4) The effective length of a raised quarter deck, if fitted with an intact front bulkhead, shall be its length up to a maximum of 0,6 L. Where the bulkhead is not intact, the raised quarter deck shall be treated as a poop of less than standard height.
5) Superstructures which are not enclosed shall have no effective length.
Regulation 36
Trunks
1) A trunk or similar structure which does not extend to the sides of the ship shall be regarded as efficient on the following conditions:
The trunk is at least as strong as a superstructure;
The hatchways are in the trunk deck, and the hatchway coamings and covers comply with the requirements of regulations 13 to 16 inclusive and the width of the trunk deck stringer provides a satisfactory gangway and sufficient lateral stiffness. However, small access openings with watertight covers may be permitted in the freeboard deck;
A permanent working platform fore and aft fitted with guard rails is provided by the trunk deck, or by detached trunks connected to superstructures by efficient permanent gangways;
Ventilators are protected by the trunk, by watertight covers or by other equivalent means;
Open rails are fitted on the weather parts of the freeboard deck in way of the trunk for at least half their length;
The machinery casings are protected by the trunk, by a superstructure of at least standard height, or by a deckhouse of the same height and of equivalent strength;
The breadth of the trunk is at least 60 per cent of the breadth of the ship; and
Where there is no superstructure, the length of the trunk is at least 0,6 L.
2) The full length of an efficient trunk reduced in the ratio of its mean bradth to B shall be its effective length.
3) The standard height of a trunk is the standard height of a superstructure other than a raised quarter deck.
4) Where the height of a trunk is less than the standard height, its effective length shall be reduced in the ratio of the actual to the standard height. Where the height of hatchway coamings on the trunk deck is less than that required under regulation 15, paragraph 1), a reduction from the actual height of trunk shall be made which corresponds to the difference between the actual and the required height of coaming.
Regulation 37
Deduction for superstructures and trunks
1) Where the effective length of superstructures and trunks is 1 L, the deduction from the freeboard shall be 350 mm at 24 m length of ship, 860 mm at 85 m length, and 1070 mm at 122 m length and above (14" at 79' length of ship, 34" at 279' length, and 42" at 400' length and above); deductions at intermediate lengths shall be obtained by linear interpolation.
2) Where the total effective length of superstructures and trunks is less than 1 L the deduction shall be a percentage obtained from one of the following tables:

3) For ships of type «B»:
Where the effective length of a bridge is less than 0,2 L, the percentages shall be obtained by linear interpolation between lines I and II.
Where the effective length of a forecastle is more than 0,4 L, the percentages shall be obtained from line II.
Where the effective length of a forecastle is less than 0,07 L, the above percentages shall be reduced by:
5 x (0,07 L - f)/0,07 L)
where f is the effective length of the forecastle.
Regulation 38
Sheer
General:
1) The sheer shall be measured from the deck at side to a line of reference drawn parallel to the keel through the sheer line at amidships.
2) In ships designed with a rake of keel, the sheer shall be measured in relation to a reference line drawn parallel to the design load water line.
3) In flush deck ships and in ships with detached superstructures the sheer shall be measured at the freeboard deck.
4) In ships with topsides of unusual form in which there is a step or break in the topsides, the sheer shall be considered in relation to the equivalent depth amidships.
5) In ships with a superstructure of standard height which extends over the whole length of the freeboard deck, the sheer shall be measured at the superstructure deck. Where the height exceeds the standard the least difference (Z) between the actual and standard heights shall be added to each end ordinate. Similarly, the intermediate ordinates at distances of (1/6)L and (1/3)L from each perpendicular shall be increased by 0,444 Z and 0,111 Z respectively.
6) Where the deck of an enclosed superstructure has at least the same sheer as the exposed freeboard deck, the sheer of the enclosed portion of the freeboard deck shall not be taken into account.
7) Where an enclosed poop or forecastle is of standand height with greater sheer than that of the freeboard deck, or is of more than standard height, an addition to the sheer of the freeboard deck shall be made as provided in paragraph 12) of this regulation.

Measurement of variation from standard sheer profile:
9) Where the sheer profile differs from the standard, the four ordinates of each profile in the forward or after half shall be multiplied by the appropriate factors given in the table of ordinates. The difference between the sums of the respective products and those of the standard divided by 8 measures the deficiency or excess of sheer in the forward or after half. The arithmetical mean of the excess or deficiency in the forward and after halves measures the excess or deficiency of sheer.
10) Where the after half of the sheer profile is greater than the standard and the forward half is less than the standard, no credit shall be allowed for the part in excess and deficiency only shall be measured.
11) Where the forward half of the sheer profile exceeds the standard, and the after portion of the sheer profile is not less than 75 per cent of the standard, credit shall be allowed for the part in excess; where the after part is less than 50 per cent of the standard no credit shall be given for the excess sheer forward. Where the after sheer is between 50 per cent and 75 per cent of the standard, intermediate allowances may be granted for excess sheer forward.
12) Where sheer credit is given for a poop or forecastle the following formula shall be used:
s = (y/3)(L'/L)
where:
s = sheer credit, to be deducted from the deficiency or added to the excess of sheer;
y = difference between actual and standard height of superstructure at the end of sheer;
L' = mean enclosed length of poop or forecastle up to a maximum length of 0,5 L;
L = length of ship as defined in regulation 3, paragraph 1) of this Annex.
The above formula provides a curve in the form of a parabola tangent to the actual sheer curve at the freeboard deck and intersecting the end ordinate at a point below the superstructure deck a distance equal to the standard height of a superstructure. The superstructure deck shall not be less than standard height above this curve at any point. This curve shall be used in determining the sheer profile for forward and after halves of the ship.
Correction for variations from standard sheer profile:
13) The correction for sheer shall be the deficiency or excess of sheer [see paragraphs 9) to 11) inclusive of this regulation], multiplied by 0,75 - (S/2L), where S is the total length of enclosed superstructures.
Addition for deficiency in sheer:
14) Where the sheer is less than the standard, the correction for deficiency in sheer [see paragraph 13) of this regulation] shall be added to the freeboard. Deduction for excess sheer:
15) In ships where an enclosed superstructure covers 0,1 L before and 0,1 L abaft amidships, the correction for excess of sheer as calculated under the provisions of paragraph 13) of this regulation shall be deducted from the freeboard; in ships where no enclosed superstructure covers amidships, no deduction shall be made from the freeboard; where an enclosed superstructure covers less than 0,1 L before and 0,1 L abaft amidships, the deduction shall be obtained by linear interpolation. The maximum deduction for excess sheer shall be at the rate of 125 mm per 100 m of length (1 1/2" per 100' of length).
Regulation 39
Minimum bow height
1) The bow height defined as the vertical distance at the forward perpendicular between the waterline corresponding to the assigned summer freeboard and the designed trim and the top of the exposed deck at side shall be not less than:
For ships below 250 m in length:
56 L (1 - (L/500))(1,36/C(índice b) + 0,68) (millimetres)
For ships of 250 m and above in length:
7000 (1,36/C(índice b) + 0,68) (millimetres)
where L is the length of the ship in metres, C(índice b) is the block coefficient which is to be taken as not less than 0,68.
or,
For ships below 820' in length:
0,672 L (1 - (L/1640))(1,36/C(índice b) + 0,68) (inches)
For ships of 820' and above in length:
275,6 (1,36/C(índice b) + 0,68) (inches)
where L is the length of the ship in feet, (C(índice b)) is the block coefficient which is to be taken as not less than 0,68.
2) Where the bow height required in paragraph 1) of this regulation is obtained by sheer, the sheer shall extend for at least 15 per cent of the length of the ship measured from the forward perpendicular. Where it is obtained by fitting a superstructure, such superstructure shall extend from the stem to a point at least 0,07 L abaft the forward perpendicular, and it shall comply with the following requirements:
For ships not over 100 m (328') in length it shall be enclosed as defined in regulation 3, paragraph 10), and
For ships over 100m (328') in length it need not comply with regulation 3, paragraph 10) but shall be fitted with closing appliances to the satisfaction of the Administration.
