de 21 de Agosto
Usando da faculdade conferida pela 2.ª parte do n.º 2.º do artigo 109.º da Constituição, o Governo decreta o seguinte:
Artigo único. É aprovada para ratificação a Convenção Relativa ao Comércio do Trigo, aberta à assinatura em Washington de 29 de Março a 3 de Maio de 1971, cujo texto em inglês e o do preâmbulo do Acordo Internacional do Trigo de 1971, de que a Convenção faz parte, bem como as respectivas traduções para português, vão anexos ao presente decreto.

INTERNATIONAL WHEAT AGREEMENT, 1971
PREAMBLE
The United Nations Wheat Conference, 1971,
Considering that the International Wheat Agreement of 1949 was revised, renewed or extended in 1953, 1956, 1959, 1962, 1965, 1966 and 1967,
Considering that the provisions of the International Grains Arrangement, 1967, consisting of the Wheat Trade Convention, on the one hand, and the Food Aid Convention, on the other, will expire on 30 June 1971 and that it is desirable to conclude an Agreement for a new period,
Has agreed that this International Wheat Agreement, 1971, shall consist of two separate legal instruments:
The Wheat Trade Convention, 1971; and
The Food Aid Convention, 1971;
and that either the Wheat Trade Convention, 1971, or both the Wheat Trade Convention, 1971, and the Food Aid Convention, 1971, as appropriate, shall be submitted for signature, ratification, acceptance or approval, in conformity with their respective constitutional procedures, by the Governments represented at the United Nations Wheat Conference, 1971, and by the Governments of States party to the Wheat Trade Convention of the International Grains Arrangement, 1967.
WHEAT TRADE CONVENTION, 1971
PART I
General
ARTICLE 1
Objectives
The objectives of this Convention are:
To further international co-operation in connection with world wheat problems, recognizing the relationship of the trade in wheat to the economic stability of markets for other agricultural products;
To promote the expansion of the international trade in wheat and wheat flour and to secure the freest possible flow of this trade in the interests of both exporting and importing members, and thus contribute to the development of countries, the economies of which depende on commercial sales of wheat;
To contribute to the fullest extent possible to the stability of the international wheat market in the interests of both importing and exporting members; and
To provide a framework, in conformity with article 21 of the present Convention, for the negotiation of provisions relating to the prices of wheat and to the rights and obligations of members in respect of international trade in wheat.
ARTICLE 2
Definitions
For the purposes of this Convention:
1) - a) «Council» means the International Wheat Council established by the International Wheat Agreement, 1949, and continued in being by article 10;
«Member» means a party to this Convention or a territory or a group of territories in respect of which a notification has been made pursuant to paragraph 3) of article 28;
«Exporting member» means a member listed in Annex A;
«Importing member» means a member listed in Annex B;
«Territory» in relation to an exporting or importing member includes any territory in respect of which the rights and obligations of that member under this Convention apply under article 28;
«Executive Committee» means the Committee established under article 15;
«Advisory Sub-Committee on Market Conditions» means the Sub-Committee established under article 16;
«Grains» means wheat, rye, barley, oats, maize and sorghum;
«Wheat» includes wheat grain of any description, class, type, grade or quality and, except where the context otherwise requires, wheat flour;
«Crop year» means the period from 1 July to 30 June;
«Bushel» means in the case of wheat sixty pounds avoirdupois or 27.2155 kilogrammes;
«Metric ton», Or 1,000 kilogrammes, means in the case of wheat 36.74371 bushels;
- i) «Purchase» means a purchase for import of wheat exported or to be exported from an exporting member or from other than an exporting member, as the case may be, or the quantity of such wheat so purchased, as the context requires;
ii) «Sale» means a sale for export of wheat imported or to be imported by an importing member or by other than an importing member, as the case may be, or the quantity of such wheat so sold, as the context requires;
iii) Where reference is made in this Convention to a purchase or sale, it shall be understood to refer not only to purchases o sales concluded between the Governments concerned, but also to purchases or sales concluded between private traders and to purchases or sales concluded between e private trader and the Government concerned. In this definition «Government» shall be deemed to include the Government of any territory in respect of which the rigths and obligations of any Government ratifying, accepting, approving or acceding to this Convention apply under article 28;
Any reference in this Convention to a «Government represented at the United Nations Wheat Conference, 1971» shall be construed as including a reference to the European Economic Community (hereinafter referred to as the E. E. C.). Accordingly, any reference in this Convention to «signature» or to the «deposit of instruments of ratification, acceptance or approval» or «an instrument of accession» or a «declaration of provisional application» by a Government shall, in the case of the E. E. C., be construed as including signature or declaration of provisional application on behalf of the E. E. C. by its competent authority and the deposit of the instrument required by the institutional procedures of the E. E. C. to be deposited for the conclusion of an international agreement.
2) All calculations of the wheat equivalent of purchases of wheat flour shall be made on the basis of the rate of extraction indicated by the contract between the buyer and the seller. If no such rate is indicated, seventy-two units by weight of wheat flour shall, for the purpose of such calculations, be deemed to be equivalent to one hundred units by weight of wheat grain unless the Council decides otherwise.
ARTICLE 3
Commercial purchases and special transactions
1) A commercial purchase for the purposes of this Convention is a purchase as defined in article 2 which conforms to the usual commercial practices in international trade and which does not include those transactions referred to in paragraph 2) of this article.
2) A special transaction for the purposes of this Convention is one which includes features introduced by the Government of a member concerned which do not conform to usual commercial practices. Special transactions include the following:
Sales on credit in which, as a result of government intervention, the interest rate, period of payment, or other related terms do not conform to the commercial rates, periods or terms prevailing in the world market;
Sales in which the funds for the purchase of wheat are obtained under a loan from the Government of the exporting member tied to the purchase of wheat;
Sales for currency of the importing member which is not transferable or convertible into currency or goods for use in the exporting member;
Sales under trade agreements with special payments arrangements which include clearing accounts for settling credit balances bilaterally through the exchange of goods, except where the exporting member and the importing member concerned agree that the sale shall be regarded as commercial;
Barter transactions:
Which result from the intervention of governments where wheat is exchanged at other than prevailing world prices, or
ii) Which involve sponsorship under a government purchase programme, except where the purchase of which results from a barter transaction in which the country of final destination was not named in the original barter contract;
A gift of wheat or a purchase of wheat out of a monetary grant by the exporting member made for that specific purpose;
Any other categories of transactions, as the Council may prescribe, that include features introduced by the Government of a member concerned which do not conform to usual commercial practices.
3) Any question raised by the Executive Secretary or by an exporting or importing member as to whether a transaction is a commercial purchase as defined in paragraph 1) of this article or a special transaction as defined in paragraph 2) of this article shall be decided by the Council.
ARTICLE 4
Recording and reporting
1) The Council shall keep separate records for each crop year:
For the purposes of the operation of this Convention, of all commercial purchases by members from other members and non-members and of all imports by members from other members and non-members on terms which render them special transactions; and
Of all commercial sales by members to non-members and of all exports by members to non-members on terms which render them special transactions.
2) The records referred to in the preceding paragraph shall be kept so that records of special transactions are separate from records of commercial transactions.
3) In order to facilitate the operation of the Advisory Sub-Committee on Market Conditions under article 16, the Council shall keep records of international market prices for wheat and wheat flour and of transportation costs.
4) In the case of any wheat which reaches the country of final destination after re-sale in, passage through, or trans-shipment from the ports of, a country other than that in which the wheat originated, members shall to the maximum extent possible make available such information as will enable the purchase or transaction to be entered in the records referred to in paragraphs 1) and 2) of this article as a purchase or transaction between the country of origin and the country of final destination. In the case of a re-sale, the provisions of this paragraph shall apply if the wheat originated in the country of origin during the same crop year.
5) The Council may authorize purchases to be recorded for a crop year if:
The loading period involved is within a reasonable time up to one month, to be decided by the Council, before the beginning or after the end of that crop year; and
The two members concerned so agree.
6) For the purpose of this article:
Members shall send to the Executive Secretary such information concerning the quantities of wheat involved in commercial sales and purchases and special transactions as the Council within its competence may require, including:
In relation to special transactions, such detail of the transactions as will enable them to be classified in accordance with article 3;
ii) In respect of wheat, such information as may be available as to the type, class, grade and quality, and the quantities relating thereto;
iii) In respect of flour, such information as may be available to identify the quality of the flour and the quantities relating to each separate quality;
Members when exporting on a regular basis, and such other members as the Council shall decide, shall send to the Executive Secretary such information relating to prices of commercial and, where available, special transactions in such descriptions, classes, types, grades and qualities of wheat and wheat flour as the Council may require;
The Council shall obtain regular information on currently prevailing transportation costs, and members shall to the extent practicable report such supplementary information as the Council may require.
