O Governo decreta, nos termos da alínea c) do artigo 200.º da Constituição, o seguinte:
Artigo único. É aprovado o Acordo de Transporte Aéreo entre o Governo de Portugal e o Governo da República Socialista Federativa da Jugoslávia, assinado em Belgrado em 3 de Junho de 1976, cujo texto em inglês e respectiva tradução para português acompanham o presente decreto.

AIR TRANSPORT AGREEMENT BETWEEN THE GOVERNMENT OF PORTUGAL AND THE GOVERNMENT OF THE SOCIALIST FEDERAL REPUBLIC OF YUGOSLAVIA.
The Government of Portugal and the Government of the Socialist Federal Republic of Yugoslavie, hereinafter referred to as «the Contracting Parties»:
Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944;
Desiring to conclude an Agreement on scheduled air transport between and beyond their respective territories;
have agreed as follows:
ARTICLE 1
For the purposes of the present Agreement, unless the context otherwise requires:
The term «Convention» means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944, including any Annex adopted under article 90 of that Convention and any amendment of the Annexes or Convention under articles 90 and 94 thereof so far as those Annexes and amendments have been adopted by both Contracting Parties;
The term «Aeronautical Authorities» means:
For Portugal:
The Secretariat of State of Transport and Comunications - Directorate General of Civil Aviation;
For the Socialist Federal Republic of Yugoslavia:
Federal Civil Aviation Administration.
These institutions may be replaced by any other institution or person authorized to take over their present functions;
The term «designated airline» means an airline which has been designated and authorized in accordance with the provisions of article 4 of the present Agreement;
The term «territory» in relation to a State means the land areas and territorial waters adjacent thereto under the sovereignity of that State;
The term «agreed service» means any scheduled air services performed by aircraft for public transport of passengers, cargo and mail on the routes referred to in the Annex to the present Agreement; and
The term «tariff» means the prices to be paid for the carriage of passengers, baggage and freight and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services, but excluding remuneration or conditions for the carriage of mail.
ARTICLE 2
Each Contracting Party grants the other Contracting Party the rights specified in the present Agreement for the purpose of establishing scheduled international air services on the routes specified in the Annex to the present Agreement. Such services and routes are hereinafter called «the agreed services» and «the specified routes» respectively.
ARTICLE 3
The airline designated by each Contracting Party shall enjoy, while operating an agreed service on a specified route, the following rights:
To fly without landing across the territory of the other Contracting Party;
To make stops in the said territory for non-traffic purposes;
To make stopes in the said territory at the points specified for the route or routes in the Annex to the present Agreement, for the purpose of taking on and putting down passengers, cargo and mail on international services in accordance with the provisions of the present Agreement and its Annex.
The provisions of this article shall not be deemed to confer on the airline of one Contracting Party the right to take on in the territory of the other Contracting Party passengers, cargo or mail carried for remuneration or hire and destined for another point in the territory of the other Contracting Party (cabotage).
ARTICLE 4
Each Contracting Party shall have the right to designate an airline for the purpose of operating the agreed services on the specified routes. This designation shall be notified in writing by the Aeronautical Authorities of the Contracting Party having designated the airline to the authorities of the other Contracting Party.
On receipt of such notification the Aeronautical Authorities shall, subject to the provisions of the paragraph 3 of this article, grant to the designated airline the appropriate operating authorization without delay.
The Aeronautical Authorities of one Contracting Party may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfil the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services in conformity with the provisions of the Convention.
When an airline has been so designated and authorized, it may begin at any time to operate the agreed services, partly or in whole, provided that the time-tables and tariffs relating to such services have been established in accordance with the provisions of paragraph 5 of this article and article 9 respectively.
The time-tables of the agreed services shall be submitted by the designated airline of one Contracting Party to the approval of the Aeronautical Authorities of the other Contracting Party at least thirty days before the intended date of their implementation. Any modification to such time-tables shall also be submitted to the Aeronautical Authorities for approval.
ARTICLE 5
Each Contracting Party shall have the right to revoke the operating authorization or to suspend the exercise of the rights specified in article 3 of the present Agreement by the airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights, in case:
It is not satisfied that in the case of the Socialist Federal Republic of Yugoslavia the Organization of Associated Labour from the Domain of Air Transportation effectively controls the designated airline and that its funds are public property and in case of Portugal that substantial ownership and effective control of the designated airline are vested in the Contracting Party designating the airline or in its nationals;
That airline fails to comply with the laws and regulations of the Contracting Party granting these rights; or
That airline otherwise fails to operate the agreed services in accordance with the conditions prescribed in the present Agreement and its Annex.
Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this article is essential to prevent further infringements of laws or regulations such right shall be exercised only after consultation with the other Contracting Party. Such consultation shall begin within a period of thirty days of the date of request for the consultation.
ARTICLE 6
Aircraft operated on international services by the designated airline of either Contracting Party, as well as their regular equipment, supplies of fuel and lubricants and aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempted from customs duties, inspection fees or other duties or taxes on arriving in the territory of the other Contracting Party provided that such equipment, supplies and stores remain on board the aircraft until it leaves the territory of that Contracting Party.