3) Ships which, to suit exceptional operational requirements, cannot meet the requirements of paragraphs 1) and 2) of this regulation may be given special consideration by the administration.
Regulation 40
Minimum freeboards
Summer freeboard:
1) The minimum freeboard in summer shall be the freeboard derived from the tables in regulation 28 as modified by the corrections in regulations 27, as applicable, 29, 30, 31, 32, 37, 38 and, if applicable, 39.
2) The freeboard in salt water, as calculated in accordance with paragraph 1) of this regulation, but without the correction for deck line, as provided by regulation 32, shall not be less than 50 mm (2"). For ships having in position 1 hatchways with covers which do not comply with the requirements of regulations 15, paragraph 7), 16 or 26, the freeboard shall be not less than 150 mm (6").
Tropical freeboard:
3) The minimum freeboard in the tropical zone shall be the freeboard obtained by a deduction from the summer freeboard of one forty-eighth of the summer draught measured from the top of the keel to the centre of the ring of the load line mark.
4) The freeboard in salt water, as calculated in accordance with paragraph 1) of this regulation, but without the correction for deck line, as provided by regulation 32 shall not be less than 50 mm (2"). For ships having position 1 hatchways with covers which do not comply with the requirements of regulations 15, paragraph 7), 16 or 26, the freeboard shall be not less than 150 mm (6").
Winter freeboard:
5) The minimum freeboard in winter shall be the freeboard obtained by an addition to the summer freeboard of one forty-eighth of summer draught, measured from the top of the keel to the centre of the ring of the load line mark.
Winter north Atlantic freeboard:
6) The minimum freeboard for ships of not more than 100 m (328') in length, which enter any part of the north Atlantic defined in regulation 52 (Annex II) during the winter seasonal period, shall be the winter freeboard plus 50 mm (2"). For other ships, the winter north Atlantic freeboard shall be the winter freeboard.
Fresh water freeboard:
7) The minimum freeboard in fresh water of unit density shall be obtained by deducting from the minimum freeboard in salt water:
((Delta)/40 T)(centimetres - inches)
where:
(Delta) = displacement in salt water in tons at the summer load water line;
T = tons per centimetre (inch) immersion in salt water at the summer load water line.
8) Where the displacement at the summer load water line cannot be certified, the deduction shall be one forty-eighth of summer draught, measured from the top of the keel to the centre of the ring of the load line mark.
CHAPTER IV
Special requirements for ships assigned timber freeboards
Regulation 41
Application of this chapter
Regulations 42 to 45 inclusive apply only to ships to which timber load lines are assigned.
Regulation 42
Definitions
1) Timber deck cargo. - The term «timber deck cargo» means a cargo of timber carried on an uncovered part of a freeboard or superstructure deck. The term does not include wood pulp or similar cargo.
2) Timber load line. - A timber deck cargo may be regarded as giving a ship a certain additional buoyancy and a greater degree of protection against the sea. For that reason, ships carrying a timber deck cargo may be granted a reduction of freeboard calculated according to the provisions of regulation 45 and marked on the ship's side in accordance with the provisions of regulation 6, paragraphs 3) and 4). However, in order that such special freeboard may be granted and used, the timber deck cargo shall comply with certain conditions which are laid down in regulation 44, and the ship itself shall also comply with certain conditions relating to its construction which are set out in regulation 43.
Regulation 43
Construction of ship
Superstructure:
1) Ships shall have a forecastle of at least standard height and a length of at least 0,07 L. In addition, if the ship is less than 100 m (328') in length, a poop of at least standard height, or a raised quarterdeck with either a deckhouse or a strong stell hood of at least the same total height shall be fitted aft.
Double bottom tanks:
2) Double bottom tanks where fitted within the midship half length of the ship shall have adequate watertight longitudinal subdivision.
Bulwarks:
3) The ship shall be fitted either with permanent bulwarks at least 1 metre (39 1/2") in height, specially stiffened on the upper edge and supported by strong bulwark stays attached to the deck and provided with necessary freeing ports, or with efficient rails of the same height and of specially strong construction.
Regulation 44
Stowage
General:
1) Openings in the weather deck over which cargo is stowed shall be securely closed and battened down. The ventilators shall be efficiently protected.
2) Timber deck cargo shall extend over at least the entire available length which is the total length of the well or wells between superstructures. Where there is no limiting superstructure at the after end, the timber shall extend at least to the after end of the aftermost hatchway. The timber shall be stowed as solidly as possible to at least the standard height of the superstructure.
3) On a ship within a seasonal winter zone in winter, the height of the deck cargo above the weather deck shall not exceed one-third of the extreme breadth of the ship.
4) The timber deck cargo shall be compactly stowed, lashed and secured. It shall not interfere in any way with the navigation and necessary work of the ship. Uprights:
5) Uprights, when required by the nature of the timber, shall be of adequate strength considering the breadth of the ship; the spacing shall be suitable for the length and character of timber carried, but shall not exceed 3 m (9,8'). Strong angles or metal sockets or equally efficient means shall be provided for securing the uprights.
Lashings:
6) Timber deck cargo shall be efficiently secured throughout its length by independent over-all lashings spaced not more than 3 m (9,8') apart. Eye plates for these lashings shall be efficiently attached to the sheer strake or to the deck stringer plate at intervals of not more than 3 m (9,8'). The distance from an end bulkhead of a superstructure to the first eye plate shall be not more than 2 m (6,6'). Eye plates and lashings shall be provided 0,6 m (23 1/2") and 1,5 m (4,9') from the ends of timber deck cargoes where there is no bulkhead.
7) Lashings shall be not less than 19 mm (3/4") close link chain or flexible wire rope of equivalent strength, fitted with sliphooks and turnbuckles, which shall be accessible at all times. Wire rope lashings shall have a short length of long link chain to permit the length of lashings to be regulated.
8) When timber is in lengths less than 3,6 m (11,8') the spacing of the lashings shall be reduced or other suitable provisions made to suit the length of timber.
9) All fittings required for securing the lashings shall be of strength corresponding to the strength of the lashings.
Stability:
10) Provision shall be made for a safe margin of stability at all stages of the voyage, regard being given to additions of weight, such as those due to absorption of water and icing and to losses of weight such as those due to consumption of fuel and stores.
Protection of crew. Access to machinery spaces, etc.:
11) In addition to the requirements of regulation 25, paragraph 5) of this Annex guard rails or life lines spaced not more than 33 cm (13") apart vertically shall be provided on each side of the deck cargo to a height of at least 1 metre (39 1/2") above the cargo.
Steering arrangements:
12) Steering arrangements shall be effectively protected from damage by cargo and, as far as practicable, shall be accessible. Efficient provision shall be made for steering in the event of a breakdown in the main steering arrangements.
Regulation 45
Computation for freeboard
1) The minimum summer freeboards are computed in accordance with regulations 27, paragraph 5), 27, paragraphs 6) and 11), 28, 29, 30, 31, 32, 37 and 38, except that regulation 37 is modified by substituting the following percentages for those given in regulation 37:

Percentages at intermediate lengths of superstructures shall be obtained by linear interpolation.
2) The winter timber freeboard shall be obtained by adding to the summer timber freeboard one thirty-sixth of the moulded summer timber draught.
3) The winter north Atlantic timber freeboard shall be the same as the winter north Atlantic freeboard prescribed in regulation 40, paragraph 6).
4) The tropical timber freeboard shall be obtained by deducting from the summer timber freeboard one forty-eighth of the moulded summer timber draught.
5) The fresh water timber freeboard shal be computed in accordance with regulation 40, paragraph 7), based on the summer timber load water line
ANNEX II
Zones, areas and seasonal periods
The zones and areas in this Annex are, in general, based on the following criteria:
Summer - not more than 10 per cent winds of force 8 Beaufort (34 knots) or more. Tropical - not more than 1 per cent winds of force 8 Beaufort (34 knots) or more. Not more than one tropical storm in 10 years in an area of 5º square in any one separate calendar month.
In certain special areas, for practical reasons, some degree of relaxation has been found acceptable.
