The Education (Student Support) (Wales) (Amendment) Regulations 2025

The Welsh Ministers make the following Regulations in exercise of the powers conferred upon the Secretary of State by sections 22(1)(a) and (2)(c) and 42(6) of the Teaching and Higher Education Act 1998[^f00001], and now exercisable by them[^f00002].
Title and coming into force

- (1) The title of these Regulations is the Education (Student Support) (Wales) (Amendment) Regulations 2025.
- (2) These Regulations come into force on 31 August 2025.
Application

These Regulations apply in relation to the provision of support to a student in relation to an academic year which begins on or after 1 September 2025.
Amendment of the Education (Student Support) (Wales) Regulations 2018

The Education (Student Support) (Wales) Regulations 2018[^f00003] are amended in accordance with regulations 4 to 6.
Substitution of regulation 5

For regulation 5 (designated courses) (but not the heading before it) substitute—
(5) In these Regulations (and for the purposes of section 22 of the Teaching and Higher Education Act 1998 (“the 1998 Act”)), a course is a designated course if it satisfies— (a) each of the conditions in regulation 6(1) and does not fall within any of the exceptions in regulation 7(1), or (b) the requirements set out in Schedule 1A.
Amendment to regulation 40

In regulation 40 (amount of tuition fee loan), in paragraph (2)(c)(i), at the end insert “or a provider specified in column 2 of Table 14A in Schedule 1A in so far as they provide the course described in the corresponding entry in column 3”.
Insertion of new Schedule 1A

After Schedule 1 (interpretation) insert—
SCHEDULE 1A (1) A course described in column 3 of Table 14A that— (a) is provided by the course provider specified in the corresponding entry in column 2, (b) leads to a qualification awarded by the body specified in the corresponding entry in column 1, and (c) begins before 1 January 2026.

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
These Regulations amend the Education (Student Support) (Wales) Regulations 2018 (“the 2018 Regulations”).
The 2018 Regulations provide for financial support for eligible students taking designated courses of higher education which begin on or after 1 August 2018.
These Regulations amend the 2018 Regulations to specify particular courses as designated courses in those Regulations, and for the purposes of section 22 of the Teaching and Higher Education Act 1998, so that students undertaking such courses are eligible for student support under those Regulations.
These Regulations also treat the providers of such courses as “ordinary providers” under regulation 40 of the 2018 Regulations, so that students undertaking such courses qualify for the higher amounts of tuition fee loan available.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. [^f00002]: The function of the Secretary of State in section 22(1) of the Teaching and Higher Education Act 1998 was transferred to the National Assembly for Wales, so far as it relates to making provision in relation to Wales, by section 44 of the Higher Education Act 2004 (c. 8). Section 44(2) of the Higher Education Act 2004 provided that the function in section 22(2)(c) of the Teaching and Higher Education Act 1998 was to be exercised by the National Assembly for Wales concurrently with the Secretary of State, so far as it relates to making provision in relation to Wales. The Secretary of State’s function in section 42(6) of the Teaching and Higher Education Act 1998, in so far as being exercisable in relation to Wales, was transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999, article 2 and Schedule 1 (S.I. 1999/672). The functions of the National Assembly for Wales were transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
