (i) section 76 (fees);

• (j) section 94 (interpretation of this Part);

• (k) Schedule 3 (further provision in connection with special procedure licences).

• (2) The following provisions of the Act come into force on 13 September 2024—

• (a) section 64 (consultation about licensing criteria and mandatory licensing conditions);

• (b) section 94 (interpretation of this Part) for the purposes of section 64.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order, made by the Welsh Ministers, brings into force on 13 September 2024 specified provisions of the Public Health (Wales) Act 2017 (“the Act”).

Article 2 (1) brings into force certain provisions of the Act to the extent necessary for the making of regulations under Part 4 of and Schedule 3 to the Act. Article 2(2) brings into force section 64 (consultation about licensing criteria and mandatory licensing conditions) of the Act. Article 2(2) also brings into force section 94 (interpretation of this Part) of the Act for the purposes of section 64.