A chart is attached to this Annex to illustrate the zones and areas defined below.
Regulation 46
Northern winter seasonal zones and area
1) North Atlantic winter seasonal zones I and II:
The north Atlantic winter seasonal zone I lies within the meridian of longitude 50º W from the coast of Greenland to latitude 45º N, thence the parallel of latitude 45º N to longitude 15º W, thence the meridian of longitude 15º W to latitude 60º N, thence the parallel of latitude 60º N the Greenwich Meridian, thence this meridian northwards.
Seasonal periods:
Winter - 16 October to 15 April.
Summer - 16 April to 15 October
The north Atlantic winter seasonal zone II lies within the meridian of longitude 68º 30'W from the coast of the United States to latitude 40º N, thence the rhumb line to the point latitude 36º N, longitude 73º W, thence the parallel of latitude 36º N to longitude 25º W and thence the rhumb line to cape Toriñana.
Excluded from this zone are the north Atlantic winter seasonal zone I and the Baltic sea bounded by the parallel of the latitude of The Skaw in the Skagerrak.
Seasonal periods:
Winter - 1 November to 31 March;
Summer - 1 April to 31 October.
2) North Atlantic winter seasonal area:
The boundary of the north Atlantic winter seasonal area is: the meridian of longitude 68º 30' W from the coast of the United States to latitude 40º N, thence the rhumb line to the southernmost intersection of the meridian of longitude 61º W with the coast of Canada and thence the east coasts of Canada and the United States.
Seasonal periods:
For ships over 100 m (328') in length:
Winter - 16 December to 15 February.
Summer - 16 February to 15 December.
For ships of 100 m (328') and under in length:
Winter - 1 N vember to 31 March.
Summer - 1 il to 31 October.
3) North Pacific winter seasonal zone:
The southern boundary of the north Pacific winter seasonal zone is: the parallel of latitude 50º N from the east coast of the U. S. S. R. to the west coast of Sakhalin, thence the west coast of Sakhalin to the southern extremity of Kurilion, thence the rhumb line to Wakkanai, Hokkaido, Japan, thence the east and south coasts of Hokkaido to longitude 145º E, thence the meridian of longitude 145º E to latitude 35º N, thence the parallel of latitude 35º N to longitude 150º W and thence the rhumb line to the southern extremity of Dall island, Alaska.
Seasonal periods:
Winter - 16 October to 15 April.
Summer - 16 April to 15 October.
Regulation 47
Southern winter seasonal zone
The northern boundary of the southern winter seasonal zone is: the rhumb line from the east coast of the American continent at cape Tres Puntas to the point latitude 34º S, longitude 50º W, thence the parallel of latitude 34º S to longitude 17º E, thence the rumb line to the point latitude 35º10' S, longitude 20º E, thence the rhumb line to the point latitude 34º S, longitude 28º E, thence along the rhumb line to the point latitude 35º30' S, longitude 118º E, and thence the rhumb line to cape Grim on the northwest coast of Tasmania; thence along the north and east coasts of Tasmania to the southernmost point of Bruny island, thence the rhumb line to Black Rock Point on Stewart island, thence the rhumb line to the point latitude 47º S, longitude 170º E, thence along the rhumb line to the point latitude 33º S, longitude 170º W, and thence the parallel of latitude 33º S to the west coast of the American continent. Seasonal periods:
Winter - 16 April to 15 October.
Summer - 16 October to 15 April.
Regulation 48
Tropical zone
1) Northern boundary of the tropical zone:
The northern boundary of the tropical zone is: the parallel of latitude 13º N from the east coast of the American continent to longitude 60º W, thence the rhumb line to the point latitude 10º N, longitude 58º W, thence the parallel of latitude 10º N to longitude 20º W, thence the meridian of longitude 20º W to latitude 30º N and thence the parallel of latitude 30º N to the west coast of Africa; from the east coast of Africa the parallel of latitude 8º N to longitude 70º E, thence the meridian of longitude 70º E to latitude 13º N, thence the parallel of latitude 13º N to the west coast of India; thence the south coast of India to latitude 10º 30' N on the east coast of India, thence the rhumb line, to the point latitude 9º N, longitude 82º E, thence the meridian of longitude 82º E to latitude 8º N, thence the parallel of latitude 8º N to the west coast of Malaysia, thence the coast of South-East Asia to the east coast of Vietnam at latitude 10º N, thence the parallel of latitude 10º N to longitude 145º E, thence the meridian of longitude 145º E to latitude 13º N and thence the parallel of latitude 13º N to the west coast of the American continent. Saigon is to be considered as being on the boundary line of the tropical zone and the seasonal tropical area.
2) Southern boundary of the tropical zone:
The southern boundary of the tropical zone is: the rhumb line from the port of Santos, Brazil, to the point where the meridian of longitude 40º W intersects the Tropic of Capricorn; thence the Tropic of Capricorn to the west coast of Africa; from the east coast of Africa the parallel of latitude 20º S to the west coast of Madagascar, thence the west and north coasts of Madagascar to longitude 50º E, thence the meridian of longitude 50º E to latitude 10º S, thence the parallel of latitude 10º S to longitude 98º E, thence the rhumb line to port Darwin, Australia, thence the coasts of Australia and Wessel island eastwards to cape Wessel, thence the parallel of latitude 11º S to the west side of cape York; from the east, side of cape York the parallel of latitude 11º S to longitude 150º W, thence the rhumb line to the point latitude 26º S, longitude 75º W, and thence the rhumb line to the west coast of the American continent at latitude 30º S. Coquimbo and Santos are to be considered as being on the boundary line of the tropical and summer zones.
3) Areas to be included in the tropical zone:
The following areas are to be treated as included in the tropical zone:
The Suez canal, the Red sea and the gulf of Aden, from Port Said to the meridian of longitude 45º E. Aden and Berbera are to be considered as being on the boundary line of the tropical zone and the seasonal tropical area;
The Persian gulf to the meridian of longitude 59º E;
The area bounded by the parallel of latitude 22º S from the east coast of Australia to the Great Barrier reef, thence the Great Barrier reef to latitude 11º S. The northern boundary of the area is the southern boundary of the tropical zone.
Regulation 49
Seasonal tropical areas
The following are seasonal tropical areas:
1) In the North Atlantic:
An area bounded: on the north by the rhumb line from cape Catoche, Yucatan, to cape San Antonio, Cuba, the north coast of Cuba to latitude 20º N and thence the parallel of latitude 20º N to longitude 20º W ; on the west by the coast of the American continent; on the south and east by the northern boundary of the tropical zone.
Seasonal periods:
Tropical - 1 November to 15 July.
Summer - 16 July to 31 October.
2) In the Arabian sea:
An area bounded: on the west by the coast of Africa, the meridian of longitude 45º E in the gulf of Aden, the coast of South Arabia and the meridian of longitude 59º E in the gulf of Oman; on the north and east by the coasts of Pakistan and India; on the south by the northern boundary of the tropical zone.
Seasonal periods:
Tropical - 1 September to 31 May.
Summer - 1 June to 31 August.
3) In the bay of Bengal:
The bay of Bengal north of the northern boundary of the tropical zone:
Seasonal periods:
Tropical - 1 December to 30 April.
Summer - 1 May to 30 November.
4) In the South Indian ocean:
An area bounded: on the north and west by the southern boundary of the tropical zone and the east coast of Madagascar; on the south by the parallel of latitude 20º S; on the east by the rhumb line from the point latitude 20º S, longitude 50º E, to the point latitude 15º S, longitude 51º 30' E, and thence by the meridian of longitude 51º 30' E to latitude 10º S.
Seasonal periods:
Tropical - 1 April to 30 November.
Summer - 1 December to 31 March.

5) In the China sea:
An area bounded: on the west and north by the coasts of Vietnam and China from latitude 10º N to Hong-Kong; on the east by the rhumb line from Hong-Kong to the port of Sual (Luzon island) and the west coasts of the islands of Luzon, Samar and Leyte to latitude 10º N; on the south by the parallel of latitude 10º N. Hong-Kong and Sual are to be considered as being on the boundary of the seasonal tropical area and summer zone.

