A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do artigo 166.º da Constituição, aprovar o Acordo entre a Irlanda, o Reino dos Países Baixos, o Reino de Espanha, a República Italiana, a República Portuguesa, a República Francesa e o Reino Unido da Grã-Bretanha e Irlanda do Norte Que Estabelece Um Centro de Análise e Operações Marítimas - Narcóticos, adoptado em Lisboa em 30 de Setembro de 2007, cujo texto, nas versões autenticadas nas línguas holandesa, inglesa, francesa, italiana, portuguesa e espanhola, se publica em anexo.

VERDRAG TUSSEN IERLAND, HET KONINKRIJK DER NEDERLANDEN, HET KONINKRIJK SPANJE, DE ITALIAANSE REPUBLIEK, DE PORTUGESE REPUBLIEK, DE FRANSE REPUBLIEK EN HET VERENIGD KONINKRIJK VAN GROOT-BRITTANNIË EN NOORD-IERLAND TOT OPRICHTING VAN EEN MARITIEM ANALYSE- EN OPERATIECENTRUM OP HET GEBIED VAN VERDOVENDE MIDDELEN.

De Partijen bij dit Verdrag:

Overwegend dat uit onderzoek naar ingevoerde verdovende middelen, in het bijzonder vanuit Zuid-Amerika in West-Europa ingevoerde cocaïne, is gebleken dat steeds meer verdovende middelen over zee en door de lucht over de Atlantische Oceaan worden gesmokkeld naar Europa en de westkust van Afrika;

Bezorgd over de moeilijkheden die men ondervindt bij het tijdig verkrijgen van informatie voor actie op zowel internationaal als Europees niveau op dit gebied, waardoor nog meer problemen ontstaan bij de bestrijding van de smokkel van verdovende middelen over zee in de internationale wateren en via het internationale luchtruim;

Gelet op het uitgesproken internationale karakter van de smokkel van verdovende middelen waarbij criminele organisaties betrokken zijn die actief zijn in verschillende landen en schepen inzetten met uiteenlopende registraties en bemanningen van verschillende nationaliteiten;

Overwegend dat veel landen niet beschikken over voldoende middelen voor surveillance en wetshandhaving op zee en in de lucht om de smokkel van verdovende middelen over zee zelfstandig te beletten en dat er technische en juridische problemen zijn met op wetshandhaving gerichte interventies op zee;

Gelet op het initiatief inzake cocaïne van de Comprehensive Operational Strategic Planning for the Police (PCTF COSPOL);

Voorts gelet op de inventarisatie van Europol van de dreiging die uitgaat van de georganiseerde misdaad (European Organised Crime Threat Assessment - OCTA), waarin de bestrijding van de cocaïnesmokkel als prioriteit voor de wetshandhaving wordt aangemerkt en een regionale aanpak voor de bestrijding van de internationale georganiseerde misdaad wordt aanbevolen;

Gelet op het EU Drugs Actieplan 2005-2012, bekrachtigd door de Europese Raad van 16 en 17 december 2004;

Opnieuw de bestaande maatregelen bevestigend die voorzien zijn in het Enkelvoudig Verdrag inzake verdovende middelen, op 30 maart 1961 te New York aangenomen, als gewijzigd bij het op 25 maart 1972 te Genève aangenomen Protocol en het op 8 augustus 1975 te New York aangenomen Protocol; het Verdrag inzake psychotrope stoffen, op 21 februari 1971 te Wenen aangenomen; het Verdrag van de Verenigde Naties tegen de sluikhandel in verdovende middelen en psychotrope stoffen, op 20 december 1988 te Wenen aangenomen; het Verdrag van de Raad van Europa inzake sluikhandel over zee, ter implementatie van artikel 17 van het Verdrag van de Verenigde Naties tegen de sluikhandel in verdovende middelen en psychotrope stoffen 1988, op 31 januari 1995 te Straatsburg aangenomen; het Verdrag van de Verenigde Naties inzake het recht van de zee, op 10 december 1982 te Montego Bay aangenomen; de Europol-Overeenkomst van 26 juli 1995; het internationale gewoonterecht van de zee en andere relevante internationale juridische instrumenten;

Indachtig de samenwerking tussen de EU-lidstaten en andere staten ter bestrijding van de smokkel van verdovende middelen over zee en door de lucht via de Atlantische Oceaan en de waardevolle inspanningen van de Joint Interagency Task Force (JIATF) South;

Samenwerkend aan een regionaal initiatief dat wordt aangeduid als het MAOC-N (Maritiem Analyse- en Operatiecentrum op het gebied van verdovende middelen);

En optredend in overeenstemming met de onderscheiden nationale wetgeving en procedures van de Partijen;

komen als volgt overeen:

HOOFDSTUK I

Algemene bepalingen

Artikel 1

Doelstelling

1 - Het Maritiem Analyse- en Operatiecentrum op het gebied van verdovende middelen, hierna te noemen «het Centrum», wordt bij dezen in overeenstemming met dit Verdrag door de Partijen opgericht.

2 - Alle Partijen worden lid van het Centrum. Het Centrum voorziet in een basis voor de betrokkenheid van de Partijen bij multilaterale samenwerking op het gebied van de bestrijding van de smokkel van verdovende middelen over zee en door de lucht.

Artikel 2

Reikwijdte

1 - De Partijen werken via het Centrum samen bij de bestrijding van de smokkel van verdovende middelen over zee en door de lucht over de Atlantische Oceaan naar Europa en de westkust van Afrika, met de mogelijkheid de operaties uit te breiden naar onder andere het westelijk deel van het Middellandse-Zeegebied, hierna te noemen het «operatiegebied».

2 - Via het Centrum zullen de Partijen:

a)

informatie verzamelen en analyseren die van nut is om vast te stellen wat de beste operationele resultaten zijn in het licht van de smokkel van verdovende middelen over zee en door de lucht in het operatiegebied;

b)

de inlichtingen helpen verbeteren door onderling en op de geëigende wijze met Europol informatie uit te wisselen;

c)

zich inspannen om de beschikbaarheid van middelen te verzekeren die, waar mogelijk, vooraf worden gemeld, teneinde onderscheppingsoperaties te vereenvoudigen ter bestrijding van de smokkel van verdovende middelen over zee en door de lucht.

Artikel 3

Rechtspersoonlijkheid

Het Centrum heeft rechtspersoonlijkheid op het grondgebied van elk van de Partijen, met inbegrip van de bevoegdheid contracten af te sluiten en roerende en onroerende goederen te verwerven en te vervreemden.

Artikel 4

Zetel

Het Centrum wordt gevestigd in Lissabon, Portugal, hierna te noemen «de Gastheerstaat».

Artikel 5

Waarnemers

1 - Elke Staat of internationale organisatie met dezelfde doelstellingen als de Partijen wat betreft de bestrijding van de smokkel van verdovende middelen over zee en door de lucht kan bij besluit van de Uitvoerende Raad en onder door de Raad vast te stellen voorwaarden worden uitgenodigd waarnemer te worden.

2 - Op de uitwisseling van persoonsgegevens en andere informatie met waarnemers is artikel 6 van toepassing en deze uitwisseling dient beperkt te blijven tot hetgeen strikt noodzakelijk is voor hun medewerking aan de activiteiten van het Centrum.

Artikel 6

Bescherming van persoonsgegevens en andere informatie die door de Partijen is verstrekt

1 - Persoonsgegevens en andere informatie die door de Partijen is verstrekt, worden verwerkt en beschermd in overeenstemming met de nationale wetgeving van de Partijen, het EU-recht en het internationale recht dat bindend is voor de Partijen, met inbegrip van het Verdrag van de Raad van Europa tot bescherming van personen met betrekking tot de geautomatiseerde verwerking van persoonsgegevens, op 28 januari 1981 aangenomen te Straatsburg.

2 - Persoonsgegevens en andere informatie die door de Partijen is verstrekt, worden niet doorgegeven aan derde Staten of andere entiteiten zonder de voorafgaande toestemming van de verschaffer van de informatie en mogen niet worden gebruikt voor doelen anders dan waarvoor ze oorspronkelijk waren doorgegeven.

HOOFDSTUK II

Organisatie en functioneren van het Centrum

Artikel 7

Structuur

Het Centrum zal bestaan uit een Uitvoerende Raad, een directeur, verbindingsofficieren en personeel.

Artikel 8

Uitvoerende Raad

1 - De Uitvoerende Raad zal bestaan uit een hoge vertegenwoordiger van elke Partij, die niet zal optreden als verbindingsofficier bij het Centrum.

2 - De Uitvoerende Raad zal ten minste twee maal per jaar bijeenkomen.