7) The Council shall make rules of procedure for the reports and records referred to in this article. Those rules shall prescribe the frequency and the manner in which those reports shall be made and shall prescribe the duties of members with regard thereto. The Council shall also make provision for the amendment of any records or statements kept by it, including provision for the settlement of any dispute arising in connection therewith. If any member repeatedly and unreasonably fails to make reports as required by this article, the Executive Committee shall arrange consultations with that member to remedy the situation.
ARTICLE 5
Estimates of requirements and availability of wheat
1) By 1 October in the case of Northern Hemisphere countries and 1 February in the case of Southern Hemisphere countries, each importing member shall notify the Council of its estimate of its commercial import requirements of wheat in that crop year. Any importing member may thereafter notify the Council of any changes it may desire to make in its estimate.
2) By 1 October in the case of Northern Hemisphere countries and 1 February in the case of Southern Hemisphere countries, each exporting member shall notify the Council of its estimate of the wheat it will have available for export in that crop year. Any exporting member may thereafter notify the Council of any changes it may desire to make in its estimate.
3) All estimates notified to the Council shall be used for the purpose of the administration of this Convention and may only be made available to exporting and importing members on such conditions as the Council may prescribe. Estimates submitted in accordance with this article shall in no way be binding.
ARTICLE 6
Consultations on market conditions
1) If the Advisory Sub-Committee on Market Conditions, in the course of its continuous review of the market under paragraph 2) of article 16, is of the opinion that a situation of market instability has arisen or threatens imminently to arise, or if such a situation is called to the Advisory Sub-Committee's attention by the Executive Secretary on his own initiative or at the request of any exporting or importing member it shall immediately report the facts concerned to the Executive Committee. The Advisory Sub-Committee shall in so informing the Executive Committee give particular regard to those circumstances which have brought about, or threaten to bring about, the situation of market instability, including price fluctuations. The Executive Committee shall meet within five market days to review the situation and to consider whether it would be possible to arrive at mutually acceptable solutions.
2) The Executive Committee shall, if it considers it appropriate, inform the Chairman of the Council who may convene a session of the Council to review the situation.
ARTICLE 7
Disputes and complaints
1) Any dispute concerning the interpretation or application of this Convention which is not settled by negotiation shall, at the request of any member which is a party to the dispute, be referred to the Council for decision.
2) Any member which considers that its interests as a party to this Convention have been seriously prejudiced by action of any one or more members affecting the operation of this Convention may bring the matter before the Council. In such a case, the Council shall immediately consult with the members concerned in order to resolve the matter. If the matter is not resolved through such consultations, the Council shall consider the matter further and may make recommendations to the members concerned.
ARTICLE 8
Annual review of the world wheat situation
1) - a) In the furtherance of the objectives of this Convention as set forth in article 1, the Council shall annually review the world wheat situation and shall inform members of the effects upon the international trade in wheat of the facts which emerge from the review, in order that these effects be kept in mind by these members in determining and administering their internal agricultural and price policies;
The review shall be carried out in the light of information obtainable in relation to national production, stocks, consumption, prices and trade, including both commercial and special transactions of wheat;
Each member may submit to the Council information which is relevant to the annual review of the world wheat situation and is not already available to the Council either directly or through the appropriate organization in the United Nations system including the United Nations Conference on Trade and Development (U. N. C. T. A. D.) and the Food and Agriculture Organization of the United Nations (F. A. O.).
2) In carrying out the annual review, the Council shall consider the means through which the consumption of wheat may be increased, and may undertake, in cooperation with members, studies of such matters as:
Factors affecting the consumption of wheat in various countries; and
Means of achieving increased consumption, particularly in countries where the possibility of increased consumption is found to exist.
3) For the purpose of this article, the Council shall take into account work done on grains by U. N. C. T. A. D. and the F. A. O. and by other intergovernmental organizations, in order to avoid duplication of work, and may, without prejudice to the generality of paragraph 1) of article 20, make such arrangements regarding co-operation in any of its activities as it considers desirable with such intergovernmental organizations and also with any Governments of Members of the United Nations or of the specialized agencies not party to this Convention which have a substantial interest in the international trade in grains.
4) Nothing in this article shall prejudice the complete liberty of action of any member in the determination and administration of its internal agricultural and price policies.
ARTICLE 9
Guidelines relating to concessional transactions
1) Members undertake to conduct any concessional transactions in wheat in such a way as to avoid harmful interference with normal patterns of production and international commercial trade.
2) To this end members shall undertake appropriate measures to ensure that concessional transactions are additional to commercial sales which could reasonably be anticipated in the absence of such transactions. Such measures shall be consistent with the principles of surplus disposal and guiding lines recommended by the F. A. 0. and may provide that a specified level of commercial imports of wheat, agreed with the recipient country, be maintained on a global basis by that country. In establishing or adjusting this level full regard shall be had to the commercial import levels in a representative period and to the economic circumstances of the recipient country, including, in particular, its balance-of-payments situation.
3) Members, when engaging in concessional export transactions, shall consult with exporting members whose commercial sales might be affected by such transactions, to the maximum possible extent before such arrangements are concluded with recipient countries.
4) The Executive Committee shall furnish an annual report to the Council on developments in concessional transactions in wheat.
PART II
Administration
ARTICLE 10
Constitution of the Council
1) The International Wheat Council, established by the International Wheat Agreement, 1949, shall continue in being for the purpose of administering this Convention with the membership, powers and functions provided in this Convention.
2) Each exporting and importing member shall be a voting member of the Council and may be represented at its meetings by one delegate, alternates, and advisers.
3) Such intergovernmental organizations as the Council may decide to invite to any of its meetings may each have one non-voting representative in attendance at those meetings.
4) The Council shall elect a chairman and vice-chairman who shall hold office for one crop year. The chairman shall have no vote and the vice-chairman shall have no vote while acting as chairman.
ARTICLE 11
Powers and functions of the Council
1) The Council shall establish its Rules of Procedure.
2) The Council shall keep such records as are required by the terms of this Convention and may keep such other records as it considers desirable.
3) The Council shall publish an annual report and may also publish any other information (including, in particular, its annual review or any part or summary thereof) concerning matters within the scope of this Convention.
4) In addition to the powers and functions specified in this Convention the Council shall have such other powers and perform such other functions as are necessary to carry out the terms of this Convention.
5) The Council may, by two-thirds of the votes cast by the exporting members and two-thirds of the votes cast by the importing members delegate to any of its committees or to the executive secretary the exercice of powers or functions other than those relating to the budget and assessment of contributions contained in paragraphs 2) and 3) of article 19. The Council may at any time revoke such delegation by a majority of the votes cast. Any decision made under any powers or functions delegated by the Council in accordance with this paragraph shall be subject to review by the Council at the request of any exporting or importing members made within a period which the Council shall prescribe. Any decision in respect of which no request for review has been made within the prescribed period shall be binding on all members.
6) In order to enable the Council to discharge its functions under this Convention, the Council may request, and members undertake to supply, such statistics and information as are necessary for this purpose.
ARTICLE 12
Votes
1) The exporting members shall together hold 1,000 votes and the importing members shall together hold 1,000 votes.
2) The votes to be exercised by the respective delegations of exporting members on the Council shall be those specified in Annex A.
3) The votes to be exercised by the respective delegations of importing members on the Council shall be those specified in Annex B.
4) Any exporting member may authorize any other exporting member, and any importing member may authorize any other importing member, to represent its interests and to exercise its votes at any meeting or meetings of the Council. Satisfactory evidence of such authorization shall be submitted to the Council.
5) If at any meeting of the Council an exporting member or an importing member is not represented by an accredited delegate and has not authorized another member to exercise its votes in accordance with paragraph 4) of this article, and if at the date of any meeting any member has forfeited, has been deprived of, or has recovered its votes under any provisions of this Convention, the total votes to be exercised by the exporting members shall be adjusted to a figure equal to the total of votes to be exercised at that meeting by the importing members and redistributed among exporting members in proportion to their votes.
6) Whenever any country becomes or any member ceases to be a party to this Convention, the Council shall redistribute the votes within either Annex A or Annex B, as the case may be, proportionally to the number of votes held by each member listed in that Annex.
7) No exporting or importing member shall have less than one vote and there shall be no fractional votes.