There shall also be exempted from the same duties, fees and charges with the exception of charges corresponding to the service performed:
Aircraft stores taken on board in the territory of one Contracting Party, within limits fixed by the appropriate authorities of the said Contracting Party, and destined for use on board aircraft engaged in an international service of the other Contracting Party;
Spare parts and regular equipment entered into the territory of either Contracting Party and destined for the maintenance or repair of aircraft used on international services by the designated airline of the other Contracting Party;
Fuel and lubricants destined to supply aircraft operated on international services by the designated airline of the other Contracting Party, even when these supplies are to be used on the part of the journey performed over the territory of the Contracting Party in which they are taken on board.
Materials referred to in sub-paragraphs a), b) and c) above may be kept under customs supervision or control, if the national laws or regulations of either Contracting Party so require.
ARTICLE 7
The regular airborne equipment, as well as the materials and spare parts retained on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that territory. In such case they may be placed under supervision of the said authorities until they are loaded on board aircraft and leave the territory of that Contracting Party or are otherwise disposed of in accordance with customs regulations.
ARTICLE 8
There shall be fair and equal opportunity for the designated airlines of both Contracting Parties to operate the agreed services between their respective territories. In operating such services, the designated airline of each Contracting Party shall take into account the interests of the designated airline of the other Contracting Party, so as not to affect unduly the services which the latter provides on the whole or part of the specified route.
The total capacity to be provided shall be maintained in equilibrium with the traffic requirements between the territories of the Contracting Parties and shall as far as possible be equally divided between the designated airlines.
The designated airlines shall agree on the frequency and capacity of the services to be offered on the routes connecting the territories of both Contracting Parties. Such capacity shall be adjusted from time to time to traffic requirements and submitted to the approval of the Aeronautical Authorities of both Contracting Parties.
In order to meet unexpected traffic demands of a temporary character, the designated airlines may, notwithstanding the provisions of this article, agree between them to such temporary increases as are necessary to meet the traffic demand. Every such increase of capacity shall be notified without delay to the Aeronautical Authorities of the Contracting Parties.
ARTICLE 9
The tariffs to be charged by the designated airline of one Contracting Party for transport to or from the territory of the other Contracting Party shall be established at reasonable levels due regard being paid to all relevant factors including cost of operation, reasonable profit and the tariffs of the other airlines.
The tariffs referred to in paragraph 1 of this article shall, if possible, be agreed between the designated airlines of both Contracting Parties in consultation, when necessary, with other airlines operating over the whole route or part of it, and such agreement shall, if possible, be reached in accordance with usual practice in international air services.
The tariffs so agreed shall be submitted for approval to the Aeronautical Authorities of the Contracting Parties at least forty-five days before the proposed date of their introduction. In special cases this time limit may be reduced, subject to the agreement of the said authorities.
This approval may be given expressly. If neither of the Aeronautical Authorities has expressed disapproval wi hin thirty days from the date of submission, in accordance with paragraph 3 of this article, these tariffs shall be considered as approved. In the event of the period for submission being reduced, as provided for in paragraph 3, the Aeronautical Authorities may agree that the period within which any disapproval must be notified shall be less than thirty days.
If the designated airlines cannot agree on any of these tariffs, or if for some other reason a tariff cannot be fixed in accordance with the provisions of paragraph 2 of this article, or if during the periods referred to in paragraph 4 of this article the Aeronautical Authorities of one Contracting Party give the Aeronautical Authori ies of the other Contracting Party notice of their disagreement with any tariff agreed in accordance with the provisions of paragraph 2 of this article, the Aeronautical Authorities of the Contracting Par ies shall try to determine the tariffs by agreement be ween themselves.
If the Aeronautical Authorities cannot agree on any tariff submitted to them under paragraph 3 of this article, or on the determination of any tariff under paragraph 5 of this article, the dispute shall be settled in accordance with the provisions of article 16 of the present Agreement.
Subject to the provisions of paragraph 3 and 6 of this article, no tariff shall come into force if the Aeronautical Authorities of either Contracting Party have not approved it.
The tariffs established in accordance with the provisions of this article shall remain in force until new tariffs have been established. Nevertheless, a tariff shall net be prolonged by virtue of this paragraph for more than twelve months after the date on which it otherwise would have expired.
ARTICLE 10
The designated airline of one Contracting Party shall comply, in its commercial and financial activities in the territory of the other Contracting Party with the laws and regulations of that Contracting Party.
The Contracting Parties agree that the charges levied by one Contracting Party on the designated airline of the other Contracting Party for the use of airports, air navigation facilities and other technical installlations, shall not exceed those levied on foreign airlines engaged in similar international services.
ARTICLE 11
The laws and regulations of each Contracting Party, governing the admission to, remaining in and departure from its territory of aircraft engaged in internationl air services and the operation and navigation of such aircraft while within its territory, shall also be applied to the aircraft of the designated airline of the other Contracting Party.
The laws and regulations of one Contracting Party, governing the admission to, remaining in and departure from its territory of passengers, crews, cargo and mail, such as regulations relating to entry, customs control, quarantine and currency shall be applicable to passengers, crews, cargo and mail carried on board the aircraft of the designated airline of the other Contracting Party while within that territory.