3 - De door de Uitvoerende Raad te vervullen taken omvatten:

a)

het ontwikkelen van de strategie van het Centrum;

b)

het uitnodigen en toelaten van waarnemers met inbegrip van het vaststellen van de voorwaarden voor toelating;

c)

het instellen van comités, waar nodig;

d)

het aannemen van het procedurehandboek en het goedkeuren van eventuele volgende wijzigingen;

e)

het goedkeuren van de jaarlijkse begroting;

f)

het goedkeuren van het jaarverslag;

g)

het benoemen van de directeur van het Centrum.

4 - De Uitvoerende Raad kiest zijn voorzitter voor een termijn van een jaar; het voorzitterschap zal jaarlijks rouleren.

5 - Alle besluiten van de Uitvoerende Raad worden met eenparigheid van stemmen van de Partijen genomen.

Artikel 9

Directeur van het Centrum

1 - De Uitvoerende Raad benoemt de directeur van het Centrum uit een van de Partijen voor een termijn van twee jaar, die eenmaal met ten hoogste twee jaar kan worden verlengd.

2 - De directeur verricht de volgende taken:

a)

het leidinggeven aan de werkzaamheden van Centrum;

b)

het Centrum extern vertegenwoordigen;

c)

het zonder stemrecht bijwonen van de vergaderingen van de Uitvoerende Raad;

d)

het opstellen van het conceptjaarverslag waarin de activiteiten van het Centrum worden beschreven;

e)

het indienen van de jaarlijkse begroting van het Centrum en er rekenschap voor afleggen;

f)

het uitvoeren van de besluiten van de Uitvoerende Raad.

3 - De Gastheerstaat waarborgt de noodzakelijke bescherming en ondersteuning van de directeur.

Artikel 10

Verbindingsofficieren

1 - De Partijen plaatsen verbindingsofficieren bij het Centrum.

2 - De verbindingsofficieren hebben toegang tot de uitrusting, persoonsgegevens en gegevensbestanden van het Centrum.

3 - De verbindingsofficieren verrichten hun werkzaamheden in overeenstemming met het procedurehandboek, voorzien in artikel 12, onderdeel b.

4 - De Gastheerstaat waarborgt de noodzakelijke bescherming en ondersteuning van de verbindingsofficieren die bij het Centrum zijn geplaatst.

Artikel 11

Personeel

1 - De directeur van het Centrum kan, met toestemming van de Uitvoerende Raad, personeel aanstellen voor het uitvoeren van administratieve, technische of onderhoudstaken in het Centrum.

2 - Dit personeel neemt geen deel aan de operationele taken van het Centrum.

Artikel 12

Procedures

Het uit hoofde van artikel 8, derde lid, onderdeel d, door de Uitvoerende Raad aan te nemen procedurehandboek omvat het volgende:

a)

operationele procedures van het Centrum;

b)

rollen en verantwoordelijkheden van de verbindingsofficieren;

c)

protocollen voor de uitwisseling en verwerking van informatie, met inbegrip van de bescherming ervan;

d)

aanvullende informatie over de taken van de Uitvoerende Raad;

e)

taken van elk comité dat uit hoofde van dit Verdrag wordt ingesteld;

f)

procedures voor de planning en coördinatie van operaties;

g)

regelingen voor kennisgevingen voor de vergaderingen van de Uitvoerende Raad;

h)

budgettaire regelingen en de verslaglegging inzake uitgaven aan de Uitvoerende Raad; en

i)

overige aspecten van de taken van het Centrum.

Artikel 13

Operationele en tactische beslissingen

Elke Partij is verantwoordelijk voor operationele en tactische beslissingen en elke beslissing dient te stroken met de grondbeginselen en regels van het internationaal recht, alsmede met hun onderscheiden nationale wetten en procedures.

Artikel 14

Toepasselijk recht

Op het dagelijks functioneren van het Centrum is het recht van de Gastheerstaat van toepassing.

Artikel 15

Kosten

1 - De kosten die betrekking hebben op het budget van het Centrum, met uitzondering van de kosten van de verbindingsofficieren, worden gelijkelijk voldaan en gedragen door de Partijen bij dit Verdrag.

2 - Deelname aan operaties door een Partij geschiedt vrijwillig. Partijen die deelnemen aan een dergelijke operatie dragen hun eigen kosten.

3 - Aanvullende financiering voor het functioneren en beheren van het Centrum kan worden gevraagd van bronnen binnen de Europese Unie of elders.

Artikel 16

Samenwerking met andere entiteiten

Onder strategische aanwijzingen van de Uitvoerende Raad kan het Centrum samenwerken met andere entiteiten die dezelfde doelstellingen nastreven wat betreft de bestrijding van de smokkel van verdovende middelen over zee en door de lucht.

Artikel 17

Evaluatie

Twee jaar na de inwerkingtreding van dit Verdrag wordt het functioneren van het Centrum geëvalueerd door een comité waarin één vertegenwoordiger van elke Partij zitting heeft.

HOOFDSTUK III

Slotbepalingen

Artikel 18

Internationale verplichtingen

Niets in dit Verdrag mag worden uitgelegd als onverenigbaar met bestaande internationale verplichtingen vervat in andere internationale overeenkomsten die de Partijen binden.

Artikel 19

Beslechting van geschillen

Geschillen die voortvloeien uit de uitlegging of toepassing van dit Verdrag worden in overleg of langs een andere door de Partijen overeen te komen wijze van beslechting geregeld.

Artikel 20

Depositaris

De Regering van de Portugese Republiek treedt op als depositaris van dit Verdrag.

Artikel 21

Inwerkingtreding

1 - Dit Verdrag staat open voor ondertekening door Ierland, het Koninkrijk der Nederlanden, het Koninkrijk Spanje, de Italiaanse Republiek, de Portugese Republiek, de Franse Republiek en het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland.

2 - De Staten die dit Verdrag hebben ondertekend stellen de depositaris er schriftelijk en langs diplomatieke weg van in kennis dat aan hun nationale constitutionele vereisten is voldaan en geven daarmee blijk van hun instemming door dit Verdrag te worden gebonden.

3 - Dit Verdrag treedt in werking zestig dagen na de datum waarop de derde kennisgeving, bedoeld in het tweede lid van dit artikel, is gedeponeerd.

4 - Voor de overige ondertekenende Staten treedt dit Verdrag in werking zestig dagen na de datum waarop de kennisgeving, bedoeld in het tweede lid van dit artikel, is gedeponeerd.

Artikel 22

Toetreding

1 - Na de inwerkingtreding staat dit Verdrag open voor toetreding door elke Staat die met eenparigheid van stemmen van de Partijen is uitgenodigd toe te treden.

2 - Dit Verdrag treedt voor de toetredende Staat in werking zestig dagen na de datum van de nederlegging van de desbetreffende akte van toetreding.

Artikel 23

Wijzigingen

1 - Dit Verdrag kan met onderlinge schriftelijke toestemming van alle Partijen worden gewijzigd.

2 - De wijzigingen treden in werking zestig dagen na de datum waarop alle Partijen er schriftelijk en langs diplomatieke weg kennis van hebben gegeven dat aan hun nationale vereisten is voldaan.

Artikel 24

Voorlopige toepassing

Elke Staat kan bij de ondertekening van het Verdrag verklaren de bepalingen van het Verdrag voorlopig toe te zullen passen in afwachting van de inwerkingtreding ervan voor die Staat.

Artikel 25

Beëindiging en opzegging

1 - Dit Verdrag kan te allen tijde in wederzijds overleg tussen de Partijen worden beëindigd waarbij zij overeenkomen op welke datum de bepalingen van het Verdrag ophouden van kracht te zijn.

2 - Zodra het Verdrag twee jaar van kracht is, kan elke Partij het langs diplomatieke weg opzeggen door middel van een kennisgeving, schriftelijk en langs diplomatieke weg, aan de depositaris. De opzegging wordt van kracht zes maanden nadat de depositaris de desbetreffende kennisgeving heeft ontvangen. De depositaris stelt de Partijen in kennis van dergelijke kennisgevingen.

3 - In het geval van opzegging door een Partij draagt die Partij haar aandeel in de kosten die ontstaan totdat de opzegging van kracht wordt.

4 - Dit Verdrag houdt op van kracht te zijn zodra het aantal Partijen lager wordt dan drie.

5 - Niettegenstaande beëindiging of opzegging blijven alle informatie en gegevens die uit hoofde van dit Verdrag zijn doorgegeven onverminderd beschermd overeenkomstig de in dit Verdrag vervatte bepalingen.

Artikel 26

Registratie

Dit Verdrag wordt na zijn inwerkingtreding door de depositaris aan het Secretariaat van de Verenigde Naties toegezonden ter registratie overeenkomstig artikel 102 van het Handvest van de Verenigde Naties.

Gedaan te Lissabon op 30 september 2007, in de Nederlandse, de Engelse, de Franse, de Italiaanse, de Portugese en de Spaanse taal, zijnde alle teksten gelijkelijk authentiek.