ARTICLE 13
Seat, sessions and quorum
1) The seat of the Council shall be London unless the Council decides otherwise.
2) The Council shall meet at least once during each half of each crop year and at such other times as the chairman may decide, or as otherwise required by this Convention.
3) The chairman shall convene a session of the Council if so requested by:
Five members; or
One or more members holding a total of not less than 10 per cent of the total votes; or
The Executive Committee.
4) The presence of delegates with a majority of the votes held by the exporting members and a majority of the votes held by the importing members prior to any adjustment of votes under article 12 shall be necessary to constitute a quorum at any meeting of the Council.
ARTICLE 14
Decisions
1) Except where otherwise specified in this Convention, decisions of the Council shall be by a majority of the votes cast by the exporting members and a majority of the votes cast by the importing members, counted separately.
2) Each member undertakes to accept as binding all decisions of the Council under the provisions of this Convention.
ARTICLE 15
Executive Committee
1) The Council shall establish an Executive Committee. The members of the Executive Committee shall be not more than four exporting members elected annually by the exporting members and not more than eight importing members elected annually by the importing members. The Council shall appoint the chairman of the Executive Committee and may appoint a vice-chairman.
2) The Executive Committee shall be responsible to and work under the general direction of the Council. It shall have such powers and functions as are expressly assigned to it under this Convention and such other powers and functions as the Council may delegate to it under paragraph 5) of article 11.
3) The exporting members on the Executive Committee shall have the same total number of votes as the importing members. The votes of the exporting members on the Executive Committee shall be divided among them as they shall decide, provided that no such exporting member shall have more than 40 per cent of the total votes of those exporting members. The votes of the importing members on the Executive Committee shall be divided among them as they shall decide, provided that no such importing member shall have more than 40 percent of the total votes of those importing members.
4) The Council shall prescribe rules of procedure regarding voting in the Executive Committee and may make such other provision regarding rules of procedure in the Executive Committee as it thinks fit. A decision of the Executive Committee shall require the same majority of votes as this Convention prescribes for the Council when making a decision on a similar matter.
5) Any exporting or importing member which is not a member of the Executive Committee may participate, without voting, in the discussion of any question before the Executive Committee whenever the latter considers that the interests of that member are affected.
ARTICLE 16
Advisory Sub-Committee on Market Conditions
1) The Executive Committee shall establish an Advisory Sub-Committee on Market Conditions consisting of technical representatives of not more than five exporting members and of not more than five importing members. The chairman of the Advisory Sub-Committee shall be appointed by the Executive Committee.
2) The Advisory Sub-Committee shall keep under continuous review current market conditions and shall report to the Executive Committee as provided in article 6. The Advisory Sub-Committee shall, in the exercise of its functions, take into account any representations made by any exporting or importing member.
3) Any member which is not a member of the Advisory Sub-Committee may participate in the discussion of any question before the Advisory Sub-Committee whenever the latter considers that the interests of that member are directly affected.
4) The Advisory Sub-Committee shall advise in accordance with the relevant articles of this Convention and on such other matters as the Council or the Executive Committee may refer to it, including such matters as the Council may refer to it under article 21 of this Convention.
ARTICLE 17
Secretariat
1) The Council shall have a Secretariat consisting of an Executive Secretary, who shall be its chief administrative officer, and such staff as may be required for the work of the Council and its Committees.
2) The Council shall appoint the executive secretary who shall be responsible for the performance of the duties devolving upon the Secretariat in the administration of this Convention and for the performance of such other duties as are assigned to him by the Council and its Committees.
3) The staff shall be appointed by the executive secretary in accordance with regulations established by the Council.
4) It shall be a condition of employment of the executive secretary and of the staff that they do not hold or shall cease to hold financial interest in the trade in wheat and that they shall not seek or receive instructions regarding their duties under this Convention from any Government or from any other authority external to the Council.
ARTICLE 18
Privileges and immunities
1) The Council shall have legal personality. It shall in particular have the capacity to contract, acquire and dispose of movable and immovable property and to institute legal proceedings.
2) The status, privileges, and immunities of the Council in the territory of the United Kingdom shall continue to be governed by the headquarters Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the International Wheat Council signed at London on 28 November 1968.
3) The Agreement referred to in paragraph 2) of this article shall be independent of the present Convention. It shall however terminate:
By agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Council; or
In the event of the seat of the Council being moved from the United Kingdom; or
In the event of the Council ceasing to exist.
4) In the event of the seat of the Council being moved from the United Kingdom, the Government of the member in which the seat of the Council is situated shall conclude with the Council an international agreement relating to the status, privileges and immunities of the Council, its executive secretary, its staff and representatives of members at meetings convened by the Council.
ARTICLE 19
Finance
1) The expenses of delegations to the Council and of representatives on its Committees and Sub-Committees shall be met by their respective Governments. The other expenses necessary for the administration of this Convention shall be met by annual contributions from the exporting and importing members. The contribution of each such member for each crop year shall be in the proportion which the number of its votes bears to the total of the votes of the exporting and importing members at the beginning of that crop year.
2) At its first session after this Convention comes into force, the Council shall approve its budget for the period ending 30 June 1972 and assess the contribution to be paid by each exporting and importing member.
3) The Council shall, at a session during the second half of each crop year, approve its budget for the following crop year and assess the contribution to be paid by each exporting and importing member for that crop year.
4) The initial contribution of any exporting or importing member acceding to this Convention under paragraph 2) of article 25 shall be assessed by the Council on the basis of the votes to be distributed to it and the period remaining in the current crop year, but the assessments made upon other exporting and importing members for the current crop year shall not be altered.
5) Contributions shall be payable immediately upon assessment. Any exporting or importing member failing to pay its contribution within one year of its assessment shall forfeit its voting rights until its contribution is paid, but shall not be relieved of its obligations under this Convention, nor shall it be deprived of any of its rights under this Convention unless the Council so decides.
6) The Council shall, each crop year, publish an audited statement of its recepts and expenditures in the previous crop year.
7) The Council shall, prior to its dissolution, provide for the settlement of its liabilities and the disposal of its records and assets.
ARTICLE 20
Co-operation with other intergovernmental organizations
1) The Council may make whatever arrangements are appropriate for consultation or co-operation with the United Nations and its organs, in particular U. N. C. T. A. D., and with the F. A. O. and such other specialized agencies of the United Nations and intergovernmental organizations as may be appropriate.
2) The Council, bearing in mind the particular role of U. N. C. T. A. D. in international commodity trade, will, as it considers appropriate, keep U. N. C. T. A. D. informed of its activities and programmes of work.
3) lf the Council finds that any terms of this Convention are materially inconsistent with such requirements as may be laid down by the United Nations or through its appropriate organs and specialized agencies regarding intergovernmental commodity agreements, the inconsistency shall be deemed to be a circumstance affecting adversely the operation of this Convention and the procedure prescribed in paragraphs 2), 3) and 4) of article 27 shall be applied.
ARTICLE 21
Prices and related rights and obligations
In order to assure supplies of wheat and wheat flour to importing members and markets for wheat and wheat flour to exporting members at equitable and stable prices, the Council shall at an appropriate time examine the questions of prices and related rights and obligations. When it is judged that these matters are capable of successful negotiation with the objective of bringing them into effect within the life of this Convention, the Council shall request the secretary-general of U N. C. T. A. D. to convene a negotiating conference.
ARTICLE 22
Signature
This Convention shall be open for signature in Washington from 29 March 1971 until and including 3 May 1971 by Governments of countries party to the Wheat Trade Convention, 1967, and by Governments represented at the United Nations Wheat Conference, 1971.
ARTICLE 23
Ratification, acceptance, approval
This Convention shall be subject to ratification, acceptance or approval by each signatory Government in accordance with its respective constitutional procedures. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United States of America not later than 17 June 1971, except that the Council may grant one or more extensions of time to any signatory Government that has not deposited its instrument of ratification, acceptance or approval by that date.
ARTICLE 24
Provisional application
Any signatory Government may deposit with the Government of the United States of America a declaration of provisional application of this Convention. Any other Government eligible to sign this Convention or whose application for accession is approved by the Council may also deposit with the Government of the United States of America a declaration of provisional application. Any Government depositing such a declaration shall provisionally apply this Convention and be provisionally regarded as a party thereto.
ARTICLE 25
Accession
1) Any Government represented at the United Nations Wheat Conference, 1971, or the Government of any country party to the Wheat Trade Convention, 1967, may accede to the present Convention until and including 17 June 1971, except that the Council may grant one or more extensions of time to any Government which has not deposited its instrument by that date.