6) In the North Pacific:
An area bounded: on the north by the parallel of latitude 25º N; on the west by the meridian of longitude 160º E ; on the south by the parallel of latitude 13º N; on the east by the meridian of longitude 130º W.

1) Baltic sea:
This sea bounded by the parallel of latitude of the Skaw in the Skagerrak is included in the summer zones.

2) Black sea:
This sea is included in the summer zones.

Notes
When a ship departs from a port situated on a river or inland waters, deeper loading shall be permitted corresponding to the weight of fuel and all other materials required for consumption between the point of departure and the sea.
When a ship is in fresh water of unit density the appropriate load line may be submerged by the amount of the fresh water allowance shown above. Where the density is other than unity, an allowance shall be made proportional to the difference between 1,025 and the actual density.

Convenção Internacional das Linhas de Carga, 1966
Os Governos contratantes,
Desejando estabelecer princípios e regras uniformes sobre os limites autorizados para a imersão dos navios que efectuem viagens internacionais, tendo em vista a necessidade de salvaguardar a vida humana e a propriedade no mar;
Considerando que o melhor meio de atingir este fim é a conclusão de uma Convenção;
Acordam nas disposições seguintes:
ARTIGO 1 — Obrigações gerais derivadas da Convenção
1) Os Governos contratantes comprometem-se a dar efeito às disposições da presente Convenção e seus Anexos, os quais constituem parte integrante da mesma. Qualquer referência à presente Convenção constitui referência simultânea aos Anexos.
2) Os Governos contratantes comprometem-se a tomar todas as medidas que forem necessárias para dar efeito às disposições da presente Convenção.
ARTIGO 2 — Definições
Para os fins da presente Convenção, salva indicação expressa em contrário:
1) «Regras» é o termo que designa as regras anexas à Convenção.
2) «Administração» é o termo que designa o governo do Estado cuja bandeira o navio arvora.
3) «Aprovado» significa aprovado pela administração.
4) «Viagem internacional» é a expressão que designa uma viagem marítima entre um país ao qual se aplica a presente Convenção e um porto situado fora desse país ou inversamente. Para este fim, qualquer território por cujas relações internacionais é responsável um Governo contratante ou para o qual as Nações Unidas são a autoridade administrativa é considerado como um país distinto.
5) «Navio de pesca» é um navio utilizado na captura de peixe, baleias, focas, morsas ou outros recursos vivos do mar.
6) «Navio novo» é um navio cuja quilha é assente ou que se encontra em fase idêntica de construção na data ou depois da data de entrada em vigor da presente Convenção para cada Governo contratante.
7) «Navio existente» designa um navio que não é um navio novo.
8) «Comprimento» significa 96 por cento de todo o comprimento, medido sobre uma linha de água situada a uma altura acima da quilha igual a 85 por cento do menor dos pontais, medidos a partir da face superior da quilha ou o comprimento medido da face de vante da roda de proa até ao eixo da madre do leme naquela linha de água, se este comprimento for maior. Nos navios projectados com diferença de imersão a linha de água na qual é medido este comprimento será paralela à linha de água carregada de projecto.
ARTIGO 3 — Disposições gerais
1) Nenhum navio sujeito às prescrições da presente Convenção poderá iniciar uma viagem internacional em data posterior à da entrada em vigor da presente Convenção sem que tenha sido vistoriado, marcado e provido de um Certificado Internacional das Linhas de Carga, 1966, ou de um Certificado Internacional de Isenção das Linhas de Carga, de acordo com as disposições da presente Convenção.
2) Nenhuma disposição da presente Convenção impedirá que uma administração permita a um navio um bordo livre superior ao mínimo bordo livre determinado em conformidade com as disposições do Anexo I.
ARTIGO 4 — Aplicação
1) A presente Convenção aplica-se aos navios seguintes:
Navios registados em países cujos Governos forem Governos contratantes;
Navios registados em territórios aos quais for extensiva a presente Convenção, em conformidade com o artigo 32; e
Navios não registados que arvorem a bandeira de um Estado cujo Governo for um Governo contratante.
2) A presente Convenção aplica-se a navios que efectuem viagens internacionais.
3) As regras contidas no Anexo I são especialmente estabelecidas para navios novos.
4) Os navios existentes que não satisfaçam inteiramente às disposições das regras contidas no Anexo I, ou a parte delas, devem pelo menos satisfazer às disposições correspondentes menos rigorosas que a administração aplicava aos navios que efectuavam viagens internacionais antes da entrada em vigor da presente Convenção; em caso algum pode ser exigido aumento do seu bordo livre. Para beneficiar de qualquer redução no bordo livre anteriormente atribuído, estes navios devem satisfazer a todos os requisitos impostos pela presente Convenção.
5) As regras contidas no Anexo II aplicam-se a navios novos e aos navios existentes abrangidos pela presente Convenção.
ARTIGO 5 — Excepções
1) A presente Convenção não se aplica a:
Navios de guerra;
Navios novos de comprimento inferior a 24m (79');
Navios existentes com arqueação bruta inferior a 150 t;
Iates de recreio que não efectuem qualquer tráfego comercial;
Navios de pesca.
2) Nenhuma disposição da presente Convenção se aplica a navios que naveguem exclusivamente:
Nos grandes lagos do Norte da América e no rio de S. Lourenço, para oeste de uma loxodromia que vai do cabo des Rosiers à ponta ocidental da ilha de Anticosti, prolongada ao norte da ilha de Anticosti pelo meridiano de longitude 63º W.;
No mar Cáspio;
No rio da Prata, no Paraná e no Uruguai para ocidente da loxodromia que vai de Punta Norte, na Argentina, até Punta del Este, no Uruguai.
ARTIGO 6 — Isenções
1) Os navios que efectuem viagens internacionais entre portos próximos de dois ou mais Estados podem ser isentos pela administração, das disposições da presente Convenção, enquanto se mantiverem nesse tráfego, se os Governos dos Estados onde estiverem situados esses portos reconhecerem que as viagens são efectuadas em rota abrigada e em condições tais que seria pouco razoável ou inviável a aplicação das disposições da presente Convenção a navios que efectuem tais viagens.
2) A administração pode isentar qualquer navio que apresente características novas, de qualquer das disposições da presente Convenção, cuja aplicação possa entravar sèriamente as investigações tendentes a melhorar essas características, assim como a sua aplicação a bordo de navios que efectuem viagens internacionais. Um tal navio deve, contudo, satisfazer aos requisitos de segurança que, na opinião da administração, são adequados ao serviço a que o navio se destina e que, garantindo a total segurança do navio, são aceites pelos governos dos Estados que ele visite.
3) A administração que conceder qualquer isenção em conformidade com os parágrafos 1) e 2) deste artigo, deve participar à Organização Intergovernamental Consultiva da Navegação Marítima (a seguir designada por Organização) os pormenores e razões da mesma, dos quais a Organização dará conhecimento aos outros Governos contratantes, para sua informação.
4) Um navio que não esteja normalmente afecto a viagens internacionais, mas que, em circunstâncias excepcionais, necessite de fazer uma só viagem internacional, pode ser isento pela administração de qualquer das disposições da presente Convenção desde que satisfaça a condições de segurança que, na opinião da administração, são adequadas à viagem a empreender pelo navio.
ARTIGO 7 — Força maior
1) Um navio que, no momento de partir para uma viagem, não estiver sujeito às prescrições da presente Convenção não pode ser obrigado a submeter-se a elas por motivo de desvio da rota inicial devido a mau tempo ou qualquer outra causa de força maior.
2) Na aplicação das disposições da presente Convenção os Governos contratantes terão em consideração todos os desvios de rota ou atrasos ocasionados pelo mau tempo ou por qualquer outro motivo de força maior.
ARTIGO 8 — Equivalências
1) A administração pode autorizar que num navio sejam instalados equipamentos, materiais, dispositivos ou aparelhagem, ou adoptadas quaisquer outras disposições particulares que não sejam as exigidas pela presente Convenção, se se tiver assegurado, por meio de provas, ou por qualquer outra forma, que esses equipamentos, materiais, dispositivos, aparelhagem ou disposições são pelo menos tão eficientes como as exigidas pela presente Convenção.