AGREEMENT BETWEEN IRELAND, THE KINGDOM OF THE NETHERLANDS, THE KINGDOM OF SPAIN, THE ITALIAN REPUBLIC, THE PORTUGUESE REPUBLIC, THE FRENCH REPUBLIC, AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND ESTABLISHING A MARITIME ANALYSIS AND OPERATIONS CENTRE - NARCOTICS.

The Parties to this Agreement:

Considering that the analysis of drug imports, in particular cocaine imports from South America into Western Europe has shown an increase in illicit drug trafficking by sea and air across the Atlantic to Europe and the West African Seaboard;

Concerned about the difficulty in obtaining timely information for actions in this field, at both an international and European level, which creates additional difficulties in suppressing illicit drug trafficking by sea in international waters and by air in international airspace;

Noting the marked international nature of this illicit drug trafficking involving criminal organizations operating in several countries, employing ships with different registrations and crews of different nationalities;

Considering that many countries do not have sufficient air and sea surveillance and law enforcement assets to carry out alone the interdiction of illicit drug trafficking by sea, and that there are technical and legal difficulties with maritime interdictions;

Taking into account the Comprehensive Operational Strategic Planning for the Police (PCTF COSPOL) initiative on cocaine;

Taking further into account the European Organised Crime Threat Assessment (OCTA) by Europol, which has identified the fight against cocaine trafficking as a priority for law enforcement and encourages the regional approach towards the fight against international organised crime;

Having regard for the EU Drugs Strategy 2005-2012, endorsed by the European Council of 16 and 17 December 2004;

Re-affirming the existing measures provided for in the United Nations Single Convention on Narcotic Drugs, adopted in New York on 30 March 1961, as amended by the Protocol adopted in Geneva on 25 March 1972 and the Protocol adopted in New York on 8 August 1975; the Convention on Psychotropic Substances, adopted in Vienna on 21 February 1971; the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, adopted in Vienna on 20 December 1988; the Council of Europe Agreement on Illicit Traffic by Sea, implementing Article 17 of the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances 1988, adopted in Strasburg on 31 January 1995; the United Nations Convention of the Law of the Sea, adopted in Montego Bay on 10 December 1982; the Europol Convention of 26 July 1995; customary rules of the international law of the sea; and other relevant international legal instruments;

Bearing in mind the co-operation between EU member-states and non EU states against drug trafficking by sea and by air in the Atlantic Ocean and the valuable action of the Joint Interagency Task Force (JIATF) South;

Working together in a regional initiative referred to as the Maritime Analysis and Operations Centre - Narcotics;

And acting in accordance with the respective national law and procedures of the Parties;

agree as follows:

CHAPTER I

General provisions

Article 1

Object

1 - The Maritime Analysis and Operations Centre - Narcotics, hereinafter referred to as the «Centre», is hereby established by the Parties in accordance with this Agreement.

2 - All Parties shall be members of the Centre. The Centre shall provide a basis for the Parties' engagement in multilateral co-operation in the field of suppression of illicit drug trafficking by sea and by air.

Article 2

Scope

1 - The Parties shall co-operate through the Centre in the suppression of illicit drug trafficking by sea and by air across the Atlantic towards Europe and the West African Seaboard, with the possibility of extending its operations, inter alia, into the Western Mediterranean basin, hereinafter referred to as the «operational area».

2 - The Parties, through the Centre, shall:

a)

Collect and analyse information to assist in determining best operational outcomes in relation to illicit drug trafficking by sea and by air in the operational area;

b)

Enhance intelligence through information exchange among themselves and, in the appropriate manner, with Europol;

c)

Endeavour to ascertain the availability of their assets which, where possible, shall be notified in advance, in order to facilitate interdiction operations to suppress illicit drug trafficking by sea and by air.

Article 3

Legal status

The Centre shall enjoy legal personality in the territory of each of the Parties, including the capacity to contract, to acquire and to dispose of movable and immovable property.

Article 4

Location

The Centre shall be located in Lisbon, Portugal, hereinafter referred to as the «Host State».

Article 5

Observers

1 - Any State or International Organization sharing the same objectives as the Parties in the suppression of illicit drug trafficking by sea and by air may be invited to become an observer, by decision of the Executive Board, under the conditions determined by the Board.

2 - The exchange of personal data and other information with the observer shall be governed by Article 6 and shall be limited to that strictly necessary for his cooperation in the activity of the Centre.

Article 6

Protection of Personal Data and Other Information Provided by the Parties

1 - The processing and protection of personal data and other information provided by the Parties shall be carried out in accordance with national laws of the Parties, EU law and international law binding on the Parties, including the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, adopted in Strasbourg on 28 January 1981.

2 - Personal data and other information provided by the Parties shall not be transmitted to third States or any other entity without the prior consent of the provider of the information and may not be used for purposes other than those for which they were initially transmitted.

CHAPTER II

Organisation and operation of the Centre

Article 7

Structure

The Centre shall be composed of an Executive Board, a Director, liaison officers and staff.

Article 8

Executive Board

1 - The Executive Board shall be composed of a senior representative from each Party, who shall not be a liaison officer at the Centre.

2 - The Executive Board shall meet at least twice a year.

3 - The functions performed by the Executive Board shall include:

a)

Development of the Centre's strategic direction;

b)

Invitation and admission of observers, including the determination of conditions of admission;

c)

Establishment of committees, as necessary;

d)

Adoption of the Procedure Handbook and the approval of any subsequent amendments;

e)

Approval of the annual budget;

f)

Approval of the annual report;

g)

Appointment of the Director of the Centre.

4 - The Executive Board shall elect its chairman for a one year term, to be rotated annually.

5 - All decisions of the Executive Board shall be made by unanimous agreement of the Parties.

Article 9

Director of the Centre

1 - The Director of the Centre shall be appointed by the Executive Board from among the Parties for a two year term, which may be extended for a further term, not exceeding two years.

2 - The Director shall have the following functions:

a)

To manage the work of the Centre;

b)

To represent the Centre externally;

c)

To attend Executive Board meetings, without voting rights;

d)

To draft the annual report detailing the activities of the Centre;

e)

To submit the annual budget of the Centre and account for it;

f)

To implement decisions of the Executive Board.

3 - The Host State shall ensure the necessary protection of and assistance to the Director.

Article 10

Liaison officers

1 - The Parties shall assign liaison officers to the Centre.

2 - Liaison officers shall have access to the equipment, personal data and databases of the Centre.

3 - Liaison officers shall work in accordance with the Procedure Handbook, as provided for in article 12, b).

4 - The Host State shall ensure the necessary protection of and assistance to the liaison officers assigned to the Centre.

Article 11

Staff

1 - The Director of the Centre may, with the agreement of the Executive Board, engage staff to perform administrative, technical or maintenance tasks at the Centre.

2 - Such staff shall not take part in the operational functions of the Centre.

Article 12

Procedures

The Procedure Handbook to be adopted by the Executive Board under article 8 (3), d), shall include the following:

a)

Operation procedures of the Centre;

b)

Roles and responsibilities of liaison officers;

c)

Protocols for information exchange and processing, including its protection;

d)

Additional information on the functions of the Executive Board;

e)

Functions of every committee, established under this Agreement;

f)

Procedures for planning and co-ordinating operations;

g)

Notification arrangements for Executive Board meetings;

h)

Budgetary arrangements and reporting of expenditure to the Executive Board; and

i)

Any other aspects of the Centre's functions.

Article 13

Operational and tactical decisions

The responsibility for operational and tactical decisions rests with each Party, and each such decision shall comply with the principles and rules of International Law, as well as their respective national laws and procedures.

Article 14

Applicable law

The daily functioning of the Centre shall be subject to the law of the Host State.

Article 15

Costs

1 - The costs related to the budget of the Centre, excluding liaison officers costs, shall be funded and borne equally by the Parties to this Agreement.

2 - Participation in any operation by a Party shall be voluntary. Parties participating in such an operation shall bear their own costs.

3 - Additional funding for the operation and administration of the Centre may be sought from sources within the European Union or elsewhere.

Article 16

Co-operation with other entities

Subject to the strategic direction of the Executive Board, the Centre may co-operate with other entities which share its objectives in suppressing illegal drug trafficking by sea and by air.

Article 17

Evaluation

The functioning of the Centre shall be evaluated two years after the entry into force of this Agreement by a committee composed of one representative designated by each of the Parties.

CHAPTER III

Final provisions

Article 18

International obligations

Nothing in this Agreement shall be considered as incompatible with any existing international obligations contained in other international agreements binding on the Parties.

Article 19

Settlement of disputes

All disputes arising out of the interpretation or application of this Agreement shall be settled by negotiation or by any other means of settlement agreed by the Parties.

Article 20

Depositary

The Government of the Portuguese Republic shall be the depositary of this Agreement.

Article 21

Entry into force

1 - This agreement shall be open for signature by Ireland, the Kingdom of the Netherlands, the Kingdom of Spain, the Italian Republic, the Portuguese Republic, the French Republic and the United Kingdom of Great Britain and Northern Ireland.

