Nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o Governo decreta o seguinte:
Artigo único. São aprovadas, para adesão, as emendas ao Protocolo de 1978 relativo à Convenção Internacional para a Salvaguarda da Vida Humana no Mar, de 1974, adoptadas em 10 de Novembro de 1988, cuja versão autêntica em língua inglesa e a respectiva tradução em língua portuguesa seguem em anexo ao presente decreto.
Visto e aprovado em Conselho de Ministros de 2 de Julho de 1992. - Aníbal António Cavaco Silva - Joaquim Fernando Nogueira - Duarte Ivo Cruz - Eduardo Eugénio Castro de Azevedo Soares.

RESOLUTION OF THE CONFERENCE OF PARTIES TO THE PROTOCOL OF 1978 RELATING TO THE INTERNATIONAL CONVENTION FOR THE SAFETY OF LIFE AT SEA, 1974, ON THE GLOBAL MARITIME DISTRESS AND SAFETY SYSTEM, ADOPTED ON 10 NOVEMBER 1988.
Adoption of amendments to the Protocol of 1978 relating to the International Convention for the Safety of Life at Sea, 1974, concerning radiocommunications for the global maritime distress and safety system.
The Conference:
Noting article VIII, c), of the International Convention for the Safety of Life at Sea, 1974 (hereinafter referred to as «the Convention») and article II, paragraph 1, of the Protocol of 1978 relating to the Convention (hereafter referred to as «the 1978 Protocol») concerning the procedure for amending the 1978 Protocol by a Conference of Contracting Parties;
Having considered amendments to the Convention concerning radiocommunications for the global maritime distress and safety system, proposed and circulated to the Members of the Organization and all Contracting Governments to the Convention:
1 - Adopts, in accordance with article VIII, c), ii), of the Convention, amendments to the annex to the 1978 Protocol, the text of which is given in the annex to the present resolution.
2 - Decides in accordance with article VIII, c), iii), of the Convention that the amendments shall be deemed to have been accepted and shall enter into force in accordance with the following procedures:
The amendments shall be deemed to have been accepted on 1 February 1990, unless by that date one third of the Parties to the 1978 Protocol, or the Parties the combined merchant fleets of which constitute not less than 50% of the gross tonnage of the world's merchant fleet, notify the Secretary-General of the Organization that they object to the amendments;
The amendments which are deemed to have been accepted in accordance with paragraph a) shall enter into force with respect to all Parties to the 1978 Protocol except those which have objected to the amendments under paragraph a) and which have not withdrawn such objections on or before 1 February 1992;
Notwithstanding paragraphs a) and b), the amendments shall not enter into force if the amendments to the Convention adopted by the Conference of Contracting Governments to the International Convention for the Safety of Life at Sea, 1974, on the Global Maritime Distress and Safety System by resolution 1 are deemed not to have been accepted in accordance with article VIII, b), vi), 2), of the Convention.

Regulation 8
Survey of life-saving appliances and other equipment of cargo ships
In paragraph a) the existing words «The life-saving appliances, except a radiotelegraph installation in a motor lifeboat or a portable radio apparatus, for survival craft, the echo-sounding device, the gyro-compass, the fire extinguishing appliances and the inert gas system of cargo ships» are replaced by «The life-saving appliances and arrangements (except radio installations), the shipborne navigational equipment, the fire safety systems and appliances and the inert gas system of cargo ships of 500 t gross tonnage and upwards».
Regulation 10
Surveys of hull, machinery and equipment of cargo ships
In paragraph a) the existing words «cargo ship safety radiotelegraphy certificates or cargo ship safety radiotelephony certificates» are replaced by «or cargo ship safety radio certificates».
Regulation 14
Duration and validity of certificates
In paragraph c) the existing words «cargo ship safety radiotelegraphy certificate or a cargo ship safety radiotelephony certificate» are replaced by «cargo ship safety radio certificate».
APPENDIX
The existing form of the Cargo Ship Safety Construction Certificate in the appendix to the 1974 SOLAS Convention and the existing form of supplement to the Cargo Ship Safety Construction Certificate in the appendix to the 1978 SOLAS Protocol are replaced by the following:

2.2 - The life-saving appliances an the equipment of the lifeboats, liferafts and rescue boats were provided in accordance with the requirements of the Convention;
2.3 - The ship was provided with a line-throwing appliance and radio installations used in life-saving appliances in accordance with the requirements of the Convention;
2.4 - The ship complied with the requirements of the Convention as regards shipborne navigational equipment, means of embarkation for pilots and nautical publications;
2.5 - The ship was provided with lights, shapes and means of making sound signals and distress signals, in accordance with the requirements of the Convention and the International Regulations for Preventing Collisions at Sea in force;
2.6 - In all other respects the ship complied with the relevant requirements of the Convention.
3 - That the ship operates in accordance with regulation III/26.1.1.1 within the limits of the trade area ...