2) After 17 June 1971, any Government invited to the United Nations Wheat Conference, 1971, may accede to the present Convention upon such conditions as the Council considers appropriate by two-thirds of the votes cast by exporting members and by two-thirs of the votes cast by importing members.
3) Accession shall be effected by deposit of an instrument of accession with the Government of the United States of America.
4) Where, for the purposes of the operation of this Convention, reference is made to members listed in Annex A or B, any member the Government of which has acceded to this Convention on conditions prescribed by the Council in accordance with this article shall be deemed to be listed in the appropriate Annex.
ARTICLE 26
Entry into force
1) This Convention shall enter into force among those Governments that have deposited instruments of ratification, acceptance, approval or accession as follows:
On 18 June 1971 with respect to all provisions other than articles 3 to 9 inclusive and article 21, and
On 1 July 1971 with respect to articles 3 to 9 inclusive and article 21,
if such instruments of ratification, acceptance, approval or accession, or declarations of provisional application have been deposited not later than 17 June 1971 on behalf of Government representing exporting members holding at least 60 per cent of the votes set out in Annex A and representing importing members holding at least 50 per cent of the votes set out in Annex B.
2) This Convention shall enter into force for any Government that deposits an instrument of ratification, acceptance, approval or accession after 18 June 1971 in accordance with the relevant provisions of this Convention on the date of such deposit, except that no part of it shall enter into force for such a Government until that part enters into force for other Governments under paragraph 1) or 3) of this article.
3) If this Convention does not enter into force in accordance with paragraph 1) of this article, the Governments which have deposited instruments of ratification, acceptance, approval or accession, or declarations of provisional application may decide by mutual consent that it shall enter into force among those Governments that have deposited instruments of ratification, acceptance, approval or accession.
ARTICLE 27
Duration, amendment and withdrawal
1) This Convention shall remain in force until and including 30 June 1974. However, if a new agreement covering wheat is negotiated as envisaged by article 21 and enters into force before 30 June 1974, this Convention shall remain in force only until the date of entry into force of the new agreement.
2) The Council may recommend an amendment of this Convention to the members.
3) The Council may fix a time within which each member shall notify the Government of the United States of America whether or not it accepts the amendment. The amendment shall become effective upon its acceptance by exporting members which hold two-thirds of the votes of the exporting members and by importing members which hold two-thirds of the votes of the importing members.
4) Any member which has not notified the Government of the United States of America of its acceptance of an amendment by the date on which such amendment becomes effective, may, after giving such written notice of withdrawal to the Government of the United States of America as the Council may require in each case, withdraw from this Convention at the end of the current crop year, but shall not thereby be released from any obligations under this Convention which have not been discharged by the end of that crop year. Any such withdrawing member shall not be bound by the provisions of the amendment occasioning its withdrawal. If any member satisfies the Council at its first meeting following the effective date of the amendment that its acceptance could not be secured in time by reason of constitutional or institutional difficulties and declares its intention to apply the amendment provisionally pending acceptance of that amendment, the Council may extend for such member the period fixed for acceptance until these difficulties have been overcome.
5) If any member considers that its interests are prejudiced by operation of this Convention, it may state its case to the Council and the Council shall, within thirty days, examine the matter. If the member concerned considers that notwithstanding the Council's intervention its interests continue to be prejudiced, it may withdraw from this Convention at the end of any crop year by giving written notice of withdrawal to the Government of the United States of America at least ninety days prior to the end of that crop year, but shall not, thereby, be released from any obligations under this Convention which have not been discharged by the end of that crop year.
6) Any member which becomes a member State of the E. E. C. during the currency of this Convention shall notify the Council, and the Council shall within thirty days consider the matter with a view to negotiating with that member and the E. E. C. an appropriate adjustment of their respective rights and obligations under this Convention. The Council shall have power, in such circumstances, to recommend an amendment in accordance with paragraph 2) of this article.
ARTICLE 28
Territorial application
1) Any Government may, at the time of signature or ratification, acceptance, approval, provisional application of or accession to this Convention declare that its rights and obligations under this Convention shall not apply in respect of one or more of the territories for the international relations of which it is responsible.
2) With the exception of territories in respect of which a declaration has been made in accordance with paragraph 1) of this article, the rights and obligations of any Government under this Convention shall apply in respect of all territories for the international relations of which that Government is responsible.
3) Any member may, at any time after its ratification, acceptance, approval, provisional application of or accession to this Convention, by notification to the Government of the United States of America, declare that its rights and obligations under this Convention shall apply in respect of one or more of the territories regarding which it has made a declaration in accordance with paragraph 1) of this article.
4) Any member may, by giving notification of withdrawal to the Government of the United States of America, withdraw from this Convention separately in respect of one or more of the territories for whose international relations it is responsible.
5) When a territory to which this Convention extends under paragraphs 2) and 3) of this article subsequently attains independence, the Government of that territory may, within ninety days after the attainment of independence, declare by notification to the Government of the United States of America that it has assumed the rights and obligations of a party to this Convention.
6) For the purposes of the redistribution of votes under article 12, any change in the application of this Convention in accordance with this article shall be regarded as a change in participation in this Convention in such a manner as may be appropriate to the circumstances.
ARTICLE 29
Notification by depositary Government
The Government of the United States of America as the depositary Government shall notify all signatory and acceding Governments of each signature, ratification, acceptance, approval, provisional application of, and acession to, this Convention, as well as each notification and notice received under article 27 and each declaration and notification received under article 28.
ARTICLE 30
Certified copy of the Convention
As soon as possible after the definitive entry into force of this Convention, the depositary Government shall send a certified copy of this Convention in the English, French, Russian and Spanish languages to the secretary-general of the United Nations for registration in accordance with article 102 of the Charter of the United Nations. Any amendments to this Convention shall likewise be communicated.
ARTICLE 31
Relationship of Preamble to Convention
This Convention includes the Preamble to the International Wheat Agreement, 1971.
In witness whereof the undersigned, having been duly authorized to this effect by their respective Governments have signed this Convention on the dates appearing opposite their signatures.
The texts of this Convention in the English, French, Russian and Spanish languages shall all be equally authentic, the originals being deposited with the Government of the United States of America, which shall transmit a certified copy thereof to each signatory and acceding Government and to the Executive Secretary of the Council.

ACORDO INTERNACIONAL DO TRIGO DE 1971
PREÂMBULO
A Conferência das Nações Unidas sobre o Trigo de 1971,
Considerando que o Acordo Internacional do Trigo de 1949 foi revisto, renovado ou prorrogado em 1953, 1956, 1959, 1962, 1965, 1966 e 1967,
Considerando que as disposições do Arranjo Internacional sobre os Cereais de 1967, que compreende, por um lado, a Convenção Relativa ao Comércio do Trigo e, por outro, a Convenção Relativa à Ajuda Alimentar, expirarão em 30 de Junho de 1971 e que é desejável concluir um Acordo para novo período,
Acordaram em que o presente Acordo Internacional do Trigo de 1971 compreenderá dois instrumentos jurídicos separados:
A Convenção Relativa ao Comércio do Trigo de 1971, e
A Convenção Relativa à Ajuda Alimentar de 1971,
e que a Convenção Relativa ao Comércio do Trigo de 1971, ou a Convenção Relativa ao Comércio do Trigo de 1971 e a Convenção Relativa à Ajuda Alimentar de 1971, conforme os casos, serão submetidas à assinatura, ratificação, aceitação ou aprovação, de harmonia com os respectivos procedimentos constitucionais, dos Governos representados na Conferência das Nações Unidas sobre o Trigo de 1971 a dos Governos dos Estados partes na Convenção Relativa ao Comércio do Trigo do Arranjo Internacional sobre os Cereais de 1967.
CONVENÇÃO RELATIVA AO COMÉRCIO DO TRIGO DE 1971
1.ª PARTE
Generalidades
ARTIGO 1.º
Objectivos
A presente Convenção tem por objectivo:
Favorecer a cooperação internacional no que se refere aos problemas mundiais do trigo, tendo em conta as relações existem entre o comércio do trigo e a estabilidade económica dos mercados de outros produtos agrícolas;
Fomentar o desenvolvimento do comércio internacional do trigo e da farinha de trigo, garantir que esse comércio se efectue da maneira mais livre possível, no interesse tanto dos membros exportadores como dos membros importadores, e de contribuir assim para o desenvolvimento dos países cuja economia depende da venda comercial do trigo;
Contribuir, tanto quanto possível para a estabilidade do mercado internacional do trigo no interesse quer dos membros importadores, quer dos membros exportadores; e
Fornecer um quadro, em conformidade com o artigo 21.º da presente Convenção, para a negociação de disposições relativas aos preços do trigo e aos direitos e obrigações dos membros no que se refere ao comércio internacional do trigo.