A fair treatment shall be accorded to the airlines of both Contracting Parties in respect of the operation of the agreed services and no difference shall be made by one Contracting Party in its territory, between the airline designated by the other Contracting Party and other foreign airlines.
ARTICLE 12
Certificates of airworthiness and licences issued or rendered valid by one Contracting Party shall be recognized by the other Contracting Party, for the purpose of operating the agreed services.
Aircraft used by the designated airlines of the Contracting Parties, engaged in the agreed services, as well as the members of their crews, shall carry respectively the valid documents normally required in international air services.
ARTICLE 13
Each Contracting Party shall grant to the designated airline of the other Contracting Party the right of transfer of excess of receipts over expenditure earned by that airline in the territory of the first Contracting Party in connection with the carriage of passengers, baggage, cargo and mail in accordance with the foreign exchange regulations in force (if any) at the official bank rate of exchange.
ARTICLE 14
In a spirit of close cooperation, the Aeronautical Authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of the present Agreement and the Annex thereto.
Such consultation may be through discussion or by correspondence and shall begin within a period of sixty days of the date it is requested unless both Aeronautical Authorities agree to an extension of this period.
ARTICLE 15
The Aeronautical Authorities of one Contracting Party shall supply the Aeronautical Authorities of the other Contracting Party at their request, which such statistics as may be reasonably required for the purpose of reviewing the capacity provided on the agreed services.
ARTICLE 16
In case that any dispute should arise between the Contracting Parties relating to the interpretation or application of the present Agreement and its Annex, the Contracting Parties shall endeavour to settle it by negotiations.
If the Contracting Parties fail to reach a settlement by negotiations, the Contracting Parties shall submit the dispute to an arbitral tribunal. For this purpose each Contracting Party shall nominate an arbitrator. The arbitrators so designated shall designate a third arbitrator, who must be a national of a third State and shall act as president of the tribunal.
If either Contracting Party fails to designate an arbitrator within a period of sixty days after one of the Contracting Parties has notified its intention to refer the dispute for decision to an arbitral tribunal, or if the arbitrators fail to reach an agreement to designate the third arbitrator within a period of thirty days, the president of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to designate an arbitrator or arbitrators, as the case requires. If the president of the Council of the International Civil Aviation Organization is a national of either Contracting Party, the vice-president of that Council, who is a national of a third State, may be requested to designate the above mentioned arbitrators.
Each Contracting Party shall pay the expenses of the arbitrator it has nominated. The remaining expenses of the arbitration tribunal shall be shared equally by the Contracting Parties.
The Contracting Parties undertake to comply with any decision given by the arbitral tribunal.
ARTICLE 17
If either Contracting Party considers it desirable to modify any provision in the present Agreement, such Contracting Party can at any time request, through diplomatic channels, a consultation on the ma ter between the Aeronautical Authorities. Such consultation shall begin not later than sixty days, or in the term agreed by the Contracting Parties, from the date of request. If the said authorities reach an agreement on the modifications to be made, such modifications shall become effective when each Contracting Party notifies the other that it has ratified or approved them in accordance with its constitutional regulations.
If the Aeronautical Authorities of either Contracting Party consider it desirable to modify or to make any addition to the provisions of the Annex to this Agreement, they can at any time request a consultation with the Aeronautical Authorities of the other Contracting Party. Such consultation shall begin not later than sixty days or in the term agreed by the Contracting Parties, from the date of the request. If the said au horities agree on the proposed modifications or additions, such modifications or additions shall be brought into effect by a written arrangement between them, which will specify the date of their application as well. Such written arrangement cannot be contrary to the principles established in this Agreement.
ARTICLE 18
The present Agreement and its Annex shall be deemed amended in conformity with a multilateral air transport agreement which may become binding on both Contracting Parties.
ARTICLE 19
The Contracting Parties shall register with the International Civil Aviation Organization this Agreement and its Annex and modifications which may be made thereto.
ARTICLE 20
Either Contracting Party may at any time notify the other of its intention to terminate the present Agreement; such a notice shall be sent simultaneously to the Internationl Civil Aviation Organization. In such case the Agreement shall terminate twelve months after the date on which the notice of termination is received by the other Contracting Party unless such notice is withdrawn before the end of this period. Should the other Party not acknowledge receipt, the notification will be considered as having been received fourteen days subsequent to the date of its receipt by the International Civil Aviation Organization.
ARTICLE 21
The present Agreement shall enter into force upon the date when each Contracting Party has communicated to the other, through diplomatic channels, that it has ratified or approved the Agreement in accordance with its constitutional provisions.
In witness whereof the Plenipotentiaries, being duly authorized by their respective Governments, have signed the present Agreement.

ANNEX
SECTION I
The designated airline of Portugal may operate scheduled air services on the following routes:
Points of departure:
Points in Portugal.
Intermediate points:
Zurich or Marseille or Milano or other point to be agreed upon later.
Points in the Socialist Federal Republic of Yugoslavia:
Belgrade and/or Zagreb.