2) A administração que autorizar, nestas condições, quaisquer equipamentos, materiais, dispositivos, aparelhagem ou disposições particulares diferentes das prescritas pela presente Convenção deve comunicar os pormenores respectivos à Organização juntamente com um relatório sobre as provas efectuadas, para ser levado ao conhecimento dos Governos contratantes.
ARTIGO 9 — Aprovação para fins experimentais
1) Nenhuma das prescrições da presente Convenção impede uma administração de aprovar disposições especiais para fins experimentais, em relação a um navio ao qual se aplique esta Convenção.
2) A administração que aprove uma disposição deste género deve comunicar os seus pormenores à Organização, para esta os levar ao conhecimento dos Governos contratantes.
ARTIGO 10 — Reparações, alterações e modificações
1) Um navio que sofrer reparações, alterações, modificações e o respectivo apetrechamento deve continuar a satisfazer, pelo menos, às disposições que lhe eram aplicáveis anteriormente. Em tal caso um navio existente não deve, em regra, deixar de satisfazer em menor grau do que até então aos requisitos aplicáveis a um navio novo.
2) As reparações, alterações, modificações de maior importância e o respectivo apetrechamento devem satisfazer às disposições aplicáveis a um navio novo tanto quanto a administração o julgue possível e razoável.
ARTIGO 11 — Zonas e regiões
1) Um navio sujeito à presente Convenção deve satisfazer às disposições que lhe são aplicáveis nas zonas e regiões definidas no Anexo II.
2) Um porto que se encontrar na linha de separação de duas zonas e regiões adjacentes será considerado como estando na zona ou região donde o navio vem ou como estando naquela para onde o navio se dirige.
ARTIGO 12 — Imersão
1) Excepto nos casos previstos nos parágrafos 2) e 3) deste artigo, as linhas de carga próprias, marcadas no costado de um navio e que correspondem à estação do ano e à zona ou região na qual o navio se pode encontrar, nunca devem estar submersas quando o navio sai para o mar, durante a viagem ou à chegada.
2) Quando o navio se move em água doce, de densidade igual à unidade, a linha de carga própria pode estar submersa a uma profundidade correspondente à correcção para água doce indicada no Certificado Internacional das Linhas de Carga, 1966. Quando a densidade da água for diferente da unidade, a correcção será proporcional à diferença entre 1,025 e a densidade real.
3) Quando um navio parte de um porto fluvial ou de um porto situado em águas interiores, será permitido aumentar o carregamento do navio de uma quantidade correspondente ao peso do combustível e de quaisquer outros materiais de consumo entre o ponto de partida e o mar.
ARTIGO 13 — Vitorias, inspecções e marcações
As vistorias, inspecções e marcações dos navios para aplicação das disposições da presente Convenção são efectuadas, e as isenções concedidas, por funcionários da administração. Todavia, a administração pode confiar as vistorias, as inspecções e as marcações, quer a inspectores nomeados para o efeito, quer a organismos por ela reconhecidos. Em qualquer caso, a administração interessada garante em absoluto a execução completa e eficaz das vistorias, das inspecções e das marcações.
ARTIGO 14 — Vistorias e inspecções iniciais e periódicas dos navios
1) Um navio será submetido às vistorias e inspecções a seguir especificadas:
Uma vistoria antes de o navio entrar em serviço, a qual compreenderá uma inspecção completa à sua estrutura e ao seu equipamento, em tudo em que o navio é coberto pela presente Convenção. Esta vistoria permitirá verificar que as disposições, os materiais e os escantilhões satisfazem inteiramente aos requisitos da presente Convenção.
Uma vistoria periódica, efectuada pela administração com intervalos determinados, mas que não excedam cinco anos, a qual permitirá verificar que a estrutura, o equipamento, as disposições, os materiais e os escantilhões satisfazem inteiramente às prescrições da presente Convenção.
Uma inspecção periódica, a realizar anualmente nos três meses que seguem ou que precedem a data do aniversário da entrega do certificado, para verificar que o casco ou as superstruturas não sofreram alterações que afectem os cálculos que serviram para determinar a posição da linha de carga e que estão em bom estado de conservação as instalações e aprestos para:
Protecção das aberturas;
ii) Balaustradas;
iii) Resbordos do convés; e
iv) Meios de acesso aos alojamentos da tripulação.
2) As inspecções periódicas expressas na alínea c) do parágrafo 1) deste artigo deverão ser registadas no Certificado Internacional das Linhas de Carga, 1966,
ou no Certificado Internacional de Isenção das Linhas de Carga passado aos navios isentos ao abrigo das disposições do parágrafo 2) do artigo 6 da presente Convenção.
ARTIGO 15 — Manutenção das condições após as vitorias
Depois de qualquer das vistorias previstas no artigo 14, nenhuma modificação deverá ser feita, sem autorização da administração, na estrutura do navio, no seu equipamento, nas disposições, no material ou nos escantilhões objecto dessa vistoria.
ARTIGO 16 — Passagem de certificados
1) Aos navios que tenham sido vistoriados e marcados de acordo com as disposições da presente Convenção será passado um Certificado Internacional das Linhas de Carga, 1966.
2) A qualquer navio a que tenha sido concedida uma isenção ao abrigo das disposições do parágrafo 2) ou do parágrafo 4) do artigo 6 será passado um Certificado Internacional de Isenção das Linhas de Carga, 1966.
3) Estes certificados são passados quer pela administração, quer por uma entidade ou um organismo por ela devidamente autorizado. Em qualquer caso a administração assume inteira responsabilidade pelo certificado.
4) Sem prejuízo de qualquer outra disposição da presente Convenção, qualquer certificado internacional das linhas de carga que tenha validade quando a presente Convenção entrar em vigor para o Governo do Estado cuja bandeira o navio arvore continua válido por dois anos, ou até que expire, se o seu prazo de validade terminar antes desse tempo. Terminado esse prazo, torna-se exigível um Certificado Internacional das Linhas de Carga, 1966.
ARTIGO 17 — Certificado passado por outro Governo
1) Um Governo contratante pode pedir a outro Governo contratante que mande vistoriar um navio e que, se verificar que satisfaz às disposições da presente Convenção, passe ou autorize a passagem de um Certificado Internacional das Linhas de Carga, 1966, de acordo com a presente Convenção.
2) Uma cópia do certificado, uma cópia do relatório da vistoria feita para o cálculo do bordo livre e uma cópia dos cálculos serão enviadas logo que possível ao Governo que fez o pedido.
3) Um certificado passado nestas condições deve conter a declaração de que foi passado a pedido do Governo do Estado cuja bandeira o navio arvora ou irá arvorar, terá o mesmo valor que um certificado passado em conformidade com o artigo 16 e como tal será reconhecido.
4) Nenhum Certificado Internacional das Linhas de Carga, 1966, será passado a um navio que arvore a bandeira de um Estado cujo Governo não é um Governo contratante.
ARTIGO 18 — Modelos dos certificados
1) Os certificados serão redigidos na língua ou línguas ficiais do país que os passa. Se a língua utilizada não for o inglês, nem o francês, o texto incluirá uma tradução numa destas línguas.
2) Os certificados obedecerão aos modelos do impresso que constam do Anexo III. O arranjo gráfico de cada modelo será reproduzido exactamente em todos os certificados passados ou nas cópias autênticas dos mesmos.
ARTIGO 19 — Prazo de validade dos certificados
1) Um Certificado Internacional das Linhas de Carga, 1966, é passado por um período de tempo cuja duração é fixada pela administração, mas não poderá exceder cinco anos, contados a partir da data do certificado.
2) Se, depois da vistoria periódica prevista na alínea b) do parágrafo 1) do artigo 14, não puder ser passado novo certificado ao navio, antes de expirar a validade do certificado inicial, o agente ou o organismo que efectuar a vistoria pode prorrogar a sua validade por um período que não deve exceder cinco meses. Esta prorrogação será registada no certificado e só será concedida quando não tenha havido modificações na estrutura, no equipamento, nas disposições, nos materiais ou nos escantilhões que afectem o bordo livre do navio.