ARTIGO 2.º
Definições
Para os efeitos da presente Convenção:
1) - a) «Conselho» significa o Conselho Internacional do Trigo, constituído pelo Acordo Internacional do Trigo de 1949 e mantido pelo artigo 10.º;
«Membro» significa uma parte na presente Convenção, ou um território ou grupo de territórios em relação ao qual foi feita notificação, de harmonia com o n.º 3 do artigo 28.º;
«Membro exportador» significa um membro enumerado no Anexo A;
«Membro importador» significa um membro enumerado no Anexo B;
«Território», sempre que esta expressão se refira a um membro exportador ou a um membro importador, significa qualquer território ao qual se apliquem, em virtude do artigo 28.º, os direitos e obrigações que o Governo desse membro assumiu nos termos da presente Convenção;
«Comissão Executiva» significa a Comissão constituída de acordo com o artigo 15.º;
«Subcomissão Consultiva sobre as Condições do Mercado» significa a Subcomissão constituída de acordo com o artigo 16.º;
«Cereais» compreende o trigo, o centeio, a cevada, a aveia, o milho e o sorgo;
«Trigo» compreende o trigo em grão de qualquer natureza, categoria, tipo, grau ou qualidade e, excepto quando o contexto disponha em contrário, a farinha de trigo;
«Ano agrícola» significa o período de 1 de Julho a 30 de Junho;
«Bushel» equivale, no caso do trigo, a 60 libras avoir-du-poids ou 27,2155 kg;
«Tonelada métrica», ou 1000 kg, equivale, no caso do trigo, a 36,74371 bushels;
- i) «Compra» significa, segundo o contexto, a compra, para fins de importação, de trigo exportado, ou destinado a ser exportado, por um membro exportador ou por um membro não exportador, conforme o caso, ou a quantidade de trigo assim comprada;
ii) «Venda» significa, segundo o contexto, a venda, para fins de exportação, de trigo importado, ou destinado a ser importado, por um membro importador ou por um membro não importador, conforme o caso, ou a quantidade de trigo assim vendida;
iii) Sempre que é feita referência, na presente Convenção, a compra ou venda, entende-se que estes termos designam não só as compras ou vendas concluídas entre os Governos interessados, mas também as compras ou vendas concluídas entre os comerciantes e particulares e as compras ou vendas concluídas entre comerciante particular e o Governo interessado. Nesta definição, o termo «Governo» significa o Governo de todo e qualquer território ao qual se apliquem, em virtude do artigo 28.º, os direitos e obrigações que todos os Governos assumem ao ratificarem, aceitarem ou aprovarem a presente Convenção ou ao aderirem a ela;
Qualquer referência, na presente Convenção, a um «Governo representado na Conferência das Nações Unidas sobre o Trigo de 1971» será considerada como aplicável à Comunidade Económica Europeia (denominada a seguir por C. E. E.). Consequentemente, qualquer referência na presente Convenção à «assinatura» ou ao «depósito de instrumentos de ratificação, aceitação ou aprovação» ou a «um instrumento de adesão» ou à «declaração de aplicação provisória» por um Governo será, no caso da C. E. E., considerada como aplicável à assinatura ou à declaração de aplicação provisória pela autoridade competente da C. E. E. e ao depósito do instrumento que, de harmonia com os procedimentos institucionais da C. E. E., será necessário efectuar para a conclusão de um acordo internacional.
2) O cálculo do equivalente, em trigo, das compras de farinha de trigo será efectuado com base na taxa de extracção indicada no contrato entre o comprador e o vendedor. Se não houver indicação da taxa de extracção, 72 unidades de peso de farinha serão consideradas equivalentes, para efeitos daquele cálculo, a 100 unidades de peso de trigo em grão, salvo decisão em contrário do Conselho.
ARTIGO 3.º
Compras comerciais e transacções especiais
1) «Compra comercial» significa, para efeitos da presente Convenção, uma compra tal como é definida no artigo 2.º e realizada segundo a prática mercantil corrente no comércio internacional, com exclusão das transacções referidas no n.º 2) do presente artigo.
2) «Transacção especial» significa, para efeitos da presente Convenção, uma transacção que contém elementos não conformes à prática mercantil usual, introduzidos pelo Governo de um membro interessado. As transacções especiais compreendem:
As vendas a crédito, nas quais, como consequência de intervenção governamental, a taxa de juro, o prazo de pagamento ou outras condições conexas não são conformes com as taxa, prazos ou condições prevalecentes no comércio mundial;
As vendas em que os fundos necessários à operação são obtidos do Governo do membro exportador sob a forma de um empréstimo afectado à compra do trigo;
As vendas em divisas do membro importador, que não sejam transferíveis ou convertíveis em divisas ou em mercadorias, destinadas a serem utilizadas pelo membro exportador;
As vendas realizadas nos termos de acordos comerciais contendo disposições especiais de pagamento que prevejam contas de compensação, destinadas a liquidar bilateralmente os saldos credores por meio de troca de mercadorias, salvo se o membro exportador e o membro importador interessados concordarem que a venda seja considerada como tendo carácter comercial;
As operações de troca:
Que resultem da intervenção dos Governos e nas quais o trigo é trocado a preços diferentes dos praticados no mercado mundial; ou
ii) Que sejam realizadas a título de um programa governamental de compras, salvo se a compra do trigo resultar de uma operação de troca em que o país de destino final não é designado no contrato inicial de troca;
A dávida de trigo, ou a compra de trigo por meio de auxílio financeiro concedido especialmente para esse efeito pelo membro exportador;
Quaisquer outras categorias de transacções que o Conselho possa determinar e contenham elementos não conformes com a prática comercial corrente introduzidos pelo Governo do membro interessado.
3) Qualquer dúvida levantada pelo Secretário Executivo ou por um membro exportador ou importador sobre a determinação da natureza de uma dada transacção como compra comercial, no sentido do n.º 1), ou como transacção especial, no sentido do n.º 2) do presente artigo, será decidida pelo Conselho.
ARTIGO 4.º
Registo e notificação
1) O Conselho registará, separadamente, em relação a cada ano agrícola:
Para efeitos de aplicação da presente Convenção, todas as compras comerciais efectuadas por membros a outros membros e não membros e todas as importações pelos membros de outros membros e não membros, em condições que lhes dêem o carácter de transacções especiais; e
Todas as vendas comerciais efectuadas por membros e não membros e todas as exportações por membros com destino a não membros, em condições que lhes dêem o carácter de transacções especiais.
2) Os registos mencionados no número precedente serão feitos de forma que o registo das transacções especiais seja distinto das transacções comerciais.
3) Para facilitar o trabalho da Subcomissão Consultiva sobre as Condições do Mercado prevista no artigo 16.º, o Conselho registará os preços do mercado internacional do trigo e da farinha de trigo e os encargos de transporte.
4) Se qualquer qualidade de trigo chegar ao país de destino final, depois de revenda, passagem ou transbordo portuário num país que não seja aquele donde provém o trigo, os membros fornecerão, em toda a medida do possível, as informações que permitam registar a compra ou a transacção, mencionadas nos n.os 1) e 2) do presente artigo, como compra ou transacção entre o país de origem e o país de destino final. No caso de revenda, as disposições do presente número serão aplicáveis se o trigo saíu do país de origem durante o mesmo ano agrícola.
5) O Conselho poderá autorizar o registo das compras em relação a um ano agrícola se:
A duração prevista do carregamento estiver compreendida em prazo razoável, não superior a um mês, a fixar pelo Conselho, antes do início ou depois do termo do ano agrícola em causa; e
Os dois membros interessados estiverem de acordo.