Point beyond:
To be agreed upon later.
The intermediate points and/or point beyond may be omitted on any or all of the flights.
SECTION II
The designated airline of the Socialist Federal Republic of Yugoslavia may operate scheduled air services on the following routes:
Points of departure:
Points in the Socialist Federal Republic of Yugoslavia.
Intermediate points:
Zurich or Geneva or Marseille or other point to be agreed upon later.
Points in Portugal:
Lisbon and/or Porto.
Point beyond:
Havana or other point to be agreed upon later.
The intermediate points and/or point beyond may be omitted on any or all of the flights.
Note
In the operation of its agreed service as specified in section I of the Annex, the designated airline of Portugal shall be entitled to exercise traffic rights in either direction between Marseille and Belgrade and the exercise of these rights will cease within two years of the beginning of operation, unless otherwise agreed.
In the operation of its agreed service as specified in section II of the Annex, the designated airline of the Socialist Federal Republic of Yugoslavia shall be entitled to exercise traffic rights in either direction between Marseille and Lisbon and the exercise of these rights will cease within two years of the beginning of operation, unless otherwise agreed.
The designated airline of the Socialist Federal Republic of Yugoslavia shall be entitled to exercise traffic rights in either direction between Lisbon and Havana until the designated airline of Portugal introduces its service to Havana.
Memorandum of understanding
YUGOSLAVIA/PORTUGAL AIR TRANSPORT AGREEMENT NEGOTIATIONS
May/June 1976
Delegations representing the Governments of the Socialist Federal Republic of Yugoslavia and Portugal met in Belgrade from May 31 to June 3, 1976 to consider the operation of air services between the two countries.
In the course of negotiations which led to the signing of the Air Transport Agreement in Belgrade on June 3, 1976 between the Socialist Federal Republic of Yugoslavia and Portugal, the Yugoslav and Portuguese delegations reached the following understanding:
Either Contracting Party may operate non-scheduled flights provided that special authorization is obtained in accordance with the national respective regulations on the basis of reciprocity. The requests shall be submitted directly by the airline concerned to the Aeronautical Authorities of the other Contracting Party within a period not less than two working days prior to the beginning date of operation of such flights.
The Aeronautical Authorities of the Contracting Parties have recommended to their respective designated airlines that they should endeavour to reach the forms of cooperation regarding the air services between the respective countries so that such services may commence at an early date and be operated for the benefit of closer relations between Yugoslav and Portuguese people.

ACORDO DE TRANSPORTE AÉREO ENTRE O GOVERNO DE PORTUGAL E O GOVERNO DA REPÚBLICA SOCIALISTA FEDERATIVA DA JUGOSLÁVIA.
O Governo de Portugal e o Governo da República Socialista Federativa da Jugoslávia, daqui em diante designados por «Partes Contratantes»:
Sendo partes da Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago aos sete dias do mês de Dezembro de 1944;
Desejando concluir um acordo de transporte aéreo regular entre os seus respectivos territórios e para pontos além;
acordaram no seguinte:
ARTIGO 1
Para os efeitos do presente Acordo, salvo entendimento em contrário do seu contexto:
O termo «a Convenção» significa a Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago aos 7 dias do mês de Dezembro de 1944, incluindo qualquer Anexo adoptado nos termos do artigo 90.º daquela Convenção e qualquer emenda aos Anexos ou à Convenção nos termos dos artigos 90.º e 94.º, na medida em que esses Anexos e Emendas tenham entrado em vigor para ambas as Partes Contratantes;
O termo «autoridades aeronáuticas» significa:
Para Portugal:
A Secretaria de Estado dos Transportes e Comunicações - Direcção-Geral da Aeronáutica Civil;
Para a República Socialista Federativa da Jugoslávia:
Administração da Aviação Civil Federativa.
Estes organismos poderão ser substituídos por qualquer outro organismo ou pessoa autorizada a exercer as suas actuais funções;
O termo «empresa designada» significa uma empresa de transporte aéreo que tenha sido designada e autorizada de harmonia com as disposições do artigo 4 do presente Acordo;
O termo «território» em relação a um Estado significa as áreas terrestres e as águas territoriais a elas adjacentes sob a soberania desse Estado;
O termo «serviço acordado» significa quaisquer serviços aéreos regulares de transporte público de passageiros, carga e correio nas rotas referidas no Anexo ao presente Acordo;
O termo «tarifa» significa os preços a serem pagos pelo transporte de passageiros, bagagem e mercadorias e as condições em que se aplicam esses preços, incluindo os preços e condições referentes aos serviços de agência e outros serviços auxiliares, mas excluindo a remuneração ou condições relativas ao transporte de correio.
ARTIGO 2
Cada Parte Contratante concede à outra Parte Contratante os direitos referidos no presente Acordo para o estabelecimento de serviços aéreos internacionais regulares nas rotas especificadas no Anexo a este Acordo. Os referidos serviços e rotas são designados, daqui por diante, por «serviços acordados» e «rotas especificadas», respectivamente.