3) O Certificado Internacional das Linhas de Carga, 1966, será cancelado pela administração num dos seguintes casos:
Se no casco ou nas superstruturas do navio tiverem sido feitas modificações de tal importância que seja necessário atribuir um bordo livre maior;
Se as instalações e disposições indicadas na alínea c) do parágrafo 1) do artigo 14 não forem mantidas em estado de bom funcionamento;
Se o certificado não apresentar um visto que mostre que o navio foi inspeccionado em conformidade com a alínea c) do parágrafo 1) do artigo 14;
Se a resistência estrutural do navio tiver diminuído de tal modo que este não apresente a segurança desejada.
4):
O prazo de validade de um certificado internacional de isenção das linhas de carga passado por uma administração a um navio isento ao abrigo das disposições do parágrafo 2) do artigo 6 não deve exceder cinco anos contados a partir da data do certificado. Este certificado ficará sujeito a um processo de renovação, vistos e cancelamento idêntico ao estabelecido neste artigo para o Certificado Internacional das Linhas de Carga, 1966;
O prazo de validade de um certificado internacional de isenção das linhas de carga passado a um navio isento em conformidade com as disposições do parágrafo 4) do artigo 6 será limitado à duração da viagem simples para a qual esse certificado foi passado.
5) Um certificado passado a um navio por uma administração perde a validade se esse navio mudar de bandeira.
ARTIGO 20 — Aceitação dos certificados
Os certificados passados sob a responsabilidade de um Governo contratante em conformidade com as disposições da presente Convenção serão aceitos pelos outros Governos contratantes e considerados, para todos os fins da presente Convenção, como tendo o mesmo valor que os certificados por eles passados.
ARTIGO 21 — Fiscalização
1) Os navios portadores de um certificado que foi passado em virtude das disposições do artigo 16 ou das do artigo 17 estão sujeitos, quando se encontram em portos de outros Governos contratantes, a fiscalização exercida por funcionários, para tal devidamente autorizados por esses Governos. Os Governos contratantes devem procurar que essa fiscalização se exerça, tanto quanto for razoável e possível, com vista a verificar que existe a bordo um certificado válido segundo as disposições da presente Convenção. Se o navio possuir um Certificado Internacional das Linhas de Carga, 1966, válido, a fiscalização limitar-se-á a verificar que:
O navio não está carregado para além dos limites permitidos pelo certificado;
A posição das linhas de carga no navio corresponde às indicações do certificado; e
Para tudo o que respeita às disposições das alíneas a) e b) do parágrafo 3) do artigo 19, o navio não sofreu modificações de importância tal que não esteja manifestamente em condições de ir para o mar sem perigo para os passageiros ou para a tripulação.
Quando existir a bordo um certificado internacional de isenção das linhas de carga, válido, a fiscalização limitar-se-á à verificação de que estão cumpridas todas as condições previstas nesse certificado.
2) Se a fiscalização for exercida ao abrigo da alínea c) do parágrafo 1) deste artigo, o seu objectivo limitar-se-á a impedir o navio de sair para o mar enquanto não estiver em condições de o fazer sem perigo para os passageiros ou para a tripulação.
3) No caso de a fiscalização prevista no presente artigo originar qualquer espécie de intervenção, o funcionário que a exercer deve imediatamente e por escrito informar desta decisão o cônsul ou o representante diplomático do Estado cuja bandeira o navio arvora, bem como de todas as circunstâncias que motivarem essa intervenção.
ARTIGO 22 — Benefícios
Os benefícios da presente Convenção não podem ser reivindicados a favor de um navio que não possua um certificado válido passado ao abrigo da presente Convenção.
ARTIGO 23 — Acidentes
1) Cada administração compromete-se a efectuar inquéritos sobre quaisquer acidentes sucedidos a navios pelos quais for responsável e que estejam sujeitos às disposições da presente Convenção sempre que julgar que esses inquéritos podem auxiliar a determinar as alterações que será desejável introduzir na Convenção.
2) Cada Governo contratante compromete-se a fornecer à Organização todas as informações pertinentes relativas aos resultados desses inquéritos. Os relatórios ou recomendações da Organização baseados nessas informações não devem revelar a identidade ou a nacionalidade dos navios a que disserem respeito, nem de qualquer modo atribuir a responsabilidade desse acidente a qualquer navio ou pessoa, nem tão-pouco dar a entender a quem atribuir.
ARTIGO 24 — Tratados e convenções anteriores
1) Todos os outros tratados, convenções e acordos relacionados com as linhas de carga actualmente em vigor entre Governos que sejam partes na presente Convenção continuam a vigorar durante o prazo que lhes estiver atribuído, pelo que respeita a:
Navios aos quais se não aplica a presente Convenção;
Navios aos quais se aplica a presente Convenção em assuntos nela não expressamente estipulados.
2) Todavia, na medida em que tais tratados, convenções ou acordos estiverem em contradição com as disposições da presente Convenção, são estas que devem prevalecer.
ARTIGO 25 — Regras especiais resultantes de acordos
Quando, em conformidade com a presente Convenção, forem estabelecidas regras especiais, por acordo, entre todos ou entre alguns dos Governos contratantes, essas regras deverão ser comunicadas à Organização para esta as levar ao conhecimento de todos os Governos contratantes.
ARTIGO 26 — Comunicação de informações
1) Os Governos contratantes comprometem-se a comunicar e a fornecer à Organização:
Um número suficiente de exemplares dos modelos dos certificados que passem ao abrigo das disposições da presente Convenção para serem enviados aos Governos contratantes;
O texto das leis, decretos, ordens, regulamentos e outros diplomas que forem publicados sobre os vários assuntos abrangidos pela presente Convenção;
Uma lista das entidades não governamentais que forem autorizadas a actuar em seu nome na administração dos assuntos das linhas de carga para a comunicar aos Governos contratantes.
2) Cada Governo contratante compromete-se a pôr à disposição de qualquer outro Governo contratante, que lhas peça, as normas de resistência que utiliza.
ARTIGO 27 — Assinatura, aceitação e adesão
1) A presente Convenção ficará aberta para assinatura durante três meses a partir de 5 de Abril de 1966 e, em seguida, aberta para adesão. Os Governos dos Estados membros das Nações Unidas ou de qualquer das agências especializadas ou da Agência Internacional da Energia Atómica ou partes no Estatuto do Tribunal Internacional de Justiça podem tornar-se partes na Convenção por:
Assinatura sem reservas quanto à aceitação;
Assinatura sob reserva de aceitação, seguida de aceitação; ou
Adesão.
2) A aceitação ou a adesão deverá ser efectuada por depósito de um instrumento de aceitação ou de adesão na Organização, que informará todos os Governos que assinaram a Convenção, ou a ela aderiram, de cada nova aceitação ou adesão e da data do respectivo depósito.
ARTIGO 28 — Entrada em vigor
1) A presente Convenção entrará em vigor doze meses após a data na qual pelo menos quinze Governos (dos quais sete possuam, cada um, uma frota de pelo menos 1 milhão de toneladas brutas de arqueação), tenham assinado sem reservas de aceitação ou depositado instrumentos de aceitação ou de adesão em conformidade com as disposições do artigo 27. A Organização informará todos os Governos que assinaram a presente Convenção ou a ela aderiram da data da sua entrada em vigor.
2) Para os Governos que depositarem um instrumento de aceitação da presente Convenção ou de adesão à mesma dentro do período de doze meses previsto no parágrafo 1) do presente artigo, a aceitação ou a adesão terão efeito na data de entrada em vigor da presente Convenção ou três meses após a data do depósito do instrumento de aceitação ou de adesão, se esta última data for posterior.
3) Para os Governos que depositarem um instrumento de aceitação da presente Convenção ou de adesão à mesma após a data da sua entrada em vigor, a Convenção só entrará em vigor três meses após a data do depósito daquele instrumento.