6) Para efeitos do presente artigo:
Os membros comunicarão ao secretário executivo todas as informações relativas às quantidades de trigo que foram objecto de vendas e compras comerciais, bem como de transacções especiais, de que o Conselho, no âmbito da sua competência, possa ter necessidade, incluindo:
No que se refere às transacções especiais, as informações compreenderão os pormenores relativos às mesmas transacções que permitam classificá-las segundo as categorias definidas no artigo 3.º;
ii) No que se refere ao trigo, as informações referir-se-ão a todos os pormenores disponíveis sobre o tipo, a categoria, o grau e a qualidade, assim como sobre as quantidades em causa;
iii) No que se refere à farinha, compreenderão todas as indicações disponíveis e que permitam identificar a qualidade das farinhas e, dentro destas, as respectivas quantidades;
Os membros que exportem regularmente e os outros membros, em relação aos quais o Conselho assim venha a decidir, transmitirão ao secretário executivo todas as informações relativas aos preços das transacções comerciais, e, quando delas se disponha, das transacções especiais, a respeito de qualquer natureza, categoria, tipo, grau ou qualidade de trigo e de farinha de trigo de que o Conselho possa ter necessidade;
O Conselho receberá regularmente informações sobre os custos de transporte correntes e os membros comunicarão ao Conselho, na medida do possível, as informações complementares de que este possa ter necessidade.
7) O Conselho elaborará um regulamento de notificação e registo considerados neste artigo. Este regulamento fixará a frequência e as modalidades segundo as quais as notificações devem ser feitas e definirá as obrigações dos membros a este respeito. O Conselho prescreverá também o processo de modificação dos registos e mapas a seu cargo, bem como os modos de solução dos diferendos que possam surgir a este respeito. Se um membro faltar repetidamente e sem justificação aos compromissos de notificação assumidos nos termos do presente artigo, a Comissão Executiva iniciará consultas com o membro em causa, a fim de remediar a situação.
ARTIGO 5.º
Avaliação dos requisitos e disponibilidade de trigo
1) Até 1 de Outubro, no caso de países do Hemisfério Norte, e até 1 de Fevereiro, no caso de países do Hemisfério Sul, cada membro importador notificará o Conselho das estimativas das suas necessidades comerciais de trigo durante o ano agrícola em questão. Cada membro importador poderá comunicar posteriormente ao Conselho todas as modificações que deseja introduzir nessas estimativas.
2) Até 1 de Outubro, no caso de países do Hemisfério Norte, e até 1 de Fevereiro, no caso de países do Hemisfério Sul, cada membro exportador notificará o Conselho das suas estimativas no tocante às quantidades de trigo que poderá exportar durante o ano agrícola em questão. Cada membro exportador poderá comunicar posteriormente ao Conselho todas as modificações que deseja introduzir nas referidas estimativas.
3) Todas as estimativas notificadas ao Conselho destinam-se à administração da presente Convenção e só podem ser facultadas aos membros exportadores e importadores nas condições fixadas pelo Conselho. As estimativas apresentadas em cumprimento do presente artigo não têm, de forma nenhuma, a natureza de compromissos.
ARTIGO 6.º
Consultas sobre as condições do mercado
1) Se a Subcomissão Consultiva sobre as Condições do Mercado, no decurso do seu exame contínuo do mercado efectuado em aplicação do n.º 2) do artigo 16.º, for da opinião que a situação do mercado se tornou instável ou ameaça tornar-se iminentemente instável, ou se tal situação for levada ao conhecimento da Subcomissão Consultiva pelo secretário executivo, por sua própria iniciativa ou a pedido de qualquer membro exportador ou importador, a Subcomissão Consultiva comunicará imediatamente os factos em questão à Comissão Executiva. A Subcomissão Consultiva, ao informar a Comissão Executiva, terá particularmente em conta as circunstâncias que provocaram ou que ameaçam provocar a situação de instabilidade do mercado, incluindo as flutuações dos preços. A Comissão Executiva reunir-se-á dentro de um prazo de cinco dias úteis de mercado para analisar a situação e considerar a possibilidade de se chegar a soluções mùtuamente aceitáveis.
2) A Comissão Executiva informará, se o considerar apropriado, o presidente do Conselho, que poderá convocar uma sessão do Conselho para analisar a situação.
ARTIGO 7.º
Diferendos e reclamações
1) Todo o diferendo relativo à interpretação ou aplicação da presente Convenção que não seja resolvido por meio de negociação será, a pedido de qualquer membro, parte no diferendo, levado a Conselho para decisão.
2) Qualquer membro poderá recorrer ao Conselho quando considere que os seus interesses como parte na presente Convenção foram sèriamente lesados por acções de um ou mais membros que afectem o funcionamento da presente Convenção. Neste caso, o Conselho consultará imediatamente os membros interessados com vista a resolver a questão. Se a questão não for resolvida através dessas consultas, o Conselho examinará a questão de novo e poderá fazer recomendações aos membros interessados.
ARTIGO 8.º
Exame anual da situação mundial de trigo
1) - a) Na prossecução dos objectivos da presente Convenção tal como definidos no artigo 1.º, o Conselho estudará, cada ano, a situação mundial de trigo e informará os membros das repercussões que os factos, emergentes do tal estudo, exercem sobre o comércio mundial de trigo, de modo que os Governos desses membros os possam ter presentes quando determinarem e aplicarem a sua política interna em matéria de agricultura e de preços.
O exame da situação será efectuado em função das informações de que se disponha sobre a produção nacional, os stocks, o consumo, os preços e o comércio, ficando incluídas as transacções comerciais e especiais de trigo.
Qualquer membro pode comunicar ao Conselho informações relativas ao exame anual da situação mundial de trigo que não tenham já chegado ao Conselho, quer directamente, quer por intermédio da organização apropriada do sistema das Nações Unidas, incluindo a Conferência das Nações Unidas para o Comércio e Desenvolvimento (U. N. C. T. A. D.) e a Organização das Nações Unidas para a Alimentação e Agricultura (F. A. O.).
2) Ao proceder ao exame anual, o Conselho investigará os meios que permitam estimular o consumo de trigo e poderá empreender, em colaboração com os membros, estudos relativos, nomeadamente:
Aos factores que influenciam o consumo de trigo nos vários países; e
Aos meios que permitam estimular o consumo, particularmente nos países onde se verifique ser possível aumentá-lo.
3) Para os efeitos do presente artigo, o Conselho levará em conta os trabalhos sobre cereais feitos pela U. N. C. T. A. D. e pela F. A. O., bem como os de outros organismos intergovernamentais, com vista a evitar qualquer duplicação de trabalho, e poderá, sem prejuízo do n.º 1) do artigo 20.º, concluir os arranjos que repute desejáveis para colaborar, em qualquer das suas actividades, com aqueles organismos e também com os Governos de Estados membros da Organização das Nações Unidas ou das agências especializadas não partes na presente Convenção, mas substancialmente interessados no comércio internacional de cereais.
4) O presente artigo não prejudicará, por qualquer modo, a completa liberdade de acção de que todo o membro goza na elaboração e aplicação da sua política interna em matéria de agricultura e de preços.
ARTIGO 9.º
Directrizes relativas às transacções em condições de favor
1) Os membros comprometem-se a efectuar todas as transacções, em condições de favor, incidindo sobre trigo, por modo a evitar qualquer prejuízo à estrutura normal da produção e comércio internacionais.
2) Para este fim, os membros tomarão as medidas que se imponham no sentido de adicionar as transacções em termos de favor, às vendas comerciais, razoàvelmente previsíveis, na ausência de tais transacções. As medidas em causa deverão ser conformes aos princípios e directivas em matéria de escoamento de excedentes recomendados pela F. A. O., podendo estabelecer-se que um nível determinado de importações comerciais de trigo, acordado com o país beneficiário, seja mantido em base global por este. Na formulação e ajustamento daquele nível, convirá ter plenamente em conta o volume das importações comerciais do país beneficiário no decorrer de um período representativo, bem como a sua situação económica, nomeadamente a posição da sua balança de pagamentos.
3) Ao efectuarem operações de exportação, em termos de favor, os membros deverão consultar, na medida do possível e anteriormente à sua realização, os membros exportadores cujas vendas comerciais possam ser afectadas por aquelas.
4) A Comissão Executiva apresentará ao Conselho um relatório anual sobre a evolução das transacções de trigo em termos de favor.
2.ª PARTE
Disposições administrativas
ARTIGO 10.º
Composição do Conselho
1) O Conselho Internacional do Trigo, constituído ao abrigo do Acordo Internacional do Trigo de 1949, continua em existência, para os efeitos de aplicação da presente Convenção, com a composição, poderes e funções previstos nesta.
2) Todo o membro exportador e importador será membro do Conselho, com direito a voto, e pode fazer-se representar nas reuniões por um delegado, suplentes e conselheiros.
3) Toda a organização intergovernamental que o Conselho decida convidar para uma ou mais das reuniões poderá designar um representante, que assistirá a essas reuniões sem direito a voto.