ARTIGO 3
A empresa designada por cada Parte Contratante gozará, na exploração de um serviço acordado numa rota especificada, dos seguintes direitos:
Sobrevoar, sem aterrar, o território da outra Parte Contratante;
Aterrar no referido território para fins não comerciais;
Aterrar no referido território nos pontos especificados para a rota ou rotas no Anexo ao presente Acordo, a fim de embarcar e desembarcar passageiros, carga e correio em serviços internacionais, de harmonia com as disposições do presente Acordo e seu Anexo.
As disposições do presente artigo não deverão ser entendidas como conferindo à empresa de uma Parte Contratante o direito de embarcar no território da outra Parte Contratante passageiros, carga ou correio transportados contra remuneração ou em regime de fretamento e destinados a outro ponto no território da mesma Parte Contratante (cabotagem).
ARTIGO 4
Cada Parte Contratante terá o direito de designar uma empresa para explorar os serviços acordados nas rotas especificadas. Tal designação deverá ser notificada por escrito pelas autoridades aeronáuticas da Parte Contratante que tiver designado a empresa às autoridades da outra Parte Contratante.
Uma vez recebida tal notificação, as autoridades aeronáuticas deverão, sob reserva das disposições do parágrafo 3 do presente artigo, conceder sem demora à empresa designada a competente autorização de exploração.
As autoridades aeronáuticas de uma Parte Contratante poderão exigir que a empresa designada pela outra Parte Contratante demonstre estar em condições de satisfazer as exigências prescritas nas leis e regulamentos normal e razoavelmente aplicados à exploração de serviços aéreos internacionais, em conformidade com as disposições da Convenção.
Uma vez designada e autorizada, a empresa poderá iniciar em qualquer altura a exploração dos serviços acordados, parcial ou totalmente, desde que os horários e tarifas relativos a tais serviços tenham sido estabelecidos de harmonia com as disposições do parágrafo 5 do presente artigo e artigo 9, respectivamente.
Os horários dos serviços acordados deverão ser submetidos pela empresa designada de uma Parte Contratante à aprovação das autoridades aeronáuticas da outra Parte Contratante, pelo menos, trinta dias antes da data prevista para o seu início. Qualquer modificação dos horários deverá também ser submetida às autoridades aeronáuticas para aprovação.
ARTIGO 5
Cada Parte Contratante terá o direito de revogar a autorização da exploração ou de suspender o exercício dos direitos especificados no artigo 3 do presente Acordo pela empresa designada pela outra Parte Contratante, ou de impor ao exercício de tais direitos as condições que considerar necessárias, no caso de:
Não dar por demonstrado que, relativamente à República Socialista Federativa da Jugoslávia, a Organização dos Trabalhadores Associados do Transporte Aéreo tem o contrôle efectivo da empresa designada e que os seus fundos são propriedade pública e que, relativamente a Portugal, a propriedade substancial e o contrôle efectivo da empresa designada pertencem à Parte Contratante que a designou ou aos nacionais da dita Parte Contratante;
A empresa deixar de cumprir as leis e regulamentos da Parte Contratante que concede os direitos; ou
A empresa deixar, por outro modo, de operar os serviços acordados de harmonia com as condições prescritas no presente Acordo e seu Anexo.
Salvo se a revogação imediata, suspensão ou imposição das condições mencionadas no parágrafo 1 deste artigo for essencial para evitar ulteriores infracções de leis ou regulamentos, tal direito apenas será exercido após consulta com a outra Parte Contratante. Tal consulta terá início no prazo de trinta dias a contar da data do pedido para a sua realização.
ARTIGO 6
As aeronaves da empresa designada por uma Parte Contratante utilizadas na exploração de serviços internacionais, assim como o seu equipamento normal, reservas de combustível e lubrificantes e provisões (incluindo alimentos, bebidas e tabaco) que se encontrem a bordo de tais aeronaves serão isentos de direitos aduaneiros, taxas de inspecção ou outros impostos semelhantes à chegada ou à partida do território da outra Parte Contratante, desde que tal equipamento, reservas e provisões permaneçam a bordo da aeronave até que esta abandone o território dessa Parte Contratante.
Serão igualmente isentos dos mesmos direitos, taxas e impostos, com excepção dos encargos correspondentes a serviços prestados:
As provisões de bordo embarcadas no território de uma Parte Contratante, dentro dos limites fixados pelas autoridades da dita Parte Contratante, e destinadas a serem utilizadas a bordo das aeronaves afectas a serviços internacionais da outra Parte Contratante;
As peças sobresselentes e equipamento normal importados no território de qualquer das Partes Contratantes para a manutenção ou reparação das aeronaves utilizadas em serviços internacionais pela empresa designada da outra Parte Contratante;
Os combustíveis e lubrificantes destinados ao abastecimento das aeronaves utilizadas em serviços internacionais pela empresa designada da outra Parte Contratante, mesmo quando aqueles produtos se destinem a ser utilizados no percurso sobre o território da Parte Contratante no qual foram embarcados.
Os materiais referidos nas alíneas a), b) e c) podem ser colocados sob vigilância ou contrôle das autoridades aduaneiras, se as leis ou regulamentos de qualquer das Partes Contratantes assim o determinarem.