4) Depois da data na qual estiverem tomadas todas as disposições exigidas para a entrada em vigor de qualquer emenda à presente Convenção, ou após a data na qual todas as necessárias aceitações forem consideradas como recolhidas ao abrigo da alínea b) do parágrafo 2) do artigo 29, no caso de emenda aceite por unanimidade, qualquer instrumento de aceitação ou de adesão depositado é considerado como respeitante à Convenção com emendas.
ARTIGO 29 — Alterações
1) A presente Convenção pode ser alterada por proposta de um Governo contratante por meio de um dos processos previstos no presente artigo.
2) Alteração aprovada por unanimidade:
A pedido de um Governo contratante, qualquer proposta de alteração à presente Convenção por ele formulada será comunicada pela Organização a todos os Governos contratantes para apreciação, com vista à sua aprovação por unanimidade;
Qualquer alteração assim comunicada entrará em vigor doze meses após a data da sua aprovação por todos os Governos contratantes, a não ser que por eles seja acordada uma data mais próxima. Um Governo contratante que, num prazo de três anos, contados a partir da data em que a Organização lhe fez a comunicação, não a notifique de que aceita ou rejeita a alteração proposta, considera-se como tendo aprovado essa emenda;
A alteração assim proposta será considerada como rejeitada, se não for aprovada nas condições previstas na alínea b) do presente parágrafo, três anos após a primeira comunicação feita pela Organização a todos os Governos contratantes.
3) Alteração depois da apreciação feita pela Organização:
A pedido de um Governo contratante, a Organização examinará qualquer alteração proposta por esse Governo à presente Convenção.
Se esta proposta for aprovada pela maioria de 2/3 dos membros presentes que tenham direito a voto na Comissão de Segurança Marítima da Organização, a alteração será comunicada a todos os membros da Organização e a todos os Governos contratantes, seis meses, pelo menos, antes de ser apreciada pela Assembleia da Organização;
Se a alteração for aprovada pela maioria de 2/3 dos membros presentes que tenham direito a voto na Assembleia, será comunicada pela Organização a todos os Governos contratantes para que dêem a sua aprovação;
A alteração entrará em vigor doze meses após a data da sua aprovação por 2/3 dos Governos contratantes e não se aplicará àqueles que antes da sua entrada em vigor tiverem feito a declaração de que não a aprovam;
Pela maioria de 2/3 dos membros presentes que tenham direito a voto, neles incluindo os 2/3 dos governos representados na Comissão de Segurança Marítima presentes à Assembleia e com direito a voto, esta pode propor, no momento da adopção de uma alteração, que fique estabelecido que esta reveste tal importância que qualquer Governo contratante que fizer a declaração prevista na alínea c) e não aprove a alteração no prazo de doze meses contados a partir da data da sua entrada em vigor deixará, quando o prazo expirar, de ser parte na presente Convenção. A decisão ficará subordinada a aprovação prévia por 2/3 dos Governos contratantes partes na presente Convenção;
Nenhuma das disposições deste parágrafo impedirá o Governo contratante que, tendo adoptado para uma alteração à presente Convenção o processo previsto no mesmo parágrafo, venha a adoptar, em qualquer instante, um dos dois outros que lhe pareça desejável, seja o do parágrafo 2), seja o do parágrafo 4), do presente artigo.
4) Alteração por conferência:
A pedido formulado por um Governo contratante e apoiado por 1/3, pelo menos, dos Governos contratantes, a Organização convocará uma conferência para apreciar alterações à presente Convenção;
Qualquer alteração adoptada por esta conferência pela maioria de 2/3 dos Governos contratantes presentes e que tenham direito a voto é comunicada pela Organização a todos os outros Governos contratantes para que dêem a sua aprovação;
A alteração entrará em vigor para todos os Governos contratantes doze meses após a data da sua aprovação pelos 2/3 dos Governos contratantes e não se aplicará àqueles que antes da sua entrada em vigor tiverem feito a declaração de que não a aprovam;
Pela maioria de 2/3 dos membros presentes que tenham direito a voto, uma conferência, convocada em conformidade com a alínea a) deste parágrafo, pode indicar, no momento da aprovação de uma alteração, que esta reveste tal importância que qualquer Governo contratante que faça a declaração prevista na alínea c) e não aprove a alteração no prazo de doze meses contados a partir da data da sua entrada em vigor deixará, quando o prazo expirar, de ser parte na presente Convenção.
5) Qualquer alteração à presente Convenção feita por aplicação deste artigo e que disser respeito à estrutura dos navios só é aplicável àqueles cuja quilha foi assente, ou que se encontrem, em fase idêntica de construção, na data da entrada em vigor desta alteração ou após essa data.
6) A Organização informará todos os Governos contratantes de qualquer alteração que entre em vigor em conformidade com este artigo, assim como da data em que cada alteração entrará em vigor.
7) Qualquer aprovação ou declaração feita em conformidade com o presente artigo será notificada, por escrito, à Organização, que por sua vez notificará todos os Governos contratantes da recepção dessa aprovação ou declaração.
ARTIGO 30 — Denúncia
1) A presente Convenção pode ser denunciada em qualquer momento por qualquer dos Governos contratantes depois de decorrido um período de cinco anos contados a partir da data em que a Convenção entrou em vigor para esse Governo.
2) A denúncia será efectuada por notificação escrita dirigida à Organização, que, por sua vez, informará todos os Governos contratantes de todas as notificações recebidas e das datas da sua recepção.
3) A denúncia produzirá efeitos um ano após a data em que a sua notificação tiver sido recebida pela Organização ou decorrido prazo maior que seja indicado nessa notificação.
ARTIGO 31 — Suspensão
1) No caso de hostilidade ou de outras circunstâncias extraordinárias que afectem os interesses vitais de um Estado cujo Governo for um Governo contratante, pode esse Governo suspender, no todo ou em parte, a execução da Convenção. O Governo que usar dessa faculdade deve imediatamente avisar a Organização dessa suspensão.
2) A suspensão não privará os outros Governos contratantes de qualquer direito de fiscalização ao abrigo da presente Convenção sobre os navios do Governo que suspendeu a execução da Convenção quando esses navios se encontrarem nos seus portos.
3) O Governo que suspender a execução da Convenção pode em qualquer altura pôr termo a essa suspensão e deve imediatamente avisar do facto a Organização.
4) A Organização notificará todos os Governos contratantes de qualquer suspensão ou do termo de suspensão resolvida ao abrigo deste artigo.
ARTIGO 32 — Territórios
1):
As Nações Unidas, quando sejam responsáveis pela administração de determinado território, ou qualquer Governo contratante responsável pelas relações internacionais de um território, devem, logo que possível, consultar as autoridades desse território, esforçando-se por estender ao mesmo a aplicação da presente Convenção, e podem, em qualquer altura, por meio de notificação escrita à Organização, declarar que a aplicação da presente Convenção se tornará extensiva a esse território.
A aplicação da presente Convenção tornar-se-á extensiva ao território designado na notificação, a partir da data da recepção desta ou de qualquer outra data que nela seja indicada.
2):
As Nações Unidas ou qualquer Governo contratante que tiverem feito uma declaração em conformidade com a alínea a) do parágrafo 1) deste artigo podem, em qualquer ocasião, após ter decorrido um período de cinco anos contados a partir da data em que a aplicação da Convenção se tornou extensiva a qualquer território, declarar, por meio de notificação escrita dirigida à Organização, que a presente Convenção deixará de ser aplicável ao território designado na notificação.
A presente Convenção deixa de ser extensiva a qualquer território mencionado numa notificação ao fim de um ano contado a partir da data da recepção da notificação pela Organização ou de qualquer outro período maior nela indicado.
3) A Organização informará todos os Governos contratantes da extensão da presente Convenção a qualquer território em conformidade com o parágrafo 1) do presente artigo, ou da cessação dessa extensão, conforme as disposições do parágrafo 2), indicando, em cada um dos casos, a data em que a presente Convenção passará a ser, ou deixará de ser, aplicável.