4) O Conselho elegerá um presidente e um vice-presidente, que permanecerão em exercício durante um ano agrícola. O presidente não tem direito a voto e, do mesmo modo, o vice-presidente quando funcione como presidente.
ARTIGO 11.º
Poderes e funções do Conselho
1) O Conselho estabelecerá o seu regimento.
2) O Conselho manterá os arquivos e registos contemplados nas disposições da presente Convenção e poderá organizar quaisquer outros que julgue desejáveis.
3) O Conselho publicará um relatório anual. Poderá igualmente publicar quaisquer outros elementos informativos (nomeadamente, no todo ou em parte, o seu estudo anual ou um resumo deste sobre questões emergentes da presente Convenção).
4) Para além dos poderes e funções especificados na presente Convenção, o Conselho gozará e exercerá os outros poderes e atribuições necessários à aplicação da presente Convenção.
5) O Conselho poderá, mediante maioria de dois terços dos votos expressos por membros exportadores e de dois terços dos votos expressos por membros importadores, delegar em qualquer das suas comissões ou no secretário executivo o exercício dos poderes ou funções, excepto os relativos ao orçamento e à fixação das contribuições previstas nos n.os 2) e 3) do artigo 19.º
O Conselho poderá revogar, a todo o momento, esta delegação de poderes, mediante maioria dos votos expressos. Qualquer decisão tomada ao abrigo de poderes ou funções delegados pelo Conselho, em conformidade com as disposições do presente número, fica sujeita à revisão por parte do Conselho, a pedido de qualquer membro exportador ou importador, nos prazos prescritos pelo Conselho. Toda a decisão a respeito da qual não seja apresentado pedido de reexame, nos prazos prescritos, obriga todos os membros.
6) Com vista a estar habilitado a desempenhar as funções previstas na presente Convenção, o Conselho pode pedir aos membros, os quais se comprometem a pô-las à sua disposição, as estatísticas e informações de que necessite.
ARTIGO 12.º
Votos
1) Os membros exportadores detêm, em conjunto, 1000 votos e os importadores, em conjunto, detêm 1000 votos.
2) Os votos a que terão direito no Conselho as delegações dos membros exportadores serão os indicados no Anexo A.
3) Os votos a que terão direito no Conselho as delegações dos membros importadores serão os indicados no Anexo B.
4) Todo o membro exportador poderá autorizar um outro membro exportador e todo o membro importador poderá autorizar um outro membro importador a representar os seus interesses e exercer o direito de voto que lhe compete em uma ou mais reuniões do Conselho.
Prova bastante desta autorização será apresentada ao Conselho.
5) Se à data de uma reunião do Conselho um membro exportador ou importador não estiver representado por um delegado acreditado e não houver habilitado outro membro a exercer o seu direito de voto, em conformidade com o n.º 4) do presente artigo, ou se à data de uma reunião um membro, por força de disposição da presente Convenção, houver perdido o seu direito de voto, ou estiver dele privado, ou o tiver recuperado, o total dos votos que poderão exprimir os membros exportadores será ajustado para número igual ao dos votos que podem exprimir os membros importadores presentes na reunião e será redistribuído entre os exportadores na proporção dos votos que detêm.
6) Sempre que um país se tornar parte na presente Convenção, ou deixe de o ser, o Conselho redistribuirá os votos indicados, quer no Anexo A, quer no Anexo B, conforme o caso, proporcionalmente ao número de votos detidos por cada um dos membros constantes daquele Anexo.
7) Todo o membro exportador ou importador disporá, pelo menos, de um voto e não haverá fracções de votos.
ARTIGO 13.º
Sede, sessões e quórum
1) A sede do Conselho é em Londres, salva decisão do mesmo em contrário.
2) O Conselho reúne, no decurso de cada ano agrícola, pelo menos, uma vez por semestre e em qualquer momento por decisão do presidente ou exigência do disposto na presente Convenção.
3) O presidente convocará uma sessão do Conselho se tal lhe for solicitado:
Por cinco membros; ou
Por um ou mais membros que detenham um total de, pelo menos, 10 por cento do conjunto dos votos; ou
Pela Comissão Executiva.
4) Em cada reunião do Conselho será requisito para constituição do quórum a presença de delegados que detenham, anteriormente a qualquer ajustamento do número de votos feito ao abrigo do artigo 12.º, maioria dos votos pertencentes a membros exportadores e a maioria dos votos pertencentes a membros importadores.
ARTIGO 14.º
Decisões
1) Salva disposição contrária da presente Convenção, as decisões do Conselho serão tomadas por maioria dos votos expressos pelos membros exportadores e por maioria dos votos expressos pelos membros importadores, contados separadamente.
2) Cada membro compromete-se a considerar obrigatórias todas as decisões tomadas pelo Conselho ao abrigo do disposto na presente Convenção.
ARTIGO 15.º
Comissão Executiva
1) O Conselho nomeará uma Comissão Executiva.
Esta será composta por um máximo de quatro membros exportadores, eleitos todos os anos pelos membros exportadores, e por um máximo de oito membros importadores, eleitos todos os anos pelos membros importadores. O Conselho nomeará o presidente da Comissão Executiva e poderá nomear também um vice-presidente.
2) A Comissão Executiva é responsável perante o Conselho e funciona sob a sua direcção geral. Tem os poderes e funções que lhe são atribuídos expressamente pela presente Convenção e todos aqueles que o Conselho venha a delegar-lhe, ao abrigo do n.º 5) do artigo 11.º
3) Os membros exportadores com lugar na Comissão Executiva detêm o mesmo número total de votos que os importadores. Os votos pertencentes a membros exportadores com lugar na Comissão Executiva serão repartidos entre eles do modo que decidirem, com a condição de nenhum membro exportador deter mais de 40 por cento do total de votos pertencentes aos membros exportadores. Os votos dos membros importadores com lugar na Comissão Executiva serão repartidos entre eles do modo que decidirem, com a condição de nenhum membro importador deter mais de 40 por cento do total dos votos pertencentes aos membros importadores.
4) O Conselho fixará as regras processuais de voto no seio da Comissão Executiva e adoptará outras cláusulas que repute útil incluir no regimento da Comissão Executiva. As decisões da Comissão Executiva deverão ser tomadas por maioria igual à que a presente Convenção estabelece para o Conselho, quando este decida sobre questão semelhante.
5) Todo o membro exportador ou importador que não seja membro da Comissão Executiva poderá participar, sem direito a voto, na discussão de qualquer matéria apresentada à Comissão Executiva, sempre que esta repute em causa os interesses desse membro.
ARTIGO 16.º
Subcomissão Consultiva sobre as Condições do Mercado
1) A Comissão Executiva estabelecerá uma Subcomissão Consultiva sobre as Condições do Mercado composta por representantes técnicos de um máximo de cinco membros exportadores e de um máximo de cinco membros importadores. O presidente da Subcomissão Consultiva será designado pela Comissão Executiva.
2) A Subcomissão Consultiva examinará contìnuamente a situação corrente do mercado e informará a Comissão Executiva em conformidade com o artigo 6.º
A Subcomissão Consultiva levará em conta, no exercício das suas funções, quaisquer exposições feitas por um membro exportador ou importador.
3) Todo o membro que não estiver representado na Subcomissão Consultiva poderá participar na discussão de qualquer matéria apresentada à Subcomissão Consultiva sempre que esta repute em causa os interesses do mesmo membro.
4) A Subcomissão Consultiva dará pareceres de harmonia com os artigos pertinentes da presente Convenção, assim como sobre outras questões que possam ser-lhe submetidas pelo Conselho ou pela Comissão Executiva, incluindo as questões que o Conselho lhe submeta ao abrigo do artigo 21.º da presente Convenção.
ARTIGO 17.º
Secretariado
1) O Conselho disporá de um Secretariado, composto por um Secretário executivo, seu mais alto funcionário, e do pessoal necessário aos trabalhos do Conselho e suas Comissões.
2) O Conselho nomeará o secretário executivo, responsável pelo desempenho das tarefas cometidas ao Secretariado, para a administração da presente Convenção e de outras que lhe sejam confiadas pelo Conselho e suas Comissões.
3) O pessoal será nomeado pelo secretário executivo, em conformidade com as regras estabelecidas pelo Conselho.
4) É requisito de admissão para o secretário executivo e pessoal não possuírem interesses, ou renunciarem a todos os interesses financeiros no comércio do trigo, e não solicitarem, nem receberem, de um Governo ou autoridade exterior ao Conselho instruções relativas às funções que exerçam no âmbito da presente Convenção.
