Coming into force: 12 February 2026
The Welsh Ministers make the following Regulations in exercise of the powers conferred upon the Secretary of State by sections 22(1)(a), (2)(b) and (c), and 42(6) of the Teaching and Higher Education Act 1998[^f00001], and now exercisable by them[^f00002], and powers conferred on them under sections 5(3) and 55(2) of the Higher Education (Wales) Act 2015[^f00003].
Part 1 — Title, coming into force and application
Title and coming into force

- (1) The title of these Regulations is the Education (Student Finance) (Amounts) (Miscellaneous Amendments) (Wales) Regulations 2026.
- (2) These Regulations come into force on 12 February 2026.
Application

- (1) The following regulations apply in relation to the provision of financial support to a student in relation to an academic year which begins on or after 1 August 2026, whether or not anything done under these Regulations is done before, on or after that date—
- (a) 9 to 29 (update of amounts: the Education (Student Support) (Wales) Regulations 2017);
- (b) 31 to 46 (update of amounts: the Education (Student Support) (Wales) Regulations 2018).
- (2) The following regulations apply in relation to the provision of financial support to a student in relation to a course which begins on or after 1 August 2026, whether or not anything done under these Regulations is done before, on or after that date—
- (a) 48 (update of amounts: the Education (Postgraduate Doctoral Degree Loans) (Wales) Regulations 2018);
- (b) 50 (update of amounts: the Education (Student Support) (Postgraduate Master’s Degrees) (Wales) Regulations 2019).
Part 2 — Amendments to the Higher Education (Amounts) (Wales) Regulations 2015

Explanatory note

EXPLANATORY NOTE
These Regulations amend—
the Higher Education (Amounts) (Wales) Regulations 2015 (“the 2015 Regulations”),
the Education (Student Support) (Wales) Regulations 2017 (“the 2017 Regulations”),
the Education (Student Support) (Wales) Regulations 2018 (“the 2018 Regulations”),
the Education (Postgraduate Doctoral Degree Loans) (Wales) Regulations 2018 (“the Doctoral Degree Loan Regulations”), and
the Education (Student Support) (Postgraduate Master’s Degrees) (Wales) Regulations 2019 (“the 2019 Regulations”).
Part 1 of these Regulations provides for the coming into force and application of these Regulations.
The 2015 Regulations prescribe the maximum amount that higher education institutions in Wales with an approved fee and access plan in force (“regulated institutions”) can charge by way of tuition fees for full-time undergraduate courses. The 2015 Regulations also prescribe lower maximum amounts in respect of certain courses.
Part 2 of these Regulations amends the 2015 Regulations to increase each prescribed maximum amount from the 2026/27 academic year.
The 2017 Regulations and the 2018 Regulations provide for financial support for eligible students taking designated undergraduate courses which begin before 1 August 2018, and on or after 1 August 2018, respectively.
The Doctoral Degree Loan Regulations provide for financial support for eligible students taking designated postgraduate doctoral degree courses which begin on or after 1 August 2018. The 2019 Regulations provide for financial support for eligible students taking designated postgraduate master’s degree courses which begin on or after 1 August 2019.
Parts 3, 4, 5 and 6 of these Regulations amend the 2017 Regulations, the 2018 Regulations, the Doctoral Degree Loan Regulations and the 2019 Regulations, respectively, to update various amounts specified in each of those Regulations.
In particular, in Part 3, regulations 9, 10, 11 and 21 amend the 2017 Regulations, and in Part 4, regulation 31 amends the 2018 Regulations, to increase the maximum amount of tuition fee support available from the 2026/27 academic year to students undertaking courses at—
regulated institutions, to correspond with the increase in the prescribed maximum amounts under the 2015 Regulations as a result of the amendments made by Part 2,
higher education institutions and other providers of higher education regulated elsewhere in the United Kingdom, to correspond with increases in the amounts that such institutions and providers can charge by way of tuition fees, and
private institutions in Wales and elsewhere in the United Kingdom.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. A copy can be obtained from the Tertiary Education Directorate, Welsh Government, Cathays Park, Cardiff, CF10 3NQ.