2 - The States that have signed this agreement shall notify the depositary, in writing and through diplomatic channels, of the completion of their national constitutional requirements for expressing their consent to be bound to this Agreement.

3 - This Agreement shall enter into force sixty days following the date of the deposit of the third notification referred to in paragraph 2 of this article.

4 - For the other signatory States, this Agreement shall enter into force sixty days following the date of the deposit of the notification referred to in paragraph 2 of this article.

Article 22

Accession

1 - Following entry into force, this Agreement shall be open for accession by any State invited to accede by the unanimous consent of the Parties.

2 - The present Agreement shall enter into force for the acceding State sixty days following the date of deposit of its respective instrument of accession.

Article 23

Amendments

1 - This Agreement may be amended by mutual written consent of all Parties.

2 - The amendments shall enter into force sixty days following the date of the deposit of the notification by all Parties, in writing and through diplomatic channels, of the completion of the national requirements of each Party.

Article 24

Provisional application

Any State may, at the time of signature of the Agreement, declare that it shall apply the terms of this Agreement provisionally, pending its entry into force in that State.

Article 25

Termination and withdrawal

1 - This Agreement may be terminated at any time by mutual agreement of the Parties, which shall agree the date from which the provisions of the Agreement shall cease to be in force.

2 - After this Agreement has been in force for two years, any Party may withdraw from the Agreement by notification, in writing and through diplomatic channels to the Depositary. Withdrawal shall take effect six months after receipt of such notification by the Depositary. The Depositary shall advise the Parties of receipt of any such notification.

3 - In the case of withdrawal by a Party, that Party shall bear its share of the costs incurred until the withdrawal takes effect.

4 - The Agreement shall cease to be in force if the number of Parties becomes less than three.

5 - Notwithstanding termination or withdrawal, all the information and data transferred pursuant to this Agreement shall continue to be protected according to the provisions set forth herein.

Article 26

Registration

After the entry into force of the Agreement, the Depositary shall transmit it to the Secretariat of the United Nations for registration, in accordance with article 102 of the Charter of the United Nations.

ACCORD ENTRE L'IRLANDE, LE ROYAUME DES PAYS-BAS, LE ROYAUME D'ESPAGNE, LA REPUBLIQUE ITALIENNE, LA REPUBLIQUE PORTUGAISE, LA REPUBLIQUE FRANCAISE, ET LE ROYAUME-UNI DE GRANDE-BRETAGNE ET D'IRLANDE DU NORD, ETABLISSANT UN CENTRE OPERATIONNEL D'ANALYSE DU RENSEIGNEMENT MARITIME POUR LES STUPEFIANTS.

Les Parties au présent Accord:

Considérant que l'analyse des importations de stupéfiants, notamment de cocaïne en provenance d'Amérique du Sud à destination de l'Europe occidentale, a révélé une augmentation du trafic illicite de stupéfiants par voie maritime et aérienne dans l'Atlantique à destination de l'Europe et des côtes d'Afrique de l'Ouest;

Préoccupées par la difficulté d'obtenir des renseignements en temps utile pour mener des actions dans ce domaine tant au niveau international qu'européen, ce qui engendre des difficultés supplémentaires pour réprimer le trafic illicite de stupéfiants par voie maritime dans les eaux internationales et par voie aérienne dans l'espace aérien international;

Prenant note du caractère international marqué de ce trafic illicite de stupéfiants, dans lequel sont impliquées des organisations criminelles opérant dans plusieurs pays et employant des navires de diverses immatriculations et des équipages de diverses nationalités;

Considérant que de nombreux pays ne disposent pas de moyens de surveillance aérienne et maritime et de répression suffisants pour appliquer seuls l'interdiction du trafic illicite de stupéfiants par voie maritime, et qu'il existe des difficultés techniques et juridiques concernant les interceptions maritimes;

Tenant compte de l'initiative concernant la cocaïne du programme global de planification opérationnelle et stratégique de la police (TFCP COSPOL);

Tenant également compte de l'Evaluation de la menace que représente la criminalité organisée (EMCO) d'Europol, qui a identifié la lutte contre le trafic de cocaïne comme une priorité en matière de répression et encourage une approche régionale dans le domaine de la lutte contre la criminalité organisée internationale;

Vu la stratégie antidrogue de l'Union européenne 2005-2012, approuvée par le Conseil européen des 16 et 17 décembre 2004;

Réaffirmant les mesures existantes prévues par la Convention unique des Nations Unies sur les stupéfiants adoptée à New York le 30 mars 1961, telle que modifiée par le Protocole adopté à Genève le 25 mars 1972 et le Protocole adopté à New York le 8 août 1975; la Convention sur les substances psychotropes, adoptée à Vienne le 21 février 1971; la Convention des Nations Unies contre le trafic illicite de stupéfiants et de substances psychotropes, adoptée à Vienne le 20 décembre 1988; l'accord du Conseil de l'Europe relatif au trafic illicite par mer, mettant en oeuvre l'article 17 de la Convention des Nations Unies contre le trafic illicite de stupéfiants et de substances psychotropes, adopté à Strasbourg le 31 janvier 1995; la Convention des Nations Unies sur le droit de la mer, adoptée à Montego Bay le 10 décembre 1982; la Convention Europol du 26 juillet 1995; les règles coutumières du droit international de la mer; ainsi que les autres instruments juridiques internationaux pertinents;

Conscientes de la coopération entre les Etats membres de l'Union européenne et les Etats non membres dans la lutte contre le trafic de stupéfiants par voie maritime et aérienne dans l'océan Atlantique et de l'action pertinente du groupe de travail interinstitutionnel (JIATF) Sud;

Travaillant de façon conjointe dans le cadre de l'initiative régionale dénommée Centre opérationnel d'Analyse du Renseignement maritime pour les Stupéfiants;

Et agissant dans le respect des lois et procédures nationales respectives des Parties;

conviennent de ce qui suit:

CHAPITRE I

Dispositions générales

Article premier

Objet

1 - Les Parties instituent un Centre opérationnel d'Analyse du Renseignement maritime pour les Stupéfiants, ci-après dénommé le «Centre», conformément aux termes du présent Accord.

2 - Toutes les Parties sont membres du Centre. Le Centre permet aux Parties de s'engager dans la coopération multilatérale en vue de la répression du trafic illicite de stupéfiants par voie maritime et aérienne.

Article 2

Champ d'application

1 - Les Parties coopèrent, par le biais du Centre, à la répression du trafic illicite de stupéfiants par voie maritime et aérienne dans l'Atlantique à destination de l'Europe et des côtes d'Afrique de l'Ouest, avec la possibilité d'étendre les opérations du Centre, entre autres, au bassin méditerranéen occidental; l'expression «zone des opérations» désigne ci-après ladite zone.

2 - Les Parties, par le biais du Centre, sont chargées:

a)

De recueillir et d'évaluer des informations afin d'aider à déterminer les meilleurs choix opérationnels en matière de lutte contre le trafic illicite de stupéfiants par voie maritime et aérienne dans la zone des opérations;

b)

De renforcer le renseignement à travers l'échange d'informations entre les Parties et, de manière appropriée, avec Europol;

c)

De s'efforcer de veiller à la disponibilité de leurs moyens, qui font l'objet d'un préavis à cet effet dans la mesure du possible, afin de faciliter les opérations d'interception pour réprimer le trafic illicite de stupéfiants par voie maritime et aérienne.

Article 3

Statut juridique

Le Centre jouit de la personnalité juridique sur le territoire de chacune des Parties, qui inclut la capacité de contracter, d'acquérir et d'aliéner des biens mobiliers et immobiliers.

Article 4

Lieu

Le Centre est situé à Lisbonne, au Portugal, ci-après dénommé l' «Etat d'accueil».

Article 5

Observateurs

1 - Tout Etat ou toute organisation internationale ayant des objectifs identiques à ceux des Parties en matière de répression du trafic illicite de stupéfiants par voie maritime et aérienne peut être invité(e) en tant qu'observateur, sur décision du Comité exécutif, conformément aux conditions définies par le Comité.

2 - L'échange de données à caractère personnel et d'autres informations avec un observateur est régi par l'article 6 et se limite au strict nécessaire pour permettre la participation de ce dernier aux activités du Centre.

Article 6

Protection des données à caractère personnel et des autres informations fournies par les Parties

1 - Le traitement et la protection des données à caractère personnel et des autres informations fournies par les Parties sont assurés conformément à la législation nationale des Parties, au droit communautaire et au droit international liant les Parties, notamment la convention du Conseil de l'Europe pour la protection des personnes à l'égard du traitement automatisé des données à caractère personnel, adoptée à Strasbourg le 28 janvier 1981.

2 - Les données à caractère personnel et les autres informations fournies par les Parties ne peuvent être transmises à des Etats tiers ou à toute autre entité sans le consentement préalable du fournisseur desdites données, et ne peuvent être utilisées à des fins autres que celles qui ont initialement motivé leur transmission.