ARTIGO 7
O equipamento normal de bordo, bem como os materiais e sobresselentes mantidos a bordo das aeronaves de cada Parte Contratante, só poderão ser descarregados no território de outra Parte Contratante com a aprovação das autoridades aduaneiras desse território. Neste caso, deverão ser colocados sob vigilância das ditas autoridades até serem embarcados e deixarem o território dessa Parte Contratante ou de lhes ser dado outro destino, de harmonia com os regulamentos aduaneiros.
ARTIGO 8
As empresas designadas pelas Partes Contratantes terão justa e igual oportunidade de exploração dos serviços acordados entre os respectivos territórios. A empresa designada por cada Parte Contratante deverá ter em consideração, na exploração dos serviços acordados, os interesses da empresa designada pela outra Parte Contratante, de modo a não afectar indevidamente os serviços que esta última ofereça, no todo ou em parte, da rota especificada.
A capacidade total a oferecer será mantida em equilíbrio com as necessidades do tráfego entre os territórios das Partes Contratantes e será dividida em partes, tanto quanto possível, iguais entre as empresas designadas.
As empresas designadas entender-se-ão sobre a frequência e capacidade dos serviços a oferecer nas rotas que ligam os territórios das duas Partes Contratantes. A referida capacidade será ajustada periodicamente às necessidades do tráfego e submetida à aprovação das autoridades aeronáuticas de ambas as Partes Contratantes.
A fim de satisfazer exigências de tráfego imprevistas de carácter temporário, as empresas designadas poderão, não obstante as disposições deste artigo, decidir entre elas os aumentos temporários de capacidade que forem necessários para satisfazer a procura de tráfego. Cada um destes aumentos de capacidade deverá ser notificado sem demora às autoridades aeronáuticas das Partes Contratantes.
ARTIGO 9
As tarifas a aplicar pela empresa designada de uma Parte Contratante ao transporte para ou do território da outra Parte Contratante deverão ser estabelecidas a níveis razoáveis, tendo em devida conta a cobertura de todos os factores relevantes, incluindo o custo de operação, lucro razoável e as tarifas de outras empresas.
As tarifas referidas no parágrafo 1 deste artigo deverão, se possível, ser acordadas entre as empresas designadas pelas duas Partes Contratantes, após consulta, quando necessário, a outras empresas que operem no todo ou em parte da rota, e esse acordo deverá, sempre que possível, ser estabelecido em conformidade com a prática usual em serviços aéreos internacionais.
As tarifas assim acordadas serão submetidas a aprovação das autoridades aeronáuticas das Partes Contratantes, pelo menos, quarenta e cinco dias antes da data proposta para a sua entrada em vigor. Em casos especiais, este prazo poderá ser reduzido mediante acordo das referidas autoridades.
Tal aprovação será dada expressamente. No caso de nenhuma das autoridades aeronáuticas ter manifestado o seu desacordo no prazo de trinta dias a contar da data da apresentação para aprovação, de harmonia com o parágrafo 3 deste artigo, estas tarifas serão consideradas aprovadas. Caso o período de apresentação para a aprovação seja reduzido, conforme previsto no parágrafo 3, as autoridades aeronáuticas poderão acordar que o prazo em que qualquer desaprovação deva ser notificada seja inferior a trinta dias.
Se as empresas designadas não chegarem a acordo sobre as tarifas, ou se por qualquer outra razão as tarifas não puderem ser fixadas de harmonia com o disposto no parágrafo 2 deste artigo, ou se durante os períodos referidos no parágrafo 4 do mesmo as autoridades aeronáuticas de uma Parte Contratante notificarem as autoridades aeronáuticas da outra Parte Contratante do seu desacordo com alguma tarifa estabelecida de harmonia com as disposições do parágrafo 2 do presente artigo, as autoridades aeronáuticas das Partes Contratantes tentarão determinar as tarifas por acordo entre si.
Se as autoridades aeronáuticas não chegarem a acordo sobre as tarifas a elas apresentadas, nos termos do parágrafo 3 do presente artigo, ou sobre a sua determinação, nos termos do parágrafo 5 do mesmo, o diferendo deverá ser solucionado de harmonia com o disposto no artigo 16 do presente Acordo.
Sem prejuízo do disposto nos parágrafos 3 e 6 do presente artigo, nenhuma tarifa entrará em vigor sem a aprovação das autoridades aeronáuticas de qualquer das Partes Contratantes.
As tarifas estabelecidas, de harmonia com o disposto neste artigo, permanecerão em vigor até ao estabelecimento de novas tarifas. A validade de uma tarifa não poderá ser prorrogada, em virtude deste parágrafo, por período superior a doze meses a contar da data em que deveria ter expirado.
ARTIGO 10
A empresa designada por uma Parte Contratante deverá cumprir, no exercício das suas actividades comerciais e financeiras em território da outra Parte Contratante, as leis e regulamentos desta.
As Partes Contratantes acordam em que as taxas cobradas por uma Parte Contratante à empresa designada pela outra Parte Contratante por utilização de aeroportos, facilidades de navegação aérea e outras instalações técnicas não deverão exceder as que forem cobradas a empresas estrangeiras que operem serviços internacionais similares.