ARTIGO 33 — Registo
1) A presente Convenção será depositada na Organização e o seu secretário-geral. enviará cópias autênticas a todos os Governos signatários, assim como a todos os Governos que a ela aderirem.
2) Logo que a presente Convenção entrar em vigor será registada pela Organização em conformidade com o artigo 102 da Carta das Nações Unidas.
ARTIGO 34 — Línguas
A presente Convenção é feita num só exemplar, nas línguas inglesa e francesa, sendo ambos os textos igualmente autênticos. Serão preparadas e depositadas com o original assinado as traduções oficiais na línguas russa e espanhola.
Em fé do que os abaixo assinados, devidamente autorizados pelos seus Governos respectivos, assinaram a presente Convenção.
Feita em Londres aos 5 de Abril de 1966.
ANEXO I — Regras para determinação das linhas de carga
CAPÍTULO I — Generalidades
As regras pressupõem que a natureza e estiva da carga, o lastro, etc., são tais que asseguram ao navio estabilidade suficiente e evitam a fadiga excessiva da estrutura.
As regras pressupõem também que se cumprem os regulamentos internacionais, se os houver, relativos à estabilidade e à compartimentagem dos navios.
Regra 1
Resistência do casco
A administração verificará que a resistência estrutural geral do casco é suficiente para o calado correspondente ao bordo livre marcado. Os navios construídos e mantidos em conformidade com as regras de uma sociedade de classificação reconhecida pela administração podem considerar-se como tendo resistência suficiente.
Regra 2
Aplicação
1) Aos navios de propulsão mecânica, bem como aos batelões, barcaças ou outras embarcações sem meios independentes de propulsão, deve ser atribuído bordo livre, determinado em conformidade com as disposições das regras 1 a 40, inclusive, deste Anexo.
2) Aos navios que transportarem madeira no convés pode ser atribuído, além do bordo livre prescrito no parágrafo 1) da presente regra, bordo livre para transporte de madeira no convés, calculado em conformidade com as disposições das regras 41 a 45, inclusive, do presente Anexo.
3) Os navios previstos para usarem velas, quer como único meio de propulsão, quer como meio auxiliar, assim como os rebocadores, devem ter bordo livre calculado em conformidade com as disposições das regras 1 a 40, inclusive, do presente Anexo. A administração pode exigir-lhes bordo livre superior ao que é assim definido.
4) Aos navios de madeira ou de construção mista, aos navios construídos de quaisquer outros materiais aprovados pela administração, assim como aos navios cujas características particulares de construção tornarem injustificada ou pràticamente não viável a aplicação das disposições do presente Anexo, será atribuído bordo livre fixado pela administração.
5) As regras 10 a 26, inclusive, do presente Anexo aplicam-se a qualquer navio ao qual seja atribuído bordo livre mínimo. Podem ser concedidas derrogações aos navios aos quais tenha sido atribuído um bordo livre superior ao bordo livre mínimo sob reserva de as condições de segurança serem julgadas satisfatórias pela administração.
Regra 3
Definição dos termos empregados nos Anexos
1) Comprimento. - O comprimento (C) é igual a 96 por cento do comprimento total medido sobre uma linha de água traçada a 85 por cento do mínimo pontal de construção medido da face superior da quilha ou o comprimento medido da face de vante da roda de proa até ao eixo da madre do leme naquela linha de água, se este for maior. Nos navios projectados com diferença de imersão, a linha de água na qual é medido este comprimento será paralela à linha de água carregada, prevista.
2) Perpendiculares. - As perpendiculares a vante e a ré devem ser conduzidas pelos extremos de vante e de ré do comprimento (C). A perpendicular a vante deve passar pela intersecção da face de vante da roda de proa com a linha de água sobre a qual é medido o comprimento.
3) Meio do navio. - O meio do navio é o meio do comprimento (C).
4) Boca. - Salva disposição expressa em contrário, a boca (B) é a boca máxima a meio do navio medida na ossada, para os navios de casco metálico e medida fora do forro para os navios de casco não metálico.
5) Pontal na ossada:
O pontal na ossada é a distância vertical medida da face superior da quilha até à linha recta do vau do pavimento do bordo livre. Nos navios de madeira e nos de construção mista, o pontal é medido desde o canto inferior do alefriz da quilha. Quando o navio tem secção mestra reentrante na parte inferior ou quando as tábuas de resbordo são muito espessas, o pontal é medido desde a intersecção de uma das faces laterais da quilha com o prolongamento da parte chata do fundo;
Num navio com trincaniz arredondado, o pontal na ossada deve ser medido até ao ponto de intersecção do prolongamento das linhas na ossada, do vau e da baliza, sendo esse prolongamento feito como se o trincaniz fosse de quina viva;
Quando o pavimento de bordo livre tiver salto e a parte levantada desse pavimento se encontrar acima do ponto em que o pontal na ossada deve ser determinado, este deve ser medido até uma linha de referência que é o prolongamento da linha da parte baixa do pavimento paralelamente à parte levantada do mesmo.
6) Pontal de bordo livre:
O pontal de bordo livre (P) é o pontal na ossada medido a meio navio aumentado da espessura das chapas dos trincanizes, se os houver,
e aumentado ainda do valor (T(C-S)/C) se o pavimento de bordo livre exposto tiver revestimento. Nesta fórmula:
T é a espessura média da parte exposta do revestimento fora das aberturas do pavimento; e
S é o comprimento total das superstruturas como está definido no parágrafo 10), d), da presente regra.
O pontal de bordo livre (P) de um navio que tenha trincaniz arredondado com um raio superior a 4 por cento da boca (B) ou que tenha obras mortas de forma não habitual, é o pontal de bordo livre de um navio que tenha amuradas verticais e a flecha e área transversal da parte alta igual à da secção mestra do navio real.
7) Coeficiente de finura total. - O coeficiente de finura total (C(índice b)) é dado pela fórmula ([ver documento original](https://files.diariodarepublica.pt/1s/1969/08/19901/10791141.pdf)) na qual:

8) Bordo livre. - O bordo livre fixado é a distância medida verticalmente a meio navio desde o bordo superior da linha do pavimento de bordo livre até ao bordo superior da faixa horizontal que representa a linha de carga adequada.
9) Pavimento do bordo livre. - O pavimento do bordo livre é normalmente o pavimento completo mais elevado, exposto à intempérie e ao mar, que possuir dispositivos permanentes para fechar todas as aberturas situadas na parte descoberta e abaixo do qual as aberturas praticadas no costado possuírem dispositivos permanentes de obturação estanque. Num navio com pavimento de bordo livre descontínuo, toma-se como pavimento do bordo livre a parte mais baixa do pavimento exposto e o seu prolongamento paralelamente à parte alta do mesmo pavimento. Se o armador o desejar e sob reserva de aprovação pela administração, um pavimento inferior pode ser designado como pavimento de bordo livre desde que seja completo, permanente, contínuo no sentido transversal e contínuo no sentido longitudinal entre a zona das máquinas e as anteparas dos piques. Quando este pavimento inferior apresentar saltos, considera-se como pavimento de bordo livre a parte mais baixa e o seu prolongamento paralelamente à parte mais elevada do mesmo pavimento. Quando um pavimento inferior é designado como pavimento do bordo livre, a parte do casco acima desse pavimento considera-se como uma superstrutura, no que diz respeito às condições de atribuição do bordo livre e respectivos cálculos. É a partir desse pavimento que o bordo livre é calculado.
10) Superstruturas:
Uma superstrutura é uma construção que se ergue sobre o pavimento do bordo livre, é fechada por um pavimento superior e se estende de um a outro bordo ou tem os lados recolhidos em relação ao costado do navio não mais de 4 por cento da boca (B). Um convés subido a ré é considerado como superstrutura;
Uma superstrutura fechada é uma superstrutura com:
As anteparas que a circundam, de construção eficiente;
ii) As aberturas de acesso nestas anteparas, se existirem, providas de portas que satisfaçam às disposições da regra 12;
iii) Todas as outras aberturas praticadas nos lados ou nas extremidades providas de dispositivos eficazes para as fechar, estanques à intempérie.