CHAPITRE II

Organisation et fonctionnement du Centre

Article 7

Structure

Le Centre se compose d'un Comité exécutif, d'un Directeur, d'officiers de liaison et du personnel.

Article 8

Comité exécutif

1 - Le Comité exécutif comprend un représentant de haut rang de chaque Partie, hors les officiers de liaison du Centre.

2 - Le Comité exécutif se réunit au minimum deux fois par an.

3 - Les fonctions remplies par le Comité exécutif comprennent:

a)

Le développement de la direction stratégique du Centre;

b)

L'invitation et l'admission des observateurs, et la définition des conditions d'admission;

c)

La création de comités, si nécessaire;

d)

L'adoption du Manuel de Procédures et l'approbation de toute modification ultérieure;

e)

L'approbation du budget annuel;

f)

L'approbation du rapport annuel;

g)

La nomination du Directeur du Centre.

4 - Le Comité exécutif élit son président pour une durée d'un an. La présidence est assurée par rotation annuelle.

5 - Toutes les décisions du Comité exécutif sont prises à l'unanimité des Parties.

Article 9

Directeur du Centre

1 - Le Comité exécutif désigne le Directeur du Centre parmi les membres des Parties pour une période de deux ans, qui peut être prolongée pour une durée n'excédant pas deux ans.

2 - Les fonctions du Directeur sont les suivantes:

a)

Diriger le travail du Centre;

b)

Représenter le Centre à l'extérieur;

c)

Assister sans droit de vote aux réunions du Comité exécutif;

d)

Rédiger le projet de rapport annuel relatif aux activités du Centre;

e)

Soumettre le budget annuel du Centre pour approbation et rendre compte dans ce domaine;

f)

Mettre en oeuvre les décisions du Comité exécutif.

3 - L'Etat d'accueil assure la protection du Directeur et lui fournit l'assistance nécessaire.

Article 10

Officiers de liaison

1 - Les Parties affectent des officiers de liaison au Centre.

2 - Les officiers de liaison ont accès aux équipements, aux données à caractère personnel et aux banques de données du Centre.

3 - Les officiers de liaison travaillent conformément au Manuel de Procédures, conformément aux dispositions de l'article 12, b).

4 - L'Etat d'accueil assure la protection des officiers de liaison affectés au Centre et leur fournit l'assistance nécessaire.

Article 11

Personnel

1 - Avec l'accord du Comité exécutif, le Directeur du Centre peut engager du personnel pour effectuer des tâches administratives, techniques ou de maintenance au Centre.

2 - Ledit personnel ne participe pas aux opérations du Centre.

Article 12

Procédures

Le Manuel de Procédure devant être adopté par le Comité exécutif conformément à l'article 8 (3), d), inclut les éléments suivants:

a)

Les procédures opérationnelles du Centre;

b)

Les rôles et responsabilités des officiers de liaison;

c)

Les protocoles d'échange et de traitement des informations, et notamment de protection des données;

d)

Des informations complémentaires relatives aux fonctions du Comité exécutif;

e)

Les fonctions de tout comité créé dans le cadre du présent Accord;

f)

Les procédures de planification et de coordination des opérations;

g)

Les dispositions concernant la convocation aux réunions du Comité exécutif;

h)

Les dispositions budgétaires et le rapport des dépenses au Comité exécutif; et

i)

Tous autres aspects des fonctions du Centre.

Article 13

Décisions opérationnelles et tactiques

Chaque Partie est responsable des décisions opérationnelles et tactiques, qui sont prises conformément aux principes et règles du droit international, ainsi qu'aux lois et procédures nationales respectives des Parties.

Article 14

Législation applicable

Le fonctionnement journalier du Centre est soumis à la législation de l'Etat d'accueil.

Article 15

Frais

1 - Les frais afférents au budget du Centre, qui ne comprend pas les rémunérations des officiers de liaison, sont financés à parts égales par les Parties au présent Accord.

2 - La participation d'une Partie à une opération s'effectue sur la base du volontariat. Les Parties qui participent à une telle opération prennent en charge leurs propres frais.

3 - Un financement supplémentaire au profit du fonctionnement et de l'administration du Centre peut être sollicité auprès de l'Union européenne ou hors de l'Union européenne.

Article 16

Coopération avec d'autres entités

Sous réserve de la direction stratégique du Comité exécutif, le Centre peut coopérer avec d'autres entités poursuivant les mêmes objectifs en matière de répression du trafic illicite de stupéfiants par voie maritime et aérienne.

Article 17

Évaluation

Le fonctionnement du Centre doit être évalué deux ans après l'entrée en vigueur du présent Accord par un comité comprenant un représentant nommé par chacune des Parties.

CHAPITRE III

Dispositions finales

Article 18

Obligations internationales

Aucune des dispositions du présent Accord n'est considérée comme incompatible avec les obligations internationales contenues dans d'autres accords internationaux liant les Parties.

Article 19

Règlement des différends

Tous les différends résultant de l'interprétation ou de l'application du présent Accord sont réglés par voie de négociation ou par tout autre moyen de règlement convenu entre les Parties.

Article 20

Dépositaire

Le Gouvernement de la République portugaise est dépositaire du présent Accord.

Article 21

Entrée en vigueur

1 - Le présent Accord est ouvert à la signature de l'Irlande, du Royaume des Pays-Bas, du Royaume d' Espagne, de la République Italienne, de la République Portugaise, de la République Française et du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.

2 - Les Etats ayant signé le présent Accord informent le dépositaire, par écrit et par la voie diplomatique, de l'accomplissement des procédures constitutionnelles nationales nécessaires à l'expression de leur consentement à être lié au présent Accord.

3 - Le présent Accord entre en vigueur soixante jours après la date de dépôt de la troisième notification visée au paragraphe 2 du présent article.

4 - Pour les autres Etats signataires, le présent Accord entre en vigueur soixante jours après la date de dépôt de la notification visée au paragraphe 2 du présent article.

Article 22

Adhésion

1 - Après son entrée en vigueur, le présent Accord est ouvert à l'adhésion de tout Etat invité à y adhérer sur décision unanime des Parties.

2 - En ce qui concerne l'Etat adhérant, le présent Accord entre en vigueur soixante jours après la date de dépôt de son instrument d'adhésion.

Article 23

Amendements

1 - Le présent Accord peut être modifié par consentement mutuel écrit de toutes les Parties.

2 - Les amendements entrent en vigueur soixante jours après la date de dépôt d'une notification par toutes les Parties, transmise par écrit et par la voie diplomatique, concernant l'accomplissement des procédures nationales requises pour chaque Partie.

Article 24

Application provisoire

Tout Etat peut, au moment de la signature de l'Accord, déclarer qu'il appliquera les dispositions du présent Accord de manière provisoire, dans l'attente de son entrée en vigueur dans le dit Etat.

Article 25

Dénonciation et retrait

1 - Le présent Accord peut être dénoncé à tout moment par accord mutuel entre les Parties, qui conviennent d'une date à compter de laquelle les dispositions de l'Accord cessent de s'appliquer.

2 - Après que le présent Accord aura été en vigueur pendant deux ans, toute Partie pourra se retirer de celui-ci en faisant connaître son intention au dépositaire, par écrit et par la voie diplomatique. Le retrait prend effet six mois après la date de réception de la notification par le dépositaire. Le dépositaire informe les Parties de la réception de la notification.

3 - En cas de retrait d'une Partie, la Partie en question prend en charge les frais engagés jusqu'à ce que son retrait soit effectif.

4 - Le présent Accord cesse de produire des effets si le nombre des Parties est inférieur à trois.

5 - Nonobstant la dénonciation ou un retrait, toutes les informations et les données transmises en application du présent Accord continuent de bénéficier de la protection prévue par ses dispositions.

Article 26

Enregistrement

Après l'entrée en vigueur du présent Accord, le dépositaire transmet celui-ci au Secrétariat des Nations Unies en vue de son enregistrement, conformément à l'article 102 de la Charte des Nations Unies.

Fait à Lisbonne, le 30 septembre 2007, en langues anglaise, espagnole, française, italienne, néerlandaise et portugaise, tous les textes faisant également foi.