ARTIGO 11
As leis e regulamentos de cada Parte Contratante relativos à entrada, permanência e saída do seu território de aeronaves utilizadas em serviços aéreos internacionais e à operação e navegação de aeronaves dentro dos limites do seu território serão também aplicados às aeronaves da empresa designada pela outra Parte Contratante.
As leis e regulamentos de uma Parte Contratante relativos à entrada, permanência e saída do seu território de passageiros, tripulantes, carga e correio, bem como os relativos à entrada, contrôle aduaneiro, quarentena e moeda, serão aplicados aos passageiros, tripulantes, carga e correio transportados pelas aeronaves da empresa designada pela outra Parte Contratante quando dentro do seu território.
Será concedido um justo tratamento às empresas das duas Partes Contratantes relativamente à exploração dos serviços acordados e não será praticada discriminação por uma Parte Contratante dentro do seu território entre a empresa designada pela outra Parte Contratante e outras empresas estrangeiras.
ARTIGO 12
Os certificados de navegabilidade e as licenças emitidas ou validadas por uma Parte Contratante deverão ser reconhecidos pela outra Parte Contratante para efeito de exploração dos serviços acordados.
As aeronaves das empresas designadas pelas Partes Contratantes utilizadas nos serviços acordados, bem como os seus tripulantes, deverão transportar os documentos válidos normalmente exigidos nos serviços aéreos internacionais.
ARTIGO 13
Cada Parte Contratante concede à empresa designada pela outra Parte Contratante o direito de transferir os excedentes das receitas sobre as despesas ganhos por essa empresa no território da primeira Parte Contratante relativos ao transporte de passageiros, bagagem, carga e correio, de harmonia com os regulamentos de transferências para o estrangeiro em vigor (se existentes), ao câmbio oficial.
ARTIGO 14
Num espírito de estreita cooperação, as autoridades aeronáuticas das Partes Contratantes consultar-se-ão periodicamente, a fim de assegurarem a aplicação e satisfatória observância das disposições do presente Acordo e seu Anexo.
As referidas consultas efectuar-se-ão através de conversações ou por correspondência e iniciar-se-ão dentro do período de sessenta dias a contar da data em que foram pedidas, a menos que ambas as Partes Contratantes acordem na prorrogação deste período.
ARTIGO 15
As autoridades aeronáuticas de uma Parte Contratante fornecerão às autoridades aeronáuticas da outra Parte Contratante, a seu pedido, as estatísticas razoavelmente necessárias à revisão da capacidade oferecida nos serviços acordados.
ARTIGO 16
No caso de surgir entre as Partes Contratantes algum diferendo relativo à interpretação ou aplicação do presente Acordo e seu Anexo, as Partes Contratantes tentarão solucioná-lo através de negociações.
No caso de as Partes Contratantes não conseguirem uma solução negociada, deverão submeter o diferendo a um tribunal arbitral. Para tal cada Parte Contratante designará um árbitro. Os árbitros assim designados deverão indicar um terceiro árbitro, que deverá ser nacional de um terceiro Estado e actuará como presidente do tribunal.
Se qualquer das Partes Contratantes deixar de designar um árbitro dentro do período de sessenta dias a contar da data em que a outra Parte Contratante a tenha notificado da sua intenção de confiar a solução do diferendo a um tribunal arbitral, ou se os árbitros não acordarem na designação do terceiro árbitro dentro de um período de trinta dias, o presidente do Conselho da Organização da Aviação Civil Internacional pode ser solicitado por qualquer das Partes Contratantes para nomear um árbitro ou árbitros, conforme o caso. Se o presidente do Conselho da Organização da Aviação Civil Internacional for nacional de uma das Partes Contratantes, o vice-presidente do referido Conselho que seja nacional de um terceiro Estado pode ser solicitado para designar os mencionados árbitros.
Cada Parte Contratante deverá pagar as despesas do árbitro por si designado. As restantes despesas do tribunal arbitral serão suportadas em partes iguais pelas Partes Contratantes.
As Partes Contratantes comprometem-se a cumprir qualquer decisão proferida pelo tribunal arbitral.
ARTIGO 17
No caso de uma Parte Contratante pretender modificar qualquer disposição do presente Acordo, pode a todo o tempo solicitar, por via diplomática, consultas sobre a matéria entre as autoridades aeronáuticas. Tais consultas deverão iniciar-se dentro do prazo de sessenta dias a contar da data do pedido, ou no prazo acordado pelas Partes Contratantes. Se as referidas autoridades acordarem nas modificações a efectuar, tais modificações entrarão em vigor quando cada Parte Contratante notificar a outra de que as ratificou ou aprovou, de harmonia com os seus preceitos constitucionais.