ARTIGO 18.º
Privilégios e Imunidades
1) O Conselho terá personalidade jurídica. Terá, em particular, capacidade para contratar, para adquirir e dispor de bens móveis e imóveis, bem como para litigar.
2) O estatuto, os privilégios e as imunidades do Conselho no território do Reino Unido continuarão a ser regidos pelo Acordo relativo à sede, assinado em Londres aos 28 de Novembro de 1968, entre e o Governo do Reino Unido da Grã-Bretanha e da Irlanda do Norte e o Conselho Internacional do Trigo.
3) O Acordo referido no n.º 2) deste artigo será independente da presente Convenção. Não obstante, aquele Acordo caducará:
Se for concluído um acordo entre o Governo do Reino Unido da Grã-Bretanha e da Irlanda do Norte e o Conselho, ou
No caso de a sede do Conselho deixar de estar situada no território do Reino Unido, ou
No caso de o Conselho ser dissolvido.
4) No caso de a sede do Conselho deixar de estar situada no território do Reino Unido, o Governo do país membro em cujo território a sede do Conselho foi instalada concluirá um acordo internacional com o Conselho relativo ao estatuto, privilégios e imunidades do Conselho, do seu secretário executivo, do seu pessoal e dos representantes dos membros às reuniões convocadas pelo Conselho.
ARTIGO 19.º
Disposições de natureza financeira
1) As despesas das delegações junto do Conselho e dos representantes nas Comissões e Subcomissões ficam a cargo dos respectivos Governos. As outras despesas emergentes da aplicação da presente Convenção serão cobertas por meio de contribuições anuais dos membros exportadores e importadores. A contribuição de cada membro, por ano agrícola, é fixada proporcionalmente ao número de votos que aquele detém, relativamente ao total de votos detidos pelos membros exportadores e importadores no princípio do dito ano agrícola.
2) No decorrer da primeira sessão que se siga à entrada em vigor da presente Convenção, o Conselho votará o seu orçamento para a período que termina em 30 de Junho de 1972 e fixará a contribuição de cada membro exportador e importador.
3) O Conselho, no decorrer de uma das sessões que tenham lugar durante o 2.º trimestre de cada ano agrícola, votará o seu orçamento para o ano agrícola seguinte e fixará a contribuição de cada membro exportador e importador para o referido ano.
4) A contribuição inicial de todo a membro, exportador ou importador, que adira à presente Convenção em conformidade com as disposições do n.º 2) do artigo 25.º, será fixada pelo Conselho, com base no número de votos a atribuir-lhe e no período que decorrerá até ao fim do ano agrícola, mas as contribuições fixadas para os outros membros exportadores e importadores, pelo ano agrícola em curso, não serão modificadas.
5) As contribuições vencem-se no momento da sua liquidação. Todo o membro, exportador ou importador, que não pague o montante da sua contribuição durante o ano seguinte à liquidação perderá o direito de voto até efectuar o pagamento, mas não fica dispensado das obrigações emergentes da presente Convenção nem privado dos outros direitos que esta lhe confere, salvo decisão em contrário do Conselho.
6) O Conselho publicará, no decorrer de cada ano agrícola, uma conta corrente autenticada das receitas arrecadadas e despesas feitas no decorrer do ano agrícola precedente.
7) O Conselho tomará, anteriormente à sua dissolução, todas as disposições com vista à liquidação do seu passivo, bem assim quanto à consignação do seu activo e arquivos.
ARTIGO 20.º
Colaboração com outras organizações intergovernamentais
1) O Conselho poderá tomar todas as medidas apropriadas à troca de informações ou colaboração com a Organização das Nações Unidas e seus órgãos, nomeadamente com a U. N. C. T. A. D. e a F. A. O., bem assim com outras agências especializadas das Nações Unidas e organizações intergovernamentais.
2) Tendo em consideração o papel especial da U. N. C. T. A. D. no comércio internacional de produtos de base, o Conselho levará ao conhecimento desta Organização, quando o considere apropriado, as suas actividades e programas de trabalho.
3) Se o Conselho verificar que qualquer disposição da presente Convenção revela incompatibilidade de fundo com obrigações emergentes das Nações Unidas, seus órgãos competentes e agências especializadas, em matéria de acordos intergovernamentais sobre produtos de base, será a referida incompatibilidade reputada prejudicial ao funcionamento da presente Convenção e aplicar-se-á o procedimento prescrito nos n.os 2), 3) e 4) do artigo 27.º
ARTIGO 21.º
Preços e direitos e obrigações a eles relacionados
Com vista a assegurar fornecimentos de trigo e de farinha de trigo aos membros importadores e mercados de trigo e de farinha de trigo aos membros exportadores, o Conselho examinará, em tempo oportuno, as questões de preços e de direitos e obrigações com eles relacionados. Quando for julgado que estas matérias são susceptíveis de serem negociadas com bom êxito, o Conselho pedirá ao secretário-geral da U. N. C. T. A. D. a convocação de uma conferência, a fim de abrir negociações durante a vigência da presente Convenção sobre as matérias acima referidas.
ARTIGO 22.º
Assinatura
A presente Convenção fica aberta à assinatura, em Washington, de 29 de Março de 1971 a 3 de Maio de 1971, inclusive, dos Governos dos países partes na Convenção Relativa ao Comércio do Trigo de l967 e dos Governos representados na Conferência das Nações Unidas sobre o Trigo de 1971.
ARTIGO 23.º
Ratificação, aceitação, aprovação
A presente Convenção fica sujeita à ratificação, aceitação ou aprovação de cada Governo signatário, em conformidade com os respectivos procedimentos constitucionais. Os instrumentos de ratificação, aceitação ou aprovação serão depositados junto do Governo dos Estados Unidos da América o mais tardar no dia 17 de Junho de 1971, excepto quando o Conselho conceda uma ou mais prorrogações de prazo a todo o Governo signatário que não haja depositado o seu instrumento de ratificação, aceitação ou aprovação em tal data.
ARTIGO 24.º
Aplicação provisória
Todo o Governo signatário poderá depositar, junto do Governo dos Estados Unidos da América, uma declaração de aplicação provisória da presente Convenção. Qualquer outro Governo que preencha as condições necessárias para assinar a presente Convenção ou cujo pedido de adesão tenha sido aprovado pelo Conselho pode igualmente depositar, junto do Governo dos Estados Unidos da América, uma declaração de aplicação provisória. Todo o Governo que deposite tal declaração aplicará provisòriamente a presente Convenção e será considerado, provisòriamente, parte na dita Convenção.
ARTIGO 25.º
Adesão
1) Todo o Governo representado na Conferência das Nações Unidas sobre o Trigo de 1971 ou o Governo de qualquer país parte na Convenção Relativa ao Comércio do Trigo de 1967 poderá aderir à presente Convenção até 17 de Junho de 1971, inclusive, ficando entendido que o Conselho poderá conceder uma ou mais prorrogações de prazo a todo o Governo que não tenha depositado o seu instrumento de adesão em tal data.
2) Depois de 17 de Junho de 1971, todo o Governo convidado a participar na Conferência das Nações Unidas sobre o Trigo de 1971 poderá aderir à presente Convenção nas condições que o Conselho julgar apropriadas, estabelecidas pela maioria de dois terços dos votos expressos pelos membros exportadores e de dois terços dos votos expressos pelos membros importadores.
3) A adesão terá lugar por meio de depósito de um instrumento de adesão junto do Governo dos Estados Unidos da América.
4) Quando se faz menção, para efeitos de aplicação da presente Convenção, de membros referidos nos Anexos A ou B, todo o membro cujo Governo aderiu à presente Convenção, nas condições prescritas pelo Conselho e em conformidade com o presente artigo, será tido como fazendo parte do Anexo adequado.
ARTIGO 26.º
Entrada em vigor
1) A presente Convenção entrará em vigor, entre os Governos que depositaram instrumentos de ratificação, aceitação, aprovação ou adesão, nas seguintes condições:
A 18 de Junho de 1971, para todas as disposições que não os artigos 3.º a 9.º, inclusive, e o artigo 21.º; e
A 1 de Julho de 1971, para os artigos 3.º a 9.º, inclusive, e o artigo 21.º, no caso de instrumentos de ratificação, aceitação, aprovação ou adesão, ou declarações de aplicação provisória depositados até 17 de Junho de 1971, em nome de Governos que representem membros exportadores que detenham pelo menos 60 por cento dos votos indicados no Anexo A e representem membros importadores que detenham pelo menos 50 po cento dos votos indicados no Anexo B.