Le Parti del presente Accordo:

Considerando che l'analisi delle importazioni di droga, in particolare delle importazioni di cocaina dal Sud America verso l'Europa occidentale ha mostrato un aumento del traffico di droga via mare e per via aerea attraverso l'Atlantico verso l'Europa e la fascia costiera dell'Africa occidentale;

Preoccupate riguardo alla difficoltà di ottenere informazioni tempestive per agire in questo campo, sia a livello internazionale che europeo, cosa che crea ulteriori difficoltà nella repressione del traffico illecito di droga via mare in acque internazionali e per via aerea nello spazio aereo internazionale;

Rilevando la marcata natura internazionale di questo traffico illecito di droga che coinvolge organizzazioni criminali operanti in vari paesi, che impiegano navi con differenti immatricolazioni ed equipaggi di diverse nazionalità;

Considerando che molti paesi non hanno sufficiente sorveglianza aerea ed in mare e risorse di polizia per svolgere da soli il contrasto al traffico illecito di droga via mare, e che ci sono difficoltà tecniche e giuridiche riguardo alle interdizioni marittime;

Tenendo conto dell'iniziativa sulla cocaina nell'ambito della Pianificazione Strategica Operativa Globale per la Polizia (COSPOL) della Task Force Europea dei Capi della Polizia (PCTF);

Tenendo anche conto della Valutazione della Minaccia rappresentata dalla Criminalità Organizzata in Europa (OCTA) elaborata da Europol, che ha identificato la lotta al traffico di cocaina come priorità per le forze di polizia ed incoraggia l'approccio regionale nei confronti della lotta alla criminalità organizzata internazionale;

Tenendo in considerazione la Strategia Antidroga dell'UE 2005-2012, avallata dal Consiglio Europeo del 16 e 17 dicembre 2004;

Riaffermando le misure esistenti previste nella Convenzione Unica delle Nazioni Unite sugli Stupefacenti, adottata a New York il 30 marzo 1961, emendata dal Protocollo adottato a Ginevra il 25 marzo 1972 e dal Protocollo adottato a New York l'8 agosto 1975; la Convenzione sulle Sostanze Psicotrope, adottata a Vienna il 21 febbraio 1971; la Convenzione delle Nazioni Unite Contro il Traffico Illecito di Sostanze Stupefacenti e Psicotrope, adottata a Vienna il 20 dicembre 1988; l'Accordo del Consiglio d'Europa sul Traffico Illecito via Mare, che attua l'Articolo 17 della Convenzione delle Nazioni Unite contro il Traffico Illecito di Sostanze Stupefacenti e Psicotrope, adottato a Strasburgo il 31 gennaio del 1995; la Convenzione delle Nazioni Unite sul Diritto del Mare, adottata a Montego Bay il 10 dicembre 1982; la Convenzione Europol del 26 luglio 1995; le norme consuetudinarie del diritto marittimo internazionale; e gli altri strumenti giuridici internazionali attinenti;

Tenendo presente la cooperazione tra stati membri e non dell'UE contro il traffico di droga via mare e per via aerea nell'Oceano Atlantico e la valida attività della Task Force Congiunta Interforze (JIATF) Sud;

Lavorando insieme nell'ambito di una iniziativa regionale denominata Centro Analisi ed Operazioni Marittime- Narcotici;

Ed agendo in conformità con le rispettive leggi e procedure nazionali delle Parti;

concordano quanto segue:

CAPITOLO I

Provvedimenti generali

Articolo 1

Obiettivo

1 - Il Centro Analisi ed Operazioni Marittime-Narcotici, di qui in avanti denominato il «Centro», viene quindi creato dalle Parti conformemente al presente Accordo.

2 - Tutte le Parti saranno membri del Centro. Il Centro fornirà una base per l'impegno delle Parti nella cooperazione multilaterale nel campo della repressione del traffico illecito di droga via mare e per via aerea.

Articolo 2

Portata

1 - Le Parti coopereranno attraverso il Centro nella repressione del traffico illecito via mare e per via aerea attraverso l'Atlantico verso l'Europa e la fascia costiera dell'Africa occidentale, con la possibilità di estendere le sue operazioni, inter alia, nel bacino del Mediterraneo occidentale, di qui in avanti definito «area operativa».

2 - Le Parti, attraverso il Centro:

a)

Raccoglieranno ed analizzeranno le informazioni per contribuire a determinare i migliori risultati operativi in relazione al traffico illecito di droga via mare e per via aerea nell' area operativa;

b)

Incrementeranno l'intelligence attraverso lo scambio di informazioni tra di loro e, in modo appropriato, con Europol;

c)

Si adopereranno per accertare la disponibilità delle loro risorse che, ove possibile, sarà notificata in anticipo, al fine di agevolare le operazioni di interdizione per reprimere il traffico illecito di droga via mare e per via aerea.

Articolo 3

Status giuridico

Il Centro godrà di personalità giuridica nel territorio di ciascuna delle Parti, compresa la capacità di stipulare contratti, acquisire ed alienare proprietà mobiliari ed immobiliari.

Articolo 4

Ubicazione

Il Centro sarà ubicato a Lisbona, Portogallo, di qui in avanti denominato «Stato Ospitante».

Articolo 5

Osservatori

1 - Ciascuno Stato o Organizzazione Internazionale che condivida gli stessi obiettivi delle Parti nella repressione del traffico illecito di droga via mare e per via aerea potrà essere invitato a diventare osservatore, per decisione del Comitato Esecutivo, alle condizioni determinate dal Comitato.

2 - Lo scambio di dati personali e di altre informazioni con l'osservatore sarà regolato dall'articolo 6 e sarà limitato a ciò che è strettamente necessario per la sua cooperazione alle attività del Centro.

Articolo 6

Protezione dei Dati Personali e di Intelligence Criminale

1 - L'elaborazione e la protezione dei dati personali e di altre informazioni fornite dalle Parti saranno svolte in conformità con le leggi nazionali delle Parti, le leggi dell'UE e Internazionali vincolanti le Parti, compresa la Convenzione del Consiglio d'Europa per la Protezione degli Individui riguardo l'Elaborazione Automatica di Dati Personali adottata a Strasburgo il 28 gennaio 1981.

2 - I Dati Personali ed altre informazioni fornite dalle Parti non saranno trasmesse a paesi terzi o altre entità senza il previo consenso di chi ha fornito le informazioni e non potranno essere utilizzate per scopi diversi da quelli per cui sono state trasmesse inizialmente.

CAPITOLO 2

Organizzazione e Funzionamento del Centro

Articolo 7

Struttura

Il Centro sarà costituito da un Comitato Esecutivo, un Direttore, ufficiali di collegamento e personale.

Articolo 8

Comitato Esecutivo

1 - Il Comitato Esecutivo sarà composto da un alto funzionario di ciascuna delle Parti che non sarà un ufficiale di collegamento del Centro.

2 - Il Comitato Esecutivo si incontrerà almeno due volte l'anno.

3 - Le funzioni del Comitato esecutivo comprenderanno:

a)

Sviluppo dell'indirizzo strategico del Centro;

b)

Invito e ammissione degli osservatori compresa la determinazione delle condizioni di ammissione;

c)

Creazione dei comitati ove necessario;

d)

Adozione del Manuale delle Procedure ed approvazione di successivi emendamenti;

e)

Approvazione del budget annuale;

f)

Approvazione del rapporto annuale;

g)

Nomina del Direttore del Centro.

4 - Il Comitato Esecutivo eleggerà il presidente con incarico annuale a rotazione annuale.

5 - Tutte le decisioni del Comitato Esecutivo richiederanno il consenso unanime delle Parti.

Articolo 9

Direttore del Centro

1 - Il Direttore del Centro sarà nominato dal Comitato Esecutivo e scelto tra le Parti, per un periodo di due anni, che può essere prolungato per un ulteriore periodo non superiore ai due anni.

2 - Il Direttore avrà le seguenti funzioni:

a)

Gestione del lavoro del Centro;

b)

Rappresentanza esterna del Centro;

c)

Partecipazione alle riunioni del Comitato Esecutivo senza diritto al voto;

d)

Elaborazione del rapporto annuale sulle attività del Centro;

e)

Presentazione e resoconto del budget annuale del Centro;

f)

Attuazione delle decisioni del Comitato Esecutivo.

3 - Lo Stato Ospitante assicurerà al Direttore la protezione e l'assistenza necessaria.

Articolo 10

Ufficiali di Collegamento

1 - Le Parti designeranno gli ufficiali di collegamento presso il Centro.

2 - Gli ufficiali di collegamento avranno accesso alle attrezzature, ai dati personali ed alle banche dati del Centro.

3 - Gli ufficiali di collegamento agiranno conformemente a quanto previsto dal Manuale delle Procedure, articolo 12, b.

4 - Lo Stato Ospitante assicurerà agli ufficiali di collegamento assegnati al Centro, la protezione e l'assistenza necessaria.

Articolo 11

Personale

1 - Il Direttore del Centro può, previa approvazione del Comitato Esecutivo, assumere personale per svolgere compiti amministrativi, tecnici o di manutenzione.

2 - Suddetto personale non prenderà parte alle funzioni di carattere operativo del Centro.