No caso de as autoridades aeronáuticas de uma Parte Contratante desejarem modificar ou fazer algum aditamento às disposições do Anexo ao presente Acordo, poderão em qualquer altura solicitar consultas às autoridades aeronáuticas da outra Parte Contratante. Tais consultas deverão iniciar-se dentro do prazo de sessenta dias a contar da data do seu pedido, ou no prazo acordado pelas Partes Contratantes. Se as referidas autoridades acordarem nas modificações ou aditamentos propostos, tais modificações ou aditamentos serão estabelecidos por documento escrito, o qual especificará a data da sua aplicação. O referido documento escrito não pode contrariar os princípios consignados no presente Acordo.
ARTIGO 18
O presente Acordo e seu Anexo será considerado emendado em conformidade com qualquer acordo multilateral de transporte aéreo que venha a obrigar ambas as Partes Contratantes.
ARTIGO 19
As Partes Contratantes registarão na Organização da Aviação Civil Internacional o presente Acordo e seu Anexo, bem como as modificações que lhes sejam feitas.
ARTIGO 20
Cada Parte Contratante poderá em qualquer altura notificar a outra da sua intenção de fazer cessar o presente Acordo; a referida notificação será comunicada simultaneamente à Organização da Aviação Civil Internacional. Nesse caso, o Acordo cessará doze meses após a data da recepção da notificação pela outra Parte Contratante, salvo se essa notificação vier a ser retirada antes do fim desse período.
No caso de a outra Parte não acusar recepção da notificação, esta será considerada como tendo sido recebida catorze dias após a data da sua recepção pela Organização da Aviação Civil Internacional.
ARTIGO 21
O presente Acordo entrará em vigor a partir da data em que as Partes Contratantes tiverem comunicado uma à outra, por via diplomática, que o ratificaram ou aprovaram de harmonia com as suas formalidades constitucionais.
Em fé do que os Plenipotenciários, devidamente autorizados pelos seus Governos, assinaram o presente Acordo.

A empresa designada por Portugal poderá operar serviços aéreos regulares nas seguintes rotas:
Pontos de partida:
Pontos em Portugal.
Pontos intermédios:
Zurique, ou Marselha, ou Milão, ou outro ponto a acordar posteriormente.
Pontos na República Socialista Federativa da Jugoslávia:
Belgrado e ou Zagreb.
Ponto além:
A acordar posteriormente.
Os pontos intermédios e ou o ponto além poderão ser omitidos em algum ou todos os voos.
SECÇÃO II
A empresa designada pela República Socialista Federativa da Jugoslávia poderá operar serviços aéreos regulares nas seguintes rotas:
Pontos de partida:
Pontos na República Socialista Federativa da Jugoslávia.
Pontos intermédios:
Zurique, ou Genebra, ou Marselha, ou outro ponto a acordar posteriormente.
Pontos em Portugal:
Lisboa e ou Porto.
Ponto além:
Havana ou outro ponto a acordar posteriormente.
Os pontos intermédios e ou o ponto além poderão ser omitidos em algum ou todos os voos.
Nota
Na exploração do seu serviço acordado, conforme especificado na secção I do Anexo, a empresa designada por Portugal será autorizada a exercer direitos de tráfego em ambos os sentidos entre Marselha e Belgrado, e o exercício de tais direitos cessará dentro do prazo de dois anos a contar do início da exploração, salvo acordo em contrário.
Na exploração do seu serviço acordado, conforme especificado na secção II do Anexo, a empresa designada pela República Socialista Federativa da Jugoslávia será autorizada a exercer direitos de tráfego em ambos os sentidos entre Marselha e Lisboa, e o exercício de tais direitos cessará dentro do prazo de dois anos a contar do início da exploração, salvo acordo em contrário.
A empresa designada pela República Socialista Federativa da Jugoslávia será autorizada a exercer direitos de tráfego em ambos os sentidos entre Lisboa e Havana até que a empresa designada por Portugal estabeleça o seu serviço para Havana.
Memorando de entendimento
NEGOCIAÇÕES RELATIVAS AO ACORDO DE TRANSPORTES AÉREOS ENTRE PORTUGAL E A JUGOSLÁVIA
Maio-Junho de 1976
Delegações representando os Governos da República Socialista Federativa da Jugoslávia e de Portugal reuniram-se em Belgrado de 31 de Maio a 3 de Junho de 1976 a fim de considerarem a exploração de serviços aéreos entre os dois países.
No decurso das negociações que conduziram à assinatura do Acordo de Transportes Aéreos, em Belgrado, em 3 de Junho de 1976, entre a República Socialista Federativa da Jugoslávia e Portugal as delegações jugoslava e portuguesa acordaram no seguinte entendimento:
Cada Parte Contratante poderá efectuar voos não regulares sujeitos a autorização especial obtida de acordo com os respectivos regulamentos nacionais numa base de reciprocidade. Os pedidos deverão ser submetidos directamente pela empresa interessada às autoridades aeronáuticas da outra Parte Contratante com antecedência não inferior a dois dias úteis em relação à data do início da realização de tais voos.
As autoridades aeronáuticas das Partes Contratantes recomendaram às respectivas empresas designadas que se esforcem por encontrar formas de cooperação quanto aos serviços aéreos entre os respectivos países, a fim de que tais serviços possam iniciar-se dentro de pouco tempo e ser explorados no interesse do estreitamento das relações entre os povos jugoslavo e português.