RESOLUÇÃO DA CONFERÊNCIA DAS PARTES DO PROTOCOLO DE 1978 RELATIVO À CONVENÇÃO INTERNACIONAL PARA A SALVAGUARDA DA VIDA HUMANA NO MAR, 1974, SOBRE O SISTEMA MUNDIAL DE SOCORRO E DE SEGURANÇA MARÍTIMA, ADOPTADA EM 10 DE NOVEMBRO DE 1988.
Adopção das emendas ao Protocolo de 1978 relativo à Convenção Internacional para a Salvaguarda da Vida Humana no Mar, 1974, relativas às radiocomunicações para o sistema mundial de socorro e de segurança marítima.
A Conferência:
Notando o artigo VIII, c), da Convenção Internacional para a Salvaguarda da Vida Humana no Mar (daqui em diante designada por «a Convenção») e o artigo II, parágrafo 1, do Protocolo de 1978 relativo à Convenção (daqui em diante designado por «o Protocolo SOLAS de 1978») respeitante aos procedimentos pare emendar o Protocolo SOLAS de 1978 pela Conferência das Partes Contratantes;
Tendo considerado as emendas à Convenção respeitantes às radiocomunicações para o sistema mundial de socorro e de segurança marítima, propostas e feitas circular por todos os membros da Organização e todos os Governos contratantes da Convenção:
1 - Adopta, de acordo com o artigo VIII, c), ii), da Convenção, as emendas ao anexo ao Protocolo SOLAS de 1978, cujo texto se encontra em anexo à presente resolução.
2 - Decide, nos termos do artigo VIII, c), iii), da Convenção, que as emendas serão consideradas aceites e entrarão em vigor de acordo com os seguintes procedimentos:
As emendas serão consideradas aceites em 1 de Fevereiro de 1990, a menos que, até esta data, um terço das partes do Protocolo SOLAS de 1978 ou as Partes cujas frotas mercantes em conjunto representem pelo menos 50% da tonelagem bruta da frota mercante mundial notifiquem o Secretário-Geral que recusam as emendas;
As emendas que tenham sido consideradas aceites, em conformidade com o parágrafo a) entrarão em vigor em 1 de Fevereiro de 1992 para todas as Partes do Protocolo SOLAS de 1978, excepto para os que tenham objectado estas as emendas de acordo com o parágrafo a) e que não tenham retirado tais objecções;
Não obstante os parágrafos a) e b), as emendas não entrarão em vigor se as emendas à Convenção adoptadas pela resolução 1 da Conferência dos Governos Contratantes da Convenção Internacional para a Salvaguarda da Vida Humana no Mar, 1974, relativas ao Sistema Mundial de Socorro e de Segurança Marítima, não forem consideradas aceites de acordo com o artigo VIII, b), vi), 2), da Convenção.

Regra 8
Vistoria aos meios de salvação e outro equipamento de navios de carga
No parágrafo a) substituir as palavras «com excepção das instalações radiotelegráficas das embarcações salva-vidas com motor ou dos equipamentos portáteis de radiocomunicações das embarcações e jangadas salva-vidas, os meios de salvação, a sonda acústica, a girobússola, as instalações de extinção de incêndios e de gás inerte dos navios de carga» pelas palavras «os dispositivos e os meios de salvação (excepção feita às instalações radioeléctricos), o equipamento de navegação do navio, os sistemas e as instalações de prevenção, de detecção e de combate a incêndios e o sistema de gás inerte dos navios de carga de uma arqueação bruta igual ou superior a 500 t».
Regra 10
Vistoria ao casco, máquina e equipamento de navios de carga
No parágrafo a) substituir as palavras «um certificado de segurança da radiotelegrafia para navio de carga ou um certificado de segurança radiotelefónica para navio de carga» por «um certificado de segurança radioelétrica para navio de carga».
Regra 14
Duração e validade dos certificados
No parágrafo c) substituir as palavras «um certificado de segurança radiotelegráfica para navio de carga ou um certificado de segurança radiotelefónica para navio de carga» por «um certificado de Segurança radioeléctrica para navio de carga».