Articolo 12

Procedure

Il Manuale delle Procedure che dovrà adottare il Comitato Esecutivo in base all'articolo 8 (3) d) comprenderà:

a)

Procedure operative del Centro;

b)

Ruoli e responsabilità degli ufficiali di collegamento;

c)

Protocolli per l'elaborazione e lo scambio di informazioni, ivi compresa la loro protezione;

d)

Informazioni aggiuntive sulle funzioni del Comitato Esecutivo;

e)

Funzioni di ogni Comitato, istituito in base al presente Accordo;

f)

Procedure per la pianificazione ed il coordinamento delle operazioni;

g)

Modalità di notifica delle riunioni del Comitato Esecutivo;

h)

Disposizioni di bilancio e resoconto delle spese al Comitato Esecutivo;

i)

Ulteriori aspetti relativi alle funzioni del Centro.

Articolo 13

Decisioni operative e tattiche

La responsabilità per le decisioni tattiche e operative dipende da ciascuna delle Parti, ed ognuna di queste decisioni sarà conforme ai principi e alle norme del diritto internazionale, nonché alle rispettive normative e procedure di ciascun paese.

Articolo 14

Norme applicabili

Il funzionamento ordinario del Centro sarà soggetto alla normativa dello Stato Ospitante.

Articolo 15

Costi

1 - Le spese di bilancio relative al Centro, esclusi i costi degli ufficiali di collegamento, saranno finanziate e sostenute in egual misura dalle Parti del presente Accordo.

2 - La partecipazione delle Parti ad una qualsiasi operazione sarà volontaria. L'onere delle spese per tali operazioni sarà a carico delle Parti che vi parteciperanno.

3 - Ulteriori finanziamenti per le spese operative e di amministrazione del Centro potranno essere ricercati presso fonti in ambito UE o altrove.

Articolo 16

Cooperazione con altre entità

Subordinatamente all'orientamento strategico del Comitato Esecutivo, il Centro può cooperare con altre entità che condividono gli stessi obiettivi nella lotta al traffico di droga via mare ed aerea.

Articolo 17

Valutazione

Il funzionamento del Centro sarà valutato due anni dopo l'entrata in vigore del presente Accordo da un comitato costituito da un rappresentante designato da ciascuna delle Parti.

CAPITOLO III

Disposizioni Finali

Articolo 18

Obblighi Internazionali

Nessuno degli elementi di cui al presente Accordo sarà considerato incompatibile con gli obblighi internazionali contenuti in altri accordi internazionali che vincolano le Parti.

Articolo 19

Risoluzione delle controversie

Tutte le controversie derivanti dall'interpretazione o attuazione del presente Accordo saranno risolte mediante negoziazione o altri sistemi di risoluzione concordati dalle Parti.

Articolo 20

Depositario

Il Governo della Repubblica del Portogallo sarà il depositario del presente Accordo.

Articolo 21

Entrata in vigore

1 - Questo Accordo sarà aperto alla firma di: Irlanda, Regno dei Paesi Bassi, Regno di Spagna, Repubblica Italiana, Repubblica del Portogallo, Repubblica Francese, Regno Unito della Gran Bretagna ed Irlanda del Nord.

2 - Gli Stati firmatari del presente Accordo notificheranno al depositario per iscritto e attraverso i canali diplomatici, l'adempimento dei rispettivi requisiti costituzionali per esprimere il proprio consenso alla firma del presente Accordo.

3 - Il presente Accordo entrerà in vigore sessanta giorni dopo la data del deposito della terza notifica di cui al paragrafo 2 del presente articolo.

4 - Per gli altri Stati firmatari, il presente Accordo entrerà in vigore sessanta giorni dopo la data del deposito della notifica di cui al paragrafo 2 del presente articolo.

Articolo 22

Accesso

1 - Successivamente all'entrata in vigore, il presente Accordo sarà aperto all'accesso degli Stati invitati a farne parte, previo unanime consenso delle Parti.

2 - Il presente Accordo entrerà in vigore per lo Stato aderente, sessanta giorni dopo la data di deposito del rispettivo strumento di accesso.

Articolo 23

Emendamenti

1 - Il presente Accordo è suscettibile di emendamento attraverso il reciproco consenso scritto di tutte le Parti.

2 - Gli emendamenti entreranno in vigore sessanta giorni dopo che tutte le Parti avranno depositato la notifica, per iscritto e attraverso canali diplomatici, dell'adempimento dei requisiti nazionali di ciascuna Parte.

Articolo 24

Applicazione provvisoria

In occasione della firma dell'Accordo, ogni Stato può dichiarare che applicherà i termini del presente Accordo in via provvisoria, in attesa della sua entrata in vigore in quello Stato.

Articolo 25

Estinzione e recesso

1 - Il presente Accordo potrà cessare in qualsiasi momento, previo mutuo consenso delle Parti che si accorderanno sulla data a partire dalla quale le clausole dell'Accordo stesso non saranno più in vigore.

2 - Trascorsi due anni dall'entrata in vigore del presente Accordo, ciascuna Parte può recedere dall'Accordo stesso tramite notifica al Depositario, per iscritto e attraverso i canali diplomatici. Il recesso avrà effetto sei mesi dopo la ricezione di tale notifica da parte del Depositario. Il Depositario informerà le Parti dell'avvenuta ricezione di tale notifica.

3 - In caso di recesso di una delle Parti, quest'ultima dovrà sostenere la propria quota parte dei costi sostenuti fino a quando il recesso avrà effetto.

4 - L'Accordo cesserà di essere in vigore allorquando il numero delle Parti diventerà inferiore a tre.

5 - Nonostante l'estinzione o il recesso, tutte le informazioni e i dati trasferiti in seguito al presente Accordo continueranno ad essere protetti in forza delle disposizioni qui di seguito riportate.

Articolo 26

Registrazione

Successivamente all'entrata in vigore dell'Accordo, il Depositario lo invierà al Segretariato delle Nazioni Unite per la registrazione, in conformità con l'Articolo 102 della Carta delle Nazioni Unite.

Fatto a Lisbona il 30 Settembre 2007, in lingua olandese, inglese, francese, italiana, portoghese e spagnola, i testi facenti tutti ugualmente fede.

ACORDO ENTRE A IRLANDA, O REINO DOS PAÍSES BAIXOS, O REINO DE ESPANHA, A REPÚBLICA ITALIANA, A REPÚBLICA PORTUGUESA, A REPÚBLICA FRANCESA E O REINO UNIDO DA GRÃ-BRETANHA E DA IRLANDA DO NORTE QUE ESTABELECE UM CENTRO DE ANÁLISE E OPERAÇÕES MARÍTIMAS - NARCÓTICOS.

As Partes no presente Acordo:

Considerando que a análise das importações de estupefacientes, em particular as importações de cocaína provenientes da América do Sul para a Europa Ocidental, revelam um aumento no tráfico ilícito de estupefacientes por mar e por ar através do Atlântico para a Europa e para a costa marítima da África Ocidental;

Preocupados com a dificuldade em obter informação atempada para acções neste campo, quer a nível internacional como europeu, o que cria dificuldades adicionais na supressão do tráfico ilícito de estupefacientes por mar em águas internacionais e por ar no espaço aéreo internacional;

Observando a acentuada natureza internacional deste tráfico ilícito de estupefacientes que envolve organizações criminosas a operar em vários países, utilizando barcos com diferentes registos e tripulações de diferentes nacionalidades;

Considerando que muitos países não possuem meios de vigilância aérea e marítima suficientes, assim como meios para a aplicação do direito de modo a empreenderem de forma autónoma a interdição do tráfico ilícito de estupefacientes por mar, bem como as dificuldades técnicas e jurídicas associadas às interdições marítimas;

Considerando o Planeamento Estratégico Operacional Global para a Polícia (PEOG COSPOL), iniciativa relativa à cocaína;

Tendo ainda em consideração a Avaliação Europeia da Ameaça do Crime Organizado (ACOE) pela EUROPOL, que identificou a luta contra o tráfico de cocaína como uma prioridade para a aplicação do direito e incentiva a abordagem regional na luta contra o crime organizado internacional;

Considerando a Estratégia da União Europeia de Luta contra a Droga 2005-2012, adoptada pelo Conselho Europeu de 16 e 17 de Dezembro de 2004;

Reafirmando as medidas previstas na Convenção Única das Nações Unidas sobre Drogas Narcóticas, adoptada em Nova Iorque em 30 de Março de 1961, conforme alterada pelo Protocolo adoptado em Genebra em 25 de Março de 1972 e o Protocolo adoptado em Nova Iorque em 8 de Agosto de 1975; na Convenção sobre as Substâncias Psicotrópicas, adoptada em Viena em 21 de Fevereiro de 1971; na Convenção das Nações Unidas sobre o Tráfico Ilícito de Drogas Narcóticas e Substâncias Psicotrópicas, adoptada em Viena em 20 de Dezembro de 1988; no Acordo do Conselho da Europa Relativo ao Tráfico Ilícito por Mar, que implementa o artigo 17.º da Convenção das Nações Unidas contra o Tráfico Ilícito de Drogas Narcóticas e Substâncias Psicotrópicas de 1988, adoptado em Estrasburgo em 31 de Janeiro de 1995; na Convenção das Nações Unidas sobre o Direito do Mar, adoptada em Montego Bay em 10 de Dezembro de 1982; na Convenção da Europol de 26 de Julho de 1995; as normas consuetudinárias do direito Internacional do mar e outros instrumentos jurídicos internacionais relevantes;

Considerando a cooperação entre os Estados membros da União Europeia e os Estados não membros contra o tráfico de estupefacientes por mar e por ar no oceano Atlântico e a valiosa acção da Joint Interagency Task Force (JIATF) South;

Trabalhando em conjunto numa iniciativa regional designada por Centro de Análises e Operações Marítimas - Narcóticos; e

Agindo em conformidade com as respectivas legislações e procedimentos nacionais das Partes;

acordam no seguinte:

CAPÍTULO I — Disposições gerais

Artigo 1.º — Objecto

1 - As Partes estabelecem, em conformidade com o presente Acordo, o Centro de Análise e Operações Marítimas - Narcóticos, doravante referido como o «Centro».

