- (1) The United Kingdom market access principles do not apply to (and sections 2(3) and 5(3) do not affect the operation of) legislation so far as it prohibits the sale of—
- (a) single-use plastic straws;
- (b) single-use plastic stemmed cotton buds;
- (c) single-use plastic drink stirrers;
- (d) single-use plastic plates;
- (e) single-use plastic cutlery or chopsticks;
- (f) single-use plastic balloon sticks;
- (g) single-use food containers, drink containers or cups made wholly or partly from expanded or extruded polystyrene.
- (2) For the purposes of sub-paragraph (1)—
- (a) a “single-use” item means an item which is not designed or intended to be re-used;
- (b) a “single-use plastic” item means a single-use item which is made wholly or partly from plastic.
