Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order, which applies in England, revokes and replaces the Smoke Control Areas (Exempted Fireplaces) (England) (No. 2) Order 2014 (S.I. 2014/2404) (“the 2014 Order”). It also revokes and replaces numerous earlier Orders relating to smoke control, in so far as they relate to England.

The Order exempts the classes of fireplace listed in Schedule 1 from the provisions of section 20 of the Clean Air Act 1993 (prohibition of smoke emissions in smoke control areas), subject to the conditions set out in that Schedule. It exempts additional classes of fireplace to those which were listed in the 2014 Order and makes minor editorial changes to other entries which were included in that Order. Changes have been made to entries which were included in the earlier Orders to omit references to fuels which are no longer available or cannot lawfully be used and to improve accuracy and consistency of entries.

The Orders which are revoked by this Order are listed in Schedule 2.

An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sector is foreseen. The Explanatory Memorandum is available at legislation.gov.uk .