2 - Todas as Partes são membros do Centro. O Centro fornece uma base para o compromisso das Partes na cooperação multilateral no domínio da supressão do tráfico ilícito de estupefacientes por mar e por ar.

Artigo 2.º — Âmbito

1 - As Partes cooperarão através do Centro para a supressão do tráfico ilícito de estupefacientes por mar e por ar através do Atlântico com destino à Europa e costa marítima da África Ocidental, com a possibilidade de alargar as suas operações, inter alia, à bacia do Mediterrâneo Ocidental, doravante referida como «área operacional».

2 - As Partes, através do Centro, deverão:

a)

Recolher e analisar a informação para auxiliar na determinação dos melhores resultados operacionais relativamente ao tráfico ilícito de estupefacientes por mar e por ar na área operacional;

b)

Dinamizar a produção de informações através da troca recíproca de informação e, de forma apropriada, com a EUROPOL;

c)

Aferir a disponibilidade dos seus meios, os quais, sempre que possível, serão notificados com antecedência de modo a facilitar as operações de interdição para suprimir o tráfico ilícito de estupefacientes por mar e por ar.

Artigo 3.º — Estatuto jurídico

O Centro goza de personalidade jurídica no território de cada uma das Partes, incluindo capacidade de contratar, adquirir e dispor de património móvel e imóvel.

Artigo 4.º — Localização

O Centro situa-se em Lisboa, Portugal, doravante referido como «Estado anfitrião».

Artigo 5.º — Observadores

1 - Qualquer Estado ou organização internacional que partilhe os mesmos objectivos que as Partes na supressão do tráfico ilícito de estupefacientes por mar ou por ar pode ser convidado a tornar-se um observador, mediante decisão do conselho executivo e de acordo com as condições determinadas por este órgão.

2 - A troca de dados pessoais e de informação de outra natureza com o observador será regulada pelo artigo 6.º e será limitada ao estritamente necessário à sua cooperação na actividade do Centro.

Artigo 6.º — Protecção de dados pessoais e de outra informação fornecida pelas Partes

1 - O processamento e protecção de dados pessoais e informação de outra natureza disponibilizados pelas Partes deverão ser efectuados em conformidade com a legislação nacional das Partes, com o direito da União Europeia e com o direito internacional aos quais as Partes estão vinculadas, incluindo a Convenção do Conselho da Europa para a Protecção do Indivíduo em Matéria de Processamento Automático de Dados Pessoais, adoptada em Estrasburgo em 28 de Janeiro de 1981.

2 - Os dados pessoais e informação de outra natureza disponibilizados pelas Partes não serão transmitidos a Estados terceiros ou a qualquer outra entidade sem o prévio consentimento da Parte que disponibiliza a informação e não poderão ser usados para outros fins senão aqueles para os quais foram inicialmente transmitidos.

CAPÍTULO II — Organização e funcionamento do Centro

Artigo 7.º — Estrutura

O Centro é composto por um conselho executivo, um director, oficiais de ligação e pessoal.

Artigo 8.º — Conselho executivo

1 - O conselho executivo é composto por um representante de alto nível de cada Parte, o qual não poderá ser um oficial de ligação ao Centro.

2 - O conselho executivo reúne-se pelo menos duas vezes por ano.

3 - As funções desempenhadas pelo conselho executivo incluem:

a)

Planificação da direcção estratégica do Centro;

b)

Convite e admissão de observadores, incluindo a determinação das condições de admissão;

c)

Estabelecimento de comissões, consoante necessário;

d)

Adopção do manual de procedimentos e aprovação de quaisquer alterações subsequentes;

e)

Aprovação do orçamento anual;

f)

Aprovação do relatório anual;

g)

Nomeação do director do Centro.

4 - O conselho executivo elegerá o seu presidente para um mandato de um ano, a ser alternado anualmente.

5 - Todas as decisões do conselho executivo serão tomadas por acordo unânime das Partes.

Artigo 9.º — Director do Centro

1 - O director do Centro será nomeado pelo conselho executivo, de entre as Partes, para um mandato de dois anos, extensível a um mandato adicional, que não excederá dois anos.

2 - O director tem as seguintes funções:

a)

Gerir o trabalho do Centro;

b)

Representar o Centro a nível externo;

c)

Participar nas reuniões do conselho executivo, sem direito de voto;

d)

Elaborar o relatório anual especificando as actividades do Centro;

e)

Submeter o orçamento anual do Centro e zelar pela sua execução;

f)

Implementar decisões do conselho executivo.

3 - O Estado anfitrião deverá garantir a protecção e a assistência necessárias ao director.

Artigo 10.º — Oficiais de ligação

1 - As Partes nomearão oficiais de ligação ao Centro.

2 - Os oficiais de ligação terão acesso ao equipamento, dados pessoais e bases de dados do Centro.

3 - Os oficiais de ligação trabalharão em conformidade com o manual de procedimentos, nos termos do artigo 12.º, alínea b).

4 - O Estado anfitrião garantirá a protecção e a assistência necessárias aos oficiais de ligação nomeados para o Centro.

Artigo 11.º — Pessoal

1 - O director do Centro poderá, com o consentimento do conselho executivo, contratar pessoal para desempenhar, no Centro, funções de natureza administrativa, técnica ou de manutenção.

2 - Esse pessoal não intervirá nas funções operacionais do Centro.

Artigo 12.º — Procedimentos

O manual de procedimentos a ser adoptado pelo conselho executivo nos termos do artigo 8.º, n.º 3, alínea d), incluirá:

a)

Procedimentos operacionais do Centro;

b)

Funções e responsabilidades dos oficiais de ligação;

c)

Protocolos para troca e processamento de informação, incluindo a sua protecção;

d)

Informação adicional sobre as funções do conselho executivo;

e)

Funções de cada uma das comissões estabelecidas ao abrigo do presente Acordo;

f)

Procedimentos para o planeamento e a coordenação de operações;

g)

Convocatórias para as reuniões do conselho executivo;

h)

Ajuste orçamental e apresentação das despesas ao conselho executivo; e

i)

Quaisquer outros aspectos relativos às funções do Centro.

Artigo 13.º — Decisões operacionais e tácticas

A responsabilidade pelas decisões operacionais e tácticas pertence a cada Parte e cada uma dessas decisões deverá observar os princípios e normas de direito internacional, bem como as respectivas legislações e procedimentos nacionais.

Artigo 14.º — Lei aplicável

O funcionamento diário do Centro está sujeito ao direito do Estado anfitrião.

Artigo 15.º — Despesas

1 - As despesas relacionadas com o orçamento do Centro, excluindo as despesas com os oficiais de ligação, serão financiadas e suportadas de forma igual pelas Partes no presente Acordo.

2 - A participação de uma das Partes em qualquer operação será voluntária. As Partes participantes em tal operação suportarão as suas próprias despesas.

3 - Poderá ser obtido financiamento adicional para o funcionamento e gestão do Centro junto da União Europeia ou de quaisquer outras entidades.

Artigo 16.º — Cooperação com outras entidades

O Centro, sob a orientação estratégica do conselho executivo, pode cooperar com outras entidades que partilhem os seus objectivos relativos à supressão do tráfico ilícito de estupefacientes por mar e por ar.

Artigo 17.º — Avaliação

Decorridos dois anos após a entrada em vigor do presente Acordo, o funcionamento do Centro será objecto de avaliação por uma comissão composta por um representante nomeado por cada uma das Partes.

CAPÍTULO III — Disposições finais

Artigo 18.º — Obrigações internacionais

Nada no presente Acordo deverá ser considerado como incompatível com quaisquer obrigações internacionais existentes que constem de outros acordos internacionais que vinculem as Partes.

Artigo 19.º — Solução de controvérsias

Qualquer controvérsia resultante da interpretação ou da aplicação do presente Acordo será solucionada através de negociação ou por qualquer outro meio de resolução acordado pelas Partes.
